I received the same call from Dolores Bryce. When I asked her to send me the documents validating the debt, she told me she will not do that and that I was going to jail. She insisted if I didn't I give them $2000 that I was about to be detained. This is definitely a scam and I have reported my findings. When I mentioned a lawyer she totally flipped out and said she was going to proceed and then hung up.

I too received a call here from a Mrs. Delores Bryce she advised me they were on their way to serve papers on my wife. And needed my wife to call here called from a 904-863-5011 number is (BOGUS). She gave me a 855-265-5024. I immediately called down to the court house here in my county they advised of no papers had been filed. I called a relative who I know that works in law enforcement just to be sure and there too was nothing. I knew it was bogus when she gave me the case # I know from being a debt collector of 31 years that if you file something you have 20 days from that time to answer this complaint. I called our Attorney and he advised that the problem is they close up shop in one area and go to another so it is hard to close them down. you just have to file something with the Attorney General's Office in your state. SOOOOOOOOOOOOOOOOO tired of these guys. And when I called the # back they say "LEGAL DEPT" and when I asked for Delores Bryce and advised her of her BREAKING THE LAW ACCORDING TO FDCPA she hung up on me. I called back asked for her I knew it was her but she INSISTED it was her supervisor. I advised that I knew it was her she Hung up again. When you get a call from a legal debt collection agency they will advise you of there name and nature of the debt. and will send you a VALIDATION OF DEBT if you asked for it. I called the FTC and they said the same as my atty. Just be aware of this scam the problem with technology is it leaves you exposed to many scams. DON"T BE SCAMMED!!!!!

I received a call at my workplace today, from a company called Landmark (LM of You Are) from a "so called guy name Steven Horton. He stated that he was a police officer calling from the jail and that someone has filed charges against me. Then he stated "are you at work right now because we're about to come and serve you a warrant and arrest you. I said "for what?" He said "because you wrote a fraudulent check for a payday loan" Which, I stated "no I did not." He told me I have to call a number at the jail to resolve this issue. Some lady answered the phone (her name was Taylor Temper, I guess) and threatened, harrassed me that the police will be at my job to arrest me in a few minutes. That they needed $2000 dollars from me or they police will be coming. Then they wanted me to send them money "right now"  Make long story short, once I invested further it is a scam! I will be contacting a lawyer!

It is a scam they are being sued right now. The company name has changed to lm of ur whatever that is. When you ask to have documents faxed the response is we do not fax anything. Now what  legal company will not fax or mail you a outstanding balance. They change there numbers often.I have a cousin that works in collections she told me they are not using there real names. We called back and asked for and address guess what "for security reasons cant give out". The so called legal lady Ms. Whyte I spoke with told me I'm going to jail. I called the court house and the so called case number is fake. The case number i showed them does not look anything like a real case number used at the court house. Thank God I have a relative that saved me. She informed me its a scam and these collection companys by the paper off the internet and attempt to collect the money for themselves not to pay off the debt. YOU PAY YOU WILL BE SCAMMED.  I have not received my court papers yet or the police has not come to arrest me as Nancy Whyte told me.

I've compiled all of the numbers they are reportedly using (see below), although I'm sure they have more at their disposal. In any case, I'd strongly recommend that we all block the following numbers through our mobile carriers (you can do this easily using Sprint's website, others are probably similar).

First of all they are lower than pond scum. Don't  let them disrupt your life. Alert all your friends and family members and employers about them.

Get new phone numbers and contact your doctors and businesses you deal with and password protect all your accounts.

Invite them to come to your state to sue you.  Keep in mind most of the companies where they get your information have millions of dollars in judgements against them in State and Federal Courts and they will never file any court action because they would have to come out from under the scum where they live and identify themselves.

Legitimate collections agencies will tell you who they are and provide proof of a debt.

They HAVE to send you something that you owe the bill with all of the original lender information, if they do not do this, don't pay. If they do not send you anything then it is their loss. Go to your local county website and if they have anything against you and are going to be serving you it will be there as all of this is public record.

They also use 855-444-7528. The Robo call did not leave an extention number. Just said that they had a case that was given to them. I called and they got very hostile when I told them to call my attorney, gave them his name and number and then they said, "you Bi--h, you don't have a lawyer, pay us or you will be arrested. First of all, if they are going to serve anyone they do not call you they just show up at your home with the summons. You can go to your county's website and see if anything has been filed against you, it will show up there as it is all public record. I fell prey to a couple of these scams back about 5 years ago and I paid with a prepaid card. I was sent a receipt from both and when the original creditor called and I told them I settled the account and started giving them the information they said I was duped, so yes I admit I was stupid, but my life was in turmoil at the time and I didn't know what I was thinking or doing, so I paid, I am out over $1000 and still owe the original bills. I sent all of the  paperwork to the original bills but I never heard anything back. So if you owe something, call the original contact and if they say they sold it tell them that you are paying them and no one else and pay them. If they accept it they have to clear your name. I refuse to deal with third parties, so they can call all day long and I tell them this.

