Debt Collector
A man named David Everett left a message with my employer.  I do not have any outstanding debt so I don't know why he is calling my job or how he even got my office phone number.

Debt Collector
I was at work and received a call from Tony that work at TR solutions. He stated that I owed a payday loan which I do and was I ready to make some type of arrangements to pay this loan off. When I looked at the number it said WalMart. I asked him why his caller ID stated that the phone call was coming from Wal Mart. He stated he did not know. Told him that I was at work and that to give me a number where I could reach him. He gave me two numbers 855-868-2576 and 855-251-3265. When I call the number I just get a dial tone. I am not trying not to pay the loan I have had some finanical issues but will pay it off  ASAP.

Really? The jerkwads left "good luck to you" on my voicemail less than 2 minutes after being told it was an inconvenient time to call me... Pretty sure thats a violation of FDCPA laws.

First pretty sure ?The Boss? works for this TRS, don?t take anything into account that he/she states.  Second in regards to the statement incorrect they can if in contract it states a volutary contract that u signed?  voluntary   spelling should be correct if you want to be taken serious.

Third find out if your state even allows voluntary wage assignment, is also is one area where the federal government has become involved. Federal Trade Commission regulations prohibit loan companies and retail installment sellers from securing payment with a wage assignment unless:
* the assignment can be revoked at any time by the EMPLOYEE;
* the assignment is a payroll DEDUCTION plan starting at the time of the transaction; and
* the assignment applies only to wages already earned when the assignment is made.
Several states have passed laws incorporating similar restrictions on assignments arising out of consumer credit transactions or prohibiting such assignments altogether.
Those states that allow assignment of future wages often restrict the amount of an EMPLOYEE'S wages that can be assigned in the form of a maximum percentage or a dollar amount. They also may put a limit on how long into the future an assignment can be enforced.
As with GARNISHMENTS, wage assignments cannot be enforced against a public sector employer unless a law allows public EMPLOYEES to assign their wages. Some states have enacted laws that treat government EMPLOYEES the same as private sector EMPLOYEES where wage assignments are concerned, while others place more restrictions on the public sector.

From the reports it seems that TRS is violating FDCPA laws:
15 USC 1692d § 806. Harassment or abuse
A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.
(6) Except as provided in section 804, the placement of telephone calls without meaningful disclosure of the caller?s identity.

§ 807. False or misleading representations
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section
(2) The false representation of?
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
Steps you should take against these clowns:
1.  Send a cease and desist letter
2.  Request verification of debt in writing
3.  Get an attorney who specializes in FDCPA laws, each infringement could cost the company up to $5000.00
Above all else DO NOT CONFIRM ANYTHING, GIVE THEM MONEY OR RELEASE ANY BANK INFORMATION!!

Debt collector - trying another method of contacting you.  They told me it was regarding a property address that I am affiliated with.  Unfortunately - I don't own any property.  I goggled the number & found out it is a debt collector.

Sweetness, they don't do that unless there's a judgement from a court.  A faxed demand from someone won't do it.  I know.  I've had many previous lives and one of them included processing payroll checks for a large hospitality industry in the western US.  We had some leins on some people's pay checks but we couldn't act on one unless there weren't a judgement.  Your human resource lady either lied or doesn't exist.

This a***ole wouldn't accept the money I offered him to make payments and pay this damn loan off. Now my human resource lady brought me something about a declaration of wage assignment and they're taking money out of every damn check for who knows how long.

A David Everett from TR (Total Recovery) Solutions. Claimed I owe on a payday loan from Peak3 payday loans, but the e-mail he has for me on file I haven't used in almost 2 years. Said he was going to "debt" my paycheck. I informed him that garnishment was illegal in the State of Texas. He said it wasn't a garnishment but a deduction (whatever). I told him to send me everything in writing and I would call back to discuss. He said they mailed me something last week, but I haven't seen it. At least this jerk could speak english.
