Caller named Calvin Baker keeps calling a friend of mine.  She is filing a police report but he will not stop calling.  He said legal issues and he was bigger than the cops.  Any suggestions?

Sure it's a good day! If I got a call like that I'd be laughing hysterically for hours. That's when frauds can get really annoying. When you've laughed at them so long your facial muscles start to ache. When it starts to hurt when you smile, you know you've talked to a really good one!

JUST SAY FBI WHEN YOU SEE AN UNWANTED CALL... AND THEY WILL DISCONNECT THE LINE...

I WENT A LOT FURTHER THAN THAT CALLING AND HARASSING THEM FROM MY BLOCKED NUMBER FOR A FEW DAYS NONSTOP... THEN I LOCATED WHERE THE REAL NUMBER THEY USED WAS CALLING FROM AND I SAID WE WERE IN THEIR CITY, STATED THE CITY, AND SAID SEE YOU SHORTLY AND HUNG UP... THAT NUMBER WAS DISCONNECTED IMMEDIATELY

Employees have been receiving calls from 855-253-4758 (we are a call center so everyone's been fortunate enough to be harassed by these callers who threaten jail time and lawsuits unless the employee purchases a Walmart giftcard for these harassers as payoff).

His name is Paul Nixon. Called me at my place of employment constantly demanding money and wanted to speak to my manager. I told him no. He didn't stop until he reached someone in HR. I had to make a police report.

Report the calls to the FTC, the FBI and your state's Attorney General.  No one gets a call ahead of time giving them a heads up they'll be arrested - the cops just show up!  Other than that huge, red waving flag screaming "fraud", you can't pay your way out of being arrested either.  Since they have you and your mom's personal info, make sure you both call your financial institutions and the credit agencies (Experian, Equifax and TransUnion) and have them place fraud alerts on all your accounts.

Don't let them scare you - these people count on that because they know someone who is scared is more likely to pay money to them.

There will be no warrant because they're scammers, and as we all know, law enforcement doesn't call you ahead of time to tell you they're coming to arrest you!

These scam artists have tried harrassing me on my cell & work. After explaining I have an attorney & filing for bankruptcy, the "gentleman" continued to curse & threaten me & even my life. When I asked him for the acct number & supposed amount owed, he made up some legal case number & some bogus amount Ive never borrowed. A sherriff even spoke with him on my behalf & the jerk cussed him(the officer) out!! Nice try Edward or Raymond Scott, whatever your fake name is! LOL

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

This "I.D.I.O.T.", from India, has called my cell phone at least 6 times this morning. He wans to talk to Tawnya Evans (from Austin) and when I tell him that I don't know any Tawnya and this number has been MINE for almost 10 years, he says "Sir you are not being truthful here, I must talk to Tawnya Evans and you will help me to do this now" . Well, after using words that I haven't used since I retired from the oil fields, I hung up on him. The number on the caller ID was 1-855-253-4758. These people don't learn too fast, so I will probably get another call from that number again. Let the fun continue!

855-253-4758 Called my house at 7:30 am. When I tried explaining that was against the law and wanted their information the woman kept trying to get my personal information. I hung up. I called back and some guy named Ramone from Bureau of Criminal Investigations answered stating I stole money and they were coming to arrest me. I laughed and told him the scam wasn't going to work on me and I know for a fact there is no warrant out for my arrest. People....they will NOT call you at home and harass you if there is a warrant out for you. SCAM. Just hang up or if you feel like annoying them then do like I did....just keep laughing and talking while the jerk talks and then tell him/her to have a nice day.

Man stated his name was "Steven Mark" and my caller ID showed him calling from 850-325-5070. Rude man calling into our company for one of our employees. When I took the call because of his rudeness to our receptionists, he was talking fast and quite frankly, he was pissed off because the employee he was wanting to speak with was unavailable, so he accused me/us of lying to him and wanted my name and title because he was going to name me as part of the investigation. Had to tell him to "shut up" (which btw, REALLY pissed him off) and to identify himself. That's when he claimed he was an investigating state officer. So I read back the phone number (caller ID) and stated I would have the employee call him back at that number. He told me no, and proceeded to give me a different number for the employee to call back. It was the 855-253-4758 number and ironically, this 'investigating state officer' didn't want the employee calling for him, but instead to ask to speak to Raymond Scott.  LOL  Nice try buddy!

They we're trying to say that they were calling from a criminal investigating team. I have been scammed before and paid because they said if I hadn't there would be a warrant for my arrest. I contacted a local detective and they stated this is a scam.