Received a threatening message from a Nancy Wyatt on 3/10 staying they were about to take legal action. I called them back after hours and left an in-kind message giving them seven business days to submit a debt validation letter proving that I owe whatever specific debt I owe or that I would take their voicemail message and file a small claims case against them for harassing and threatening me. They do mask their phone number it came up as +0000000000 on my caller id, bet they left their contact number, . Which is how I traced it to this company. With the internet, finding information is so easy. We'll see what happens.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Received a call from 866-810-1306.  Said he was from Landmark, Tim Miller, ext 417.  Said I owed money from a couple of years ago.  I asked him to mail me a validation of debt, he said they couldn't because they have gone paperless.  I asked for an address so that I could send a money order (baiting him) he said that I had to do it by credit/debit card.  He said he was going to call several people to try to get information about me, since I would not confirm anything over the phone.  One of the people he is going to call is my deceased ex mother in law.  That should be interesting.

Same here, I have been getting repeated calls from which I know is Landmark.  They have called my job on Xmax Eve (2013), stating that if I didn't make a payment, the county sherriff wil come to my job to arrest me.  They have been calling both my home and cell phone, they have called my oldest son, my mom, my friends, my in-laws, and a relative who doesn't live in my city.  On 2/17/14, I got a call from Jordan Marks stating that he was a process server from 844-704-5171, stating that he has   been trying to serve me papers but has been unsuccessful, and that I need to contact the above number. On 2/25/14, I received a call from Isiah Monroe fro 866-814-8011 who left a message, stating that this was my final notification, and for me to take the phone call as me being "served".  I have received calls from a Karen White, I have also received calls from a 305 area code, which was connected with Landmark also.  I did take out a small loan with Western Skyy, that was not repaid due to hardship.  At this time I am unemployed, and not receiving unemployment.  I need these people off my back, and everyone else's back.......can anyone offer any advice.

All these are similar stories to what is going on now. The company is still Landmark according to them, their number shows up as 000-000-0000 on my caller ID from home and on my cell. The number they want me to call back is 1 866 814-2137 ext 417 and the name to contact is now Tim Miller. He also is claiming an unpaid debt back from "2008" is the reason for my possible arrest. and I have, according to him until noon today to avoid any further legal action against me including my arrest.

I got a call from a Tim Miller calling from (866) 814-2137 who threatened all the same things above. After looking into it further, I found out that not only are they liable, but the company you owe can be liable for working with a collection company that is working illegally and will most times offer to reduce or cancel your debt for the stress they have caused you.

I received a call from Ms Joins on 12/27 leaving a voice mail stating that there was an investigation pending against me for 2 counts of fraud against an FDIC bank.  Just a knee jerk reaction to the voice mail, I called the number back & stated that it was regarding a loan taken out at ACE cash express.  When I first called I tried explaining to the operator the nature of my call but that bi*** was so rude she didn't even allow me to get 2 words in before she was like "hold on" & transferred me to Ms. Joins.  Ms. Joins left on my voice mail that she was in the fraud department & that I needed to pay $375.00 or I would be served by a sheriff to appear in court.  I offered to pay in payments of $50 until I got it caught up & she said that wouldn't work..That's when I knew this company was full of s***...I mean as long as they are getting SOMETHING out of me, they aren't allowed to do anything to me legally.  I know my rights & because these people are SO FAR up to their necks in violation of the FDCPA, by the time I'm through with them, I'm going to OWN Landmark...I even contacted ACE & told them I was sorry for letting the loan default & promised that as SOON as I got the 368.74 in full I would be paying them & they said it was fine, they could just look the loan up under collections & I could pay them that way.  Ms. Joins told me "Oh that won't work we would still have to submit your document to the county because you can't pay ACE anymore you'd have to pay us" yeah whatever...I bet once I get that money I'll take it straight to my ACE location right up the street from where I live at.

Wow...I got a call from my part-time employer who had gotten a call from someone claiming to be with the "County Sheriff."  The person on the phone wanted to know when I worked next as they were planning to come to my place of employment to arrest me for bank fraud.  This person also called my ex-wife who in turn passed her to my girlfriend via her employer.  Bottom line was this was a genuine debt at one time.   Loan originally taken out from Western Sky.  I went through a divorce, lost my job (now only employed part time) and managed to pay off all the other loans I had except this one that fell through the cracks.
Took advice above and asked for mailing address for Landmark.  "Ms. Potts" in the "Legal Department" refused to either connect me with her supervisor or provide me with a mailing address.
She now says that their representatives will show up at my place of employment to pursue their $2K debt.  I offered to work out payment arrangements but "Potts" insisted on money today.
I am at my wit's end...if this isn't illegal, it should be...I don't know what I'll do if they push my little, piddly-a** part time employer to let me go...

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.
