They can't legally sue you for a debt already discharged in bankruptcy anyway!  Plus it is in violation of the FDCPA to threaten to sue if they really do not intend to.  And yes, they can be sued for these violations - I would definitely see a lawyer about this.

Put a fraud alert on your bank accounts and also with the big three credit agencies (Experian, Equifax and TransUnion).  NEVER confirm information like this unless it is someone you KNOW and you have called them first.  

If they call back to harass you about an alleged debt, demand that they comply with the law and send you a debt validation letter showing the original creditor, amount owed, date of loan, last payment and also whether they are legally entitled to collect this debt in your state.  They must prove that you do owe the debt.  If they can't or won't send this information via MAIL (not email or fax), then they are attempting to scam you.  But please - put an alert on all your financial accounts.

These people called a few months ago trying to "scare" me & my husband into paying a 9,000 credit card debt that was written off in bankruptcy court back in 2007. I was given this 855 number to call with the name Ellen Matthews. Called and told her fine, I will see you court because we don't owe this money. Ellen said that it was regarding MBNA who ever that is. Found the name Franklen Moss and Associates when I looked up that 855-233-8882. Just got another call today. In the state of FL any debt collector who threates to sue you over a debt beyound the statue of imitation is in violation of the Fair Debt Collection Practice Act. The statue of limitation is 4 years for open ended accounts including credit card debt. Since they called today, I plan on getting a lawyer and suing them for this violation

I got the same call for my husband. She was very rude said had summons for him. She called from 907-134-5678.

They're calling you off of a local number using VOIP (Voice Over Internet Protocol), and encouraging you to call a 1-866, 1-800 (and so on) with a false case number.


Is this harassment illegal?
YES.

Report it to your local FBI.

Since a legitimate website for them has not been located... YET, don't file a complaint with IC3.gov, just email or call your local FBI and mention any interactions you've had with them, record the phone calls if you can for further proof.

We need to go back to giving the death penalty for these like these.

In the past month "Franklin Moss & Associates" have called my parents house, my brother's house and today my work.  My co-worker not knowing who they were asked the caller if she wanted to talk to me and the caller said no, she just wanted to know if anyone would be here tomorrow.  What kind of legit business declines to talk to the person they are calling?  My co-worker was given a different # than I've seen in all of these posts.  888-410-3843

I also just got a message from franklin moss and associates. They gave me a case number and then asked me to confirm last 4 digits of my social. I was a little suspicious and i told the rep on the phone that im uncomfortable releasing that info..... and then he tells me im part of a civil case and they are trying to deliver legal documents. I tell the guy i am not part of any civil case to the best of my knowledge. Then he gets loud with me and tells me he knows the last 4 digits of my social and tells me the first and the fourth of the last 4 digits. I tell him that means nothing to me and he tells me im being rude and that I should be ashamed of myself and hangs up the phone on me.

My husband just recieved a phone call saying that Franklin Moss & Associates were loking for me and gave a phone number and case number about a 'court summons'.  I was concerned and wondered why they would call my husband and not my number.  I called the number and spoke with a man who asked if I was "my maiden name" and I said yes.  Then he asked me to confirm the last 4 digits of my social security # (whick was correct) and I stupidly said yes.  He looked up 'my file' and said he would have the woman in charge of my case call me back.  I had a really bad feeling about it and tried to Google Franklin Moss...that's when I found these posts.  Now I am really worried.  Have I given out/confirmed my info and it's going to hurt me???!!!  HELP!!!  WHat should I do???

i am getting the same calls for my sister except the number is different 888 434 2409.  they were saying they had a summons to serve her and my number was the contact number she had left.  This is wrong

My Sister just got a phone call from Franklin Moss and Assoc. She had NO idea it was a scam and I wasn't with her.. They told her a BIG ole story about an old credit card bill and scared her BAD! So, she gave them her checking info!!! What can we do???

My mom and I have both been receiving phone calls from 205-134-5678, and Alabama based number.  She lives in AL, and I only recently moved.  Same story as all the previous posts.  I answered, and the man I spoke to wouldn't give me any information, but did say it was regarding scheduling time to deliver court summons.  I was given the 855-233-8882 number to call as well, and when I did, the man who answered was incredibly rude, neither person I spoke to ever gave the "this is an attempt to collect a debt..." that debt collectors are legally required to give.  The man at the second phone number wanted the last 4 of my SS#, but of course I wouldn't give it to him.  He wouldn't speak to me after that.  In fact he hung up on me.

Just to give anyone who is nervous about whether this is real or not- I asked my sister-in-law, who is an attorney to please check to see if there are any court cases with my name attached.  She checked both my maiden name (the name these people had) and my married name, and found nothing.  So, this is definitely a scam.

To the Thieves who are low enough to steal from people who work hard and also struggle to makes ends meet choosing instead to work multiple jobs and go to school and earn money with dignity, doing the right thing to earn money.  

I fell for this scam and yes -  YOU THIEVES took most of my paycheck.  I am a hard working person, the sole supporter of my family and since this experience I have had to borrow money to get through the month, (yes, not a problem for you - I know - you don't have a conscience) but I'll tell you anyway, I've fallen behind on my bills have had to set up alternate dates for payments.  And wonder how I will pay for my rent - this month.  But that's ok right - cause you don't have a conscience?  Cause you thieves got your money and it seems like the thieves have no desire to stop stealing.  Thieves also continue to call me from various 408 #'s and don't let up.  I suppose once the thieves have a person they've scammed or telephone plus some personal information the thieves hope to scam more money from them - from me.  I pray every day you forget about me and leave me alone.

i received a call today stating pretty much the same thing.  Case number, court summons,call the 855-233-8882 number,  etc.  They wanted to speak to my husband.  When I informed them that he was not available they then spouted off the last four of his social # and said something about third party privacy.  They said they had to deliver a summons for civil court and when I asked what it was regarding the man was rud and said my husband should know to go ask him. They said that asummons would be delivered tomorrow and that he needed to call to set up a delivery time.

I fell for this scam, I wish I would have googled this number while on the phone with these people....
