I also receive harassing phone calls from Susan James from 855-272-1365. She says I am giving up my rights to answer a legal action because I will not answer her or return her call. She never states who the phone call is for, what company she is calling from or what purpose her call is for, such as debt collection. I have no clue who she is trying to say I owe money to.

I received the same call.  I have some debts but, I knew this wasn't a legit call because I am in touch with those I owe.  Plus, I never heard of a "pre-legal claim" and "...placed in a refusal status".  Also, as stated elsewhere, any credible company would not use an auto-call system without using the name of the intended recipient.

got a call, from a recorder, mentioning an account by name saying there was "pending legal action"... right. The account mentioned has been closed for over a decade and I've had half dozen credit cards since then, not to mention home loans etc. This group is fishing.

Just a follow-up to my original post. I looked CMS (Credit Management Solutions) up in the North Carolina listing of licensed debt collectors, and they are not licensed to do business in NC. New laws were passed in NC in 2010 that restrict any debt collector from attempting to collect a debt in this state without a license. It is a felony to attempt to do so. Their permit number must be listed on any letters they send you. If they call, they must identify who they are and they must state that the call is an attempt to collect a debt. These guys sent me a letter several months ago. No NC permit number was included. I've received 6 voice mail messages over the last three weeks from them. Some are from Susan James, and some are from a guy named John Anthony. I've made copies of all of them and they are in my phone records (I have a mobile phone). I met with a local attorney last week about this and we are goin to file a law suit against them for violations of the FCRA and North Carolina law. He was able to confirm right away that they are not licensed in NC and he took on my case for free. This is a slam dunk case that attorneys just love.

got a call from this number, from christine anthony , tried to sound very serious wanting me to call them with a "case number" saying they had some name and social security number. left no name of any company and when I returned call the answering service said some name so fast it was not clear who it was .what a waste of my time.

This Susan James person has called me twice in the past week. Same type of message implying legal action....says that if I don't call them by 5pm that I give up all rights in the matter. They never mention anyone's name or an account number. What a crock.

I noticed she did NOT say the call was an "attempt to collect a debt, etc", which is required by the FDCPA. These guys are idiots. Save those recordings and sue! Everytime they call and fail to mention this it's another violation. Not to mention that they are implying legal action when they are not attorneys.

Several recent calls from "SUSAN JAMES" at 855-272-1365 falsely claim someone at my phone number has a serious outstanding legal complaint.  "SUSAN" speaks as if she has trouble reading the script, and she uses several grammatical errors -- "...between you and I...." and "dialect" instead of "dialog" etc. (She insists on a formal "dialect between you and I...".)  Please close down this number and send SUSAN to first grade.

Made the phone call early this morning.  Didn't get an answer at the toll free number the first time.  However, someone did pick up the second time.  The first thing I noticed is this person had an attitude.  I didn't let it get to me and told him I had received a phone call concerning one of my credit cards.  He asked for the phone number which I provided.  The name associated with the number was incorrect.  He asked if it was me, which is a common question, to which I replied no.  He asked if the individual lived at my residence.  I answered no.  He then asked for the phone number again to verify and then he stated that he would removed it.  All the while he kept up with the attitude.  Now I realize these people have hard jobs and probably don't get paid much so I can let the attitude go.  He asked me if I needed anything else.  I stated that I have a couple of questions.  He said, "and what would that be?"  I asked for the physical address for the company.  He rattled it off very quickly.  I had to repeat everything just to get him to slow down.  After I took down the address he asked "what's next?"  I said that was it and that it was good to know that they are abiding by the rules that the FTC had put in place.  Not joking here.  He became super nice and started calling me sir.  That was the end of it.  So here is the information.

They are not listed with the BBB.  This information is important.  If a complaint has to be made to the FTC, then use this phone number and address.  Keep track if they continue to call after you have asked to be removed.  Also, if you are on a no call list advise them of that and include that in the complaint if they continue to call.

Hopefully I won't be hearing from them again.

I just received one of those calls.  I think I will give them a call tomorrow during their business hours.  Remember folks, laws have changed in our favor over the past 10 years.  Burden of proof is on them.  However, since I don't have any issues with the card they mentioned, we don't have it, I have the power.  There are three things I am going to ask them and demand answers to.  These questions are backed up with the power of the FTC.

1. What is the physical address of the company.
2.  Give me a direct number to the company.
3. The name of the person who is calling.

Generally you get some lower level employee who gets very alarmed when you ask these questions and inform them that they are required to give that information as per the FTC which governs their business.

In the past I had a collection company call me asking for a person that doesn't live in our house and has never lived in our house.  I called back and asked to be taken off of their call list.  The person on the phone was asking me for my SSN to verify.  I laughed and said there was no way I was giving out that information.  (I had asked the 3 previous questions before that, so I had their physical address)  So the lady on the phone, who provided me her name, became very rude and stated that since I wasn't going to provide that information she was going to assume that I was that person.  I hung up.

I proceeded to do a search of the BBB in the area where the address was located.  I found that they were in very good standing with the BBB and it even provided the name of the owner with a direct line.  I called and left a summary of what happened. (It was after hours) The first thing the next day I received a call from the owner apologizing and letting me know the lady I spoke to on the phone was going to get some retraining.  Problem solved.

I will post tomorrow how the conversation goes.  If it doesn't go well, I will file a complaint with the FTC.

Message left on answering machine.  Mentioned "written verification" of delinquency on account and that I was such an "outstanding customer" they wanted to give me an "opportunity to resolve this matter."

Uh, what?  I never had any business with Citibank.  They don't even know if they got the right number or not since the call was never addressed to a specific person.

They called me as well indicating there was a legal  claim that needed tobe resolved. I have 2 numbers. They called one number and when I gave them that number they indicated it was blocked form tehir sysytem. I gave them another number and the case pulled irght up. The name involved in the case (gas card issue) was not mine and I do not have a bank account with the bank that was involved.
