Triple-B will send a letter or two, which R&L may safely ignore. BBB has no power to get any company "closed down". If you want relief, I think you'll have to sue, and you get only until the end of this year to catch all the possible FDCPA violations. At least four solid ones are in your story.

The statutory damage cap is almost twice what R&L sought to extract from you. Any bank fees and penalties and that $400 which was looted from your account can be part of an actual damages claim, which has no limit. If your documentation of events is as thorough as your story suggests, a good consumer lawyer should be hapy to run the case on contingency. Successful FDCPA plainitffs shift all their legal bills to the loser. I know you have counsel now, but if he's never fought a collector in a hearing before, you might want to shop around.

Submission against R &L with BBB

I was notified by Rossi & Lombardi that a debt of mine held with First National Bank in regards to a Legacy Visa account opened in 2005, had been turned over to them for collections.  The representative that called told me that the amount was $563.39.  We discussed payment amounts and settled on $20 a month with 8/2/13 being the time they would call again to "reset" the amount or provide other payment options.  12/31/12 I paid the initial payment of $20 with my debit card, Authorization #E4F7FE

Payments have been made every month since then 7/11/13  I noticed a $403.49 charge from them!!!

They are no where on my credit report as a collection agency with the above mentioned account.

When I noticed the $403.39 deduction I got their file out of my cabinet and realized they had not sent me any verifying letters on this account (RED FLAG AGAIN)
I looked online (Google) for their website to get a phone number and called them at 1-855-289-0725. They were closed but I left a very irate message for them to call me back.

I called my bank immediately after and was advised to file a dispute of charges with them and that would mean to close my debit card (fee involved).  I have canceled my debit card 7/11/13 and a fee of $15 is applied for a new card (I would not have to cancel if they had not abused me); I think they are responsible for this fee as well.


7/12/13 8:16 a.m. I called R& L back and spoke with "Steven" he gave me a direct line to him 716   .332.   1658 or use his extension (100) when using 855 #
He was hostile with me, belittling me, saying I owed this to them (or Legacy Visa) and that I had NEVER made any payments to them. I told him I in fact had been paying since Dec 2013 and he told me to prove it and to watch my tone with him; after he'd been yelling at me.  I stated for him to watch his tone with me since he was to be the professional.  I then told him I had been in contact with the BBB and the FTC and he better comply, he changed his tune.  Said he would look into refunding my money and for me to call back later in the day or Monday at Noon.  I called back at noon (11:19 a.m. my time CST) and got his voice mail, 11:20 a.m. I called back on 855 number using his extension and got his voice mail, 11:21 I called 855 # getting operator and I asked to speak with "Steven" (I would swear it was he who answered the phone) they asked who was calling so I told them and was transferred to his voice mail.  My boyfriend called him immediately after I hung up using his name (not mine) and spoke with "Steven" and "Steven" stated that I owed them the money; so that told me his "looking into a refund" was only a ploy to get me off the phone and he was avoiding my calls.  
since BB is closed between 12-2 I had to wait to call them.
1:10 p.m. CST I called the BBB and they informed me to call Attorney General in Buffalo, NY to report my claim with them, as well as with the BBB.
1:34 p.m. CST I called the Attorney General and they are sending me a form to file with them to add to their case against this company.

I have done all this, and yesterday I was diagnosed with Mono so I am not feeling the best and now have to deal with this!!  

Everything I have stated in this statement can be proven with copies of phone records, and bank statements.  I contacted my attorney as well, unfortunately, he is out of state, but if something is not resolved by the time he is back, I WILL proceed in that direction.

DESIRED OUTCOME:
I want refunded the amount stolen from my bank account and the amount to cancel/renew debit card
$563.39 + $15 = $578.39  
However, I am sure I will have fees for overdrafts and returned checks later!!!!!! This is just the amount now that I know.

I would also like this company closed down so others are not put in this position.

I just got taken by them too.  You need to call the BBB and then the Attorney General in Buffalo, NY.  I did today and they are suing the company so you may be able to get your funds back.  Also, contact your bank and dispute the charges and they may be able to help you get your funds back as well.  I am trying all the above mentioned ways to retrieve my funds.   Better Business Bureau website and their number http://upstateny.bbb.org/contact-bbb/  Once you tell them it's in regards to R  & L Capital they will tell you to contact the Attorney General and will give you that phone number (that's what they did with me today). Attorney General said the more complaints they get the better and stronger their case against R & L will be.  Good luck, these guys are lower than the clay inside the earth's core.

The triple-B is an impotent glorified business directory at best and a payola scam at worst. Keep copies of all those calls and your copious notes safe. You'll need that material for the hot mess you can make in court for these extortionist bums, who will have to cover your legal bills as well when they lose or surrender. You want relief, you have to seize it yourself, not file complaints and wait for a rescuer who never comes.

Federal law does *NOT* lay any blanket prohibition on collector contact at a place of employment. Permission to call there is not illegal until it is expressly denied. Scott's story exhibits plenty of other FDCPA violations, however, sufficient to earn him good payback.

I have received 3 calls today alone from this company, and once yesterday.  They also somehow got my mom's phone number, who I haven't lived with in 15 years, because I am a grown woman.  

6/18 10:19 AM:  Sounded like first line was a cut off from a recording and it sounded like he didn't even know his name, like he read it from a script.  He said hello, my name is...and he paused then said it.  Said his name was Steven Sancos (?) from RL Capital.  Has been trying to reach me and wants to try to help me.  Need to call by 6 PM or he will have to report that I am uncooperative.  He called from 855-208-2017 and said to call 855-269-6470.

