I received multiple calls from "Shayna Smith" telling me that she had paperwork delivered to her office, and was giving me a "courtesy call" to settle my account prior to my appearance in court.  She left multiple messages, telling me to contact them to make payment arrangements prior to me being served with my "notice to appear."   When I didn't call her back, she left other messages, telling me that she would be coming by my house today to serve me my paperwork so to remain home and wait for it.  Yeah, sure, I am going to do that.  First of all, if someone actually files suit against you, they will serve you paperwork.  Calling them AFTER they have already paid the filing fee is not going to stop them from serving you.  They have only 91 days to serve you after filing suit, so if they don't have you served with the paperwork prior to that time, they have to pay to re-file.  Common sense will tell you that they would serve you, have you either go to court to fight the claim, or have a judgment levied against you.  They would have that judgment over your head, so if you didn't pay, they could garnish your wages.  They can't garnish your wages without a judgment, so that is the route they will go if they pay to file a suit.  This lady is making it sound all official so it will scare  you into setting something up.   They don't start out with a court date.  It starts out with serving you that a suit has been filed against you.  After that, you have 21-28 days to respond to their claim.  If they don't hear from you in writing, then they can get a default judgment against you.  If you file a response, they have to jump through hoops to take you to court where they will plead their case and you can plead your's.   Even if the judge rules against you, and you have a judgment against you, then you can always file a motion in court to have your payments set at a certain amount.  There are things you can do to fight these predators.  They think that harrassing people who don't have money will get them somewhere.  They have no idea what got people into the situation where they defaulted on their bills.  One medical bill or emergency can totally devastate a family.  Not everyone is a deadbeat, so if these companies would work with people rather than harrass and belittle them, perhaps they would get farther.

I got the same call and same message I contacted my local Police and filed a report and I then report them to the BBB and to the FTC. It's a shame that ppl have nothing better to do and I dont understand why they have not been shut down along time ago.. The officer that file my report was nice enough to call the 855-283-2532  and asked for the manager and the "manager" got on the phone and the officer introduce herself very nicely and was just asking general questions the manager got smart and was like look lady we have officers call all the time cause the ppl hate getting serve from us..  the officer said I am just trying to make sure this is up holding company and when she asked where they was located he got smart and got a big attitude with her... these ppl are bad news and I will go that extra mile to shut them down even if it takes years I will not stop untill I do they mess with the wrong person now

I received a call from a BLOCKED number, a message was left by Shyann Smith with this number 855-283-2532 and she stated that she received paperwork for me under my SSN and she has a request to send me a certified letter of intent to appear in court for a claim that is being filed against me. She mentioned that she will be coming to my home and workplace to sign on June 11, 2012. She wanted to provide a courtesy call to inform me that I have been put on her list and I have been NOTIFED

My father is an attorney. Don't get them any information. Ask them questions. Ask them their business name. Supervisors Name. Phone Number. Fax Number. Ask them who they are representing.  What is the reason for their cal. Ask question after question and record it or write all down. Then report them to your local law enforcement, the ftc, BBB, FBI, they have several complaints agains them for harassment and scare tactics that are against the law. Do not be intimidated by them that's what they want. You fight for your rights.

And have your attorney deal with them.  It's against the law for them to call before 8 a.m. they already broke the law. Grateful to have officers of the law in the family.  If you owe money. Get the paperwork and deal with it. Don't be harassed.

The anecdotes here from "Perplexed", "Mother", Mr. Johnson, Ms. Gomez, and "Frustrated" all describe very illegal collection tactics. There may be little or no proof of claim besides. If they're so sure you're liable for some "hot check" or PDL, why bother warning and terrorizing you? Why not just sue you and get it overwith? Because they know very well they cannot.

Get yourselves a valid US address for your tormentors and stop trying to haggle with these cretins on the phone. Dispute their claims, revoke permission to call you, and sue them for relief. The FTC explains more about your rights.

I do not understand what you are talking about? What I have put on here is VERY real and it made me very upset today. I just called the local sherriff's office and also called the payday loan place that I supposedly owed money to, and it was all bull. You cannot blame any of us for thinking this is real to an extent, they are very convincing, and no one wants to be taken to court to be sued, so yes we are going to listen and make sure we are making the right decision.

I just got a call from them as well,. telling me I owe money for a payday loan from 2008 and that someone is going to come and serve me at my home on the 25th of May 2012....and that I owe over $700 and if I have not been served yet, they will cut my bill and help me make a lower payment agreement and that they cannot promise anything, but they will see what they can do. His name is DAVID MONTOMERY! I just lost my family's home two days ago due to non employment and cannot afford to pay rent for my children right now, this was the last thing I needed to deal with. The woman at their company actually made me cry and was rude and hung up on me. I cannot believe people are allowed to treat one another in this manner. It sickens me! I know I have some bills, but to not tell me that I need to take care of a bill for over four years, then come after me in this way for it, makes no sense to me at all. I had a woman call me as well twice saying her name is S. Smith with a case number my name and my social and saying she will be out to see me at my home or place of work within two days to have me sign a notice to appear in court and saying she was with the county in which i live in. is this real? i was searching this number and someone else commented about her saying she was with some california county. and she never did show up to my address and nothing at my work. it was with a cash advance that was taken out in my name and tracing back to an email address that was mine and an ip address with my name on it. and this is a loan i never heard of and if i dont put a stop action on it to make some sort of a payment plan then it would go to court and garnish my wages. is this for real?

These morons called from 855-283-2532, claiming I have incurred some loans over the Internet that are outstanding. The loan was done in 2008.I was out of the country for 3 years since 2008 and just got back in the US in 2011. Funny thing is they have my SSS number. I called them back and told them they are phishing for info for identity theft. I reported them to the FBI.

I got the same message talking about they had some papers for me to sign. I told them to send them certified mail. DUUUUUMMMMBBBBBBBB Freaks.

These are the worst bottom feeding lying collection people that anyone will ever have to deal with.  They misreprsent who they are when they call anyone getting a call from this group should file complaints with their local bbb.

Some woman left her name and this number, claiming to have paperwork for a person who I don't know and doesn't live here, giving a claim number and ending with "You have been notified."  I called back to say they hadn't notified the person they had called, figuring someone had dialed a wrong number.  The man who answered  wanted my number and after I said "no" and started to explain that they needed to contact the person they mistakenly thought they had reached and didn't need my number to do that , he got angry and hung up.  

So what was that about?
