Received a call from Miss Clark stating that she was investigating one of my relatives and then she stated my sister's name.  I think this is a scam.  She even provided a case #?   Wow, these scammers are good.   The thing is they called my job and left the voice message on my phone?  How did they get my work phone?

The best suggestion on these type of calls: Hang up. If you were being sued, that's a matter of public record. A quick call to you City/State Court Officer would tell you if there are any pending cases. Do not argue with them. Do not ask to be taken off any call list, as they are foreign criminals who are only interested in extorting money from you. Should you get such a call in a voice message, research it, but do not call them back.

These people are too funny! I spoke with Patrick O Brian told him I wanted all paperwork and to stop calling me. he asked me to hold on. Then a lady comes on the line cannot remember her name. Very polite says Brian says you would like to resolve this matter I would be happy to help you with that, I told her I never said anything like that. I said I want all paperwork and to stop calling me. She then said did he tell you the charges that are going against you. I said yes and I want all paperwork, She then stated there is no paperwork. They will be coming to my job today to get me, I asked her where do I work and she never answered. then she babbles that she cannot stop them because she has them on the other line. Wait you were ready to resolve this but you have them on the other line waiting, Then she gives an address that I have not lived at in over 5 years. I said now I know you are a scam, She got mad raised her voice and threatened me and hung up. GIVE THEM NO INFORMATION!

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I have received several messages from Investigator Keane saying that a motion is filed against me for pending charges.  I applied for a loan online several days ago, in which I realize was a bad idea, so I believe this is linked to that.  Most likely they bought out contact information or got into some database system.  DO NOT give them any money, even if they state they have your social security number or bank account number.  Change your bank account if you have to  They cannot take any money out unless you AUTHORIZE them to because it's a scam.  I've talked to the FCC and the woman told me most likely they are using a relay station (for me it was in GA) to hide the actual origin of call, which could be out of the country even.  You can go to the FBI website and the FCC website and plug in the phone number, name of the person who called (even if it is an alias) and any other info you gather.  Tell them to STOP contacting you.  If they don't, you know it's a scam.  It's against the law for bill collectors to call you if you ask them to stop.  If someone is actually serving papers against you, you'd get a registered letter.

I received call from this lady named Carrie White from the united financial firm. She must get a statement from me before she files with the local authority. Gave me a case number. Case will be forwarded to local authorities with or without my statement. She left no name of the company or what it was in reference too. Should I call and informer to send me information in writing? I feel she is threatening me by leaving this message.

Debtors prisons???? I'll be damned!!!  Well thats gonna be a rallying cry for any Americans threatened with that. The article does have one good point tho - you cant be arraigned for the debt itself - only for not showing up.

Quote from the article::  " Under the law, debtors aren't arrested for nonpayment, but rather for failing to respond to court hearings, pay legal fines, or otherwise showing "contempt of court" in connection with a creditor lawsuit."

My husband and I have been receiving calls, very early in the AM.  We both have different numbers.  They left a voice mail and they are looking for a former daughter-in-law.  The case number that they gave seems to be unavailable through the St. Louis County case # system and we don't live in MO?

If you learn only one thing, it's this - never pay any caller who refuses to MAIL proof that you owe a debt and that they have the legal right to collect said debt.  A bill or invoice is NOT proof of debt.  Refusal to mail this documentation is a violation of the FDCPA (Fair Debt Collection Practices Act), and you should not pay anyone who won't send this to you.

Legitimate debt collectors do not threaten people with "paperwork" - in fact, this is another violation of the FDCPA, unless the company does intend to file suit against you.  In other words, it can't be an "empty" threat.  Having said that, legitimate debt collectors will mail you dunning letters for some time before it even gets to the point that they'll sue you to recover a debt.  The burden of proof lies with the debt collector to show that you do owe money to them.

For more information on how to proceed if you're being harassed by collectors, you can also click on the "Articles" link on the top right of this site.

Boy, have I got a lot to learn, but I am indeed learning alot. Im not even sure if this is even about a debt  cuz Mr Jackson never really said what the case was about - only that he was hired to serve me " paperwork"  -- but now Im thinking I did have a few issues a few years back where someone got my id out of my college dorm I was living at, so Im still getting haunted by that experience. So maybe this is connected to that incident. Either way my signature isnt on any credit card form and I dont have a job anyway and Im a single mom - so Im not really too concerned - what can they do - get blood out of a rock?

The point is, though, never to pay anyone who claims you owe them money unless they MAIL proof that you owe the alleged debt and they have the legal right to collect said debt.  Any caller who refuses to mail this documentation is in violation of the FDCPA - and you should not pay them.

Real process servers do not call ahead to let you know they're on the way - they just show up, unannounced.  Scammers and junk debt collectors threaten people with serving papers, trying to scare them into paying either a debt which has already been paid, or a completely bogus debt.  (These threats are also a violation of the FDCPA).  If a caller has to threaten and can't or won't produce proof you owe a debt to them, again, do NOT pay them.

Report your caller to the FTC, FBI, Dept of Justice and your state's Attorney General.

First off Happy,  it doesn't take a friend in collections to tell you what  your rights are.   Just google FDCPA and read everything you'd ever need to know about Alan Jackson and his Band.   Next,  It is those who don't owe a debt that we are concerned with on this discussion board.   If you owe a legitimate debt,  then Alan or your friend doesn't need to tell you to pay your bills as long as they follow the laws of the FDCPA and don't violate your rights.  Common sense does.  However,  if you don't owe the alleged debt and Alan is trying to scam the pants off of you,  it's a good time to hold Al's  feet to the fire and whip out your rights under the FDCPA.  Make old Al validate it to the point of legal acceptability.  Everyone should pay their bills when they have the financial means of doing so,  but only if it is a valid and legally collectable debt ,  in your state,  and that they have the right to claim and collect.

Okay --- a few quick questions here

1.  What is the name of the company that you took the loan out with?
2.  What was they name of the company or organization who called you to collect the said loan?

You seem like a helpful fellow, so I'm sure you would be able to answer those simple questions.  Thank you in advance for your time and cooperation!

These people who threaten to show up with "papers" or some such nonsense never do so. REAL summons are delivered by surprise so you can't dodge the process server.

These "warning" calls/threats are all from frauds trying to con you out of your money. Notice the posts who report they get repeat calls saying this is the "last notice".

Got a call from this company for a $400 Pay Day Loan I had  taken out and forgotten about from 2009 - i didnt appreciate how I was spoken to, but it is what it is, they are debt collectors - thats how they talk. I didnt wind up paying because I took out the loan because I was broke in the first place. They will take the next steps they need to take - I will update whatever happens on here. I was a little rattled - I must admit.