6/19 11:03 AM:  Samantha Evans, paralegal from R&L Legal Services.  Stated she was following up on some paperwork she sent out to me in regards to an affidavit that's going to be filed with my county.  To avoid an appearance ticket contact 716-362-1597.  And she left me a reference case number.  She called from an "unknown" number.  This is the same woman that called my mom right after she called me and told my mom that I would have to go to court if I didn't call back and tried to get my mom to give her my address.

6/19 11:40 AM:  SAME EXACT message from yesterday from Steven Sancos.  CLEARLY a recording.  

6/19 4:36 PM: Alfred Martin of RL Capital stating his associates have tried to reach me unsuccessfully and there are some issues and paperwork I need to fill out.  He said his direct line was 716-362-1591 and the toll free # was 855-269-6470.  Very important he hear from me by 6 PM, if not, he will have to let his associates and client know that I was uncooperative and non-compliant in the investigation.  This man, had the same EXACT voice as "Steven Sancos".  

I am reporting them to the BBB.

It's illegal for them to call your work.  It's also not okay for them to collect a debt, even if it is real, by using fake names and lies to collect the debt.  If a "private company" bought the debt from the original creditor, and R&L is collecting on behalf of the private company, they should be disclosing that company to you and/or providing proof of the debt.

Received a call stating I have 24 hours to call back. Called from a private number and gave me the 855-269-6470 number and an extension to a Donna Demochi. A US Case number was even given with the voicemail. So I called, was R&L Capital and Donna was on lunch and her secretary was going to pull up my info. Stated I'd like to receive a notice regarding this matter in the mail. It was for a small debt I owed to a company that was legitimate, but was also aware it was a scam trying to collect money for themselves, and they were not working for the company. Said 4 notices have already been mailed to me so I said I will contact the company myself to make sure you're their client collecting on me. They said that would not help my cause because the company sold such and such to a private company and I would not be able to verify. It ended by her stating that since I won't cooperate, court documents and papers will be sent in the mail. The most disturbing part of this is that they had contacted my work and gave them the case number and 24 report to call or possible arrest for a US Fraud matter and my supervisor had called me. Such fraud.

Unless the payday loan didn't exist.  Or the statute of limitations has expired. Or the debt isn't real.

The reason there are collection laws is to protect consumers from being harassed, lied to, intimidated, etc.  The "you're a deadbeat thief" argument is the ONLY ONE that debt collectors use. Ever.

Collectors know full well what is legal and what is not in terms of collecting debt.  Many just choose to ignore the laws.  Some even flash their cash around Buffalo and on the internet.  

Payday loans target people in tough economic situations.  Not everyone who defaults on one is a thief, especially in this economy.  

But using lies to trick someone into paying money is a crime.

The name of the company is R&L Capital, so they can hold themselves out as Rossi and Lombardi, a fake company.  But now we know that Fingerhut is an alleged creditor we should watch out for.  Expired debt? Debt that's been resold a bunch of times?

I'm suspicious of Robert Morton.  I don't think he is real.  If he is real and he paid R&L money, he most likely got duped.

What these callers are doing is called "extortion." It is illegal and carries a prison term as punishment.

I bill people, too, as part of my work, as does anyone with a business.  If I had someone with a past due account and sent it to a collection agency for collection and that collection agency used tactics like this, those tactics would be imputed to me and I would lose my state license to practice my profession.

So stop getting high, wasting our oxygen, and start earning your stay on this planet with gainful employment rather than sucking blood from other people like a parasite.  After all, it's the time spent hunting down and incarcerating creeps like you that make our police and public safety costs in this country so high, and the added costs of special phone equipment to block your special type of cretanism that keeps our phone bills so high and forces us to ignore otherwise potentially legitimate and important calls.

I got a call from Lenny Levine on my voicemail with a recording exactly like yours.  It seems from reading posts here that they are scam artists asking people for their social security numbers and bank numbers.  Don't give them any info.  I don't know how to report them, but I am going to call BBB and will let you know what they say about stopping these annoying calls.

Message from Leonard (Lenny) Levine.  Did not identify company.  Claims he has been trying to reach me for couple of months and if I don't return his call today, he will report that I am not cooperative and non-compliant while he is "desperately" trying to help resolve my problem.  Of course I would need to contact his office by 6:00 p.m.

they ALMOST got nearly $1500.00 of my money!!  This has got to be a federal crime!  I am so upset with myself for believing they were real - BUT things started getting fishy when they couldn't send me anything for MY records in the mail - and they said I "authorized" it via phone call - so I asked them to please send me the phone call for my records, and they couldn't do that either.  BS!!  Shame on me for giving them my info.  I put my banker on a 3 way call with them and backed them into a corner - he just got pissed and said "see you in court" and hung up on us...oooook???  Canceled that debit card immediately - now I need to know how to report them because they need shut down.  R & L CAPITAL LLC OUT OF CHEEKTOWAGA, NY ARE FRAUDS!  SCAMMERS!  THE LOWEST OF ALL LOWS!  (they even talked bad about my deceased mother who I lost to breast cancer 3 years ago, I was only 26 and tried to explain to them the financial situation it put me in)  awful awful people - I cried for 15 minutes after that phone call :(  what a waste.

They refuse to send you anything in writing to your home address.  Legally, in order for them to collect any money from you, they have to do so.  Just be careful who you are giving money to just anyone who calls you saying you owe a debt.  They have accessed your credit report.
