They called a friend that lives in another state and told her that I had bad checks and I was going to be in a lot of trouble if she did give them my number or contact me. Yeah right nice try. You actually told another person my personal business except it is not real. Move on cause we are not falling for this. I won't even call them back cause I know how convincing they can be and I am not even going to put myself at risk of letting them upset and scare me.

I just recieved a mssg from this man today.  Kinna freaked me out at first.  The more I listened to his mssg the more unproffessional it sounded. No details, no letter had been mailed to me of a notice, no day hours of when to call back, didnt state where he was calling from.  So I told my mom. First thing she said was "SCAM" I left him a mssg telling him I needed more details before I looked this up.  and needed to know where he was calling from.  I DARE you to call me back dude.

They're claiming to be Davis and Cohen attorneys at law. I searched it. It's a real attorneys office but not even close to being the correct number. I asked for a license or bar number and they hung up. SCAM

Recieved a call from 855-238-6520 and they identified themselves as Donald Lomax and investigating me for check fraud and I was to call him. So I called the number and some other man picked up and all I heard was all kinds of chattering in the background sounding like a collection type place.

Just got a message from Ted or Tad Morgan dept collector (855-238-6520) stating he had a complaint filed against us for fraud and we needed to contact him ASAP.  He calls on a weekend, we returned the call same day several hours later, nobody in office.  There is no Fraud investigation against us because we are not crimimals nor do we break the law, we do own a small business and have been recieving numerouse emails and phone calls from telemarketers with rediculous complaints and scams.  This is harrassment from a tele marketer.  Checked number on google, found it is a telemarketer with complaints filed against him for harrassment and obviously fraudulant legal complaints. SCAMS!    DO NOT GET SUCKED INTO THEIR SCAM!      Legal cases are served in person or by registered mail, NOT over the phone!

Caller said they are with an attorney. Had "pieces" of personal information and background. None coincided and dates were wrong. Threatened me with jail and prosecution. I told them I wanted there info to give to my attorney. Beware!!!! VERY PUSHY AND CONVINCING!!! USING SCARE TACTICS!! They provided me with phoney number and name .... lady said she was a paralegal and .... ended up using the Lords name in vain when I asked for a supervisor. She said she was connecting me an attorney. Who was using a different name as stated by other complaints. Used Kevin Davis with a number 202-999-4289....

Prank Call
I just got the same message yesterday from a Todd Morgan. When I ask for details he started to get belligerent I told him to call my lawyer he hung up on me.I called the number back and flustered the person who answered when I told them I would sue them for harassment and he hung up. Then a female answered gave some law office named Davis and Cullen, which doesn't exist, and I gave her my lawyers # and hung up. Strange how they had so much information on me.

I have received a call from this number twice this week. It is a recording advising they are investigating check fraud but they are actually looking for my sister who gives me as a reference. They say they are from an attorneys office but the guys name is Todd. I have notified my sister in which they are supposedly looking for who in return has advised me that this is fraud.

This is a collections company trying to intimidate people who may or may have not taken out a pay day loan from Emerald marketing. A truly despicable company to begin with. They're attempting to charge people with check fraud for not repaying a high interest payday loan.

Guy got pretty defensive when I started pressing him for information...if you do pick up the phone make sure you mention the call is being recorded and you'll be forwarding the recording to you local Attorney general...you could hear the tone of the call change dramatically

I got a call from them and they left a message. You can tell the guy is reading a script. Thanks to everyone for posting on this site to let everyone know it is a scam. When my uncle died, my aunt started getting calls like this asking for her checking account information. She was old and trusting, and gave it to them. We had to go to her bank and put a stop to their shenanigans. America...land of the free, and home of the scam......

I received a phone call from this number, I have received numerous phone calls just like this one only from different phone numbers, such as 888, 877, 866.....it was a recording left on my voice mail, from a Ty Morgan, telling me that I had litigation for "Check Fraud"....and left this phone number 855-638-6520, I have received phone calls from the number 638-6520 with different area code I can't count how many times....I received one last week also from probably the same company, but when I told the man not to call again or I would have my lawyer contact them I have not received another phone call till now, but I believe that they just switch people and company names....whatever you do, if you do answer the phone call, do not give them any information...period...this is an annoyance...and something needs to be done...these people are also probably harassing senior citizens which really hacks me off.....

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Received this call 2 days ago the wanted to collect a debt and said he was a process server, on behalf of shamrock marketing from 2007, I told them i have already taken care of this debt but they insisted i still owed them and that if i didn't pay them today then they will send  a sheriff to my home  and they will take me to court for check fraud. I ask to speak to his supervisor he said i couldn't? and became very rude so i called my attorney and she advise me that a process server does not collect a debt they just issue a summons or will send a letter, they will not call you and try to collect a debt that is not their purpose. In the state i live in payday loans are illegal if they were to take you to court it would be thrown out.

got msg, so i hang up,   if they are for real, they would directly mention your name or be polite,  just by saying
that he is a processor for bank , check fraud and just asking for you to call back with out any other info, that is
scary and sounds like a fraud, its a recorder,   well I answered and thats how I know that it's a recorder,
if theres any concens with check fraud or your account,  your bank will call you directly,  right ?
so if you own or have a checking account,  you call your bank and let them know you received a phone
call saying there was fraud on your account..  easy as that!
