When receiving these calls be sure to record the phone call. If the term "summoned" is being used they can be shut down for violating the FDCPA. More than likely they will stop callling once you call them out on violating federal law. Once you have the recording contact the NYS attorney general's office. Make contact with Debra Martin. She heads the collection area of NYS collection law. Collecting payday loan debt is absolutely illegal in NYS. After doing that contact the BBBand forward your attorney the recording so you can start your own lawsuit. Any more questions feel free to ask. Been away for a while so I apologize for not getting to this sooner.
Good luck and contact all law enforcement necessary as well as the owner Mike Jablonski at his law firm so you can let them know that he is violating the Bar Association.

I just got one of these calls yesterday...The lady told me I was being summonsed to court for one of those payday loans. She said I was being charged with check fraud and rhat its a felony. She was talking realky fast and kept saying it was some county, that was not the county I live in? If course I was freaking iut at first but when I thought about it...You can't be summonsed over the phone?? Correct? She was also asking for my debit card #! I called the police dept. In my town since she said they were working w/my local authorities and they are looking into it. Who can I report this to? They called 2 of my family members that have the same last name as me and told them that I was being investigated for ck fraud.

They called me on my work cell for my step-daughter saying she used me as a "reference".  When I asked if it was a collection call they said no and then proceeded to ask me to have my step d call them back.  I said No, I'm not relaying messages, call her directly yourself.  It was clear to me it was in fact a collection call.  When I reminded the caller, you told me you wanted me to give you a reference about her they hung up on me.

This # belongs to Actionable Claims Processing. A debt collection company that specializes in abusive tactics to recover payday loans. They will tell you they are a filing firm. They are NOT. They will tell you the next step in your case is to pursue it legally. They Won't. They will tell you you owe more than the actual balance and claim it's the fee for a process server. When they give you your balance they will try to claim that they can settle your account without charging you for the " Paperwork". Their is no paperwork ever issued to your local county clerks office. This company will never sue you in any way shape or form.
Get in contact with your local county clerks office and you will see that no paperwork has been filed under your name and social.
The collectors of this company use alias's instead of their real names. Dan Clark is actually Jon Jablonski. Mike Thomas is actually Mike Jablonski. Marshall Keenan is actually Matt Sehm. None of which follow the guidelines as stated in the FDCPA.
Here is important information to defend yourself.
The actual address for this company is 189 North Water Street in Rochester NY. Not 621 Park Avenue.
The office is run by an actual New York Licensed attorney named Mike Jablonski and his brother Jon Jablonski. When they call you it's your right to inquire for an attorney that you'll never get. So, Here is the actual law firm that Mike Jablonski works for.Woods Oviatt Gillman LLP. 2 State Street  Rochester, NY 14614.(585) 987-2800. When you get these calls from this # return the favor and call them at their actual place of employment. You should let the law firm know your getting debt collection calls from Mr. Jablonski and you want it to stop. Inform the partners of this law firm. However all the information regarding this company is not under his name it is registered to Dan Olcott who also is the owner of Portfolio Recovery Group on Grand Island NY.
This company will call your family, friends and your work to try and get you to pay a loan back.
Under no circumstance should you pay this company. Instead, record all conversations and turn them over to an attorney. This company violates the FDCPA in every message they leave. You will never hear them say " this is an attempt to collect a debt and any information obtained will be used for that purpose" This is known as the Mini Miranda and is required to be said in every debt collection call anywhere in the united states. Contact the New York State Attorney Generals office and the BBB to report this company every time they call you. New York has a strict collection policy and this company does not follow any of it. They will impersonate process servers and then when you call in and the guy that claimed to be "Serving" you is right next to the person your on the phone with.
Payday loans all have a statute of limitations in which you can collect the debt. The time limit varies by state. Inform yourself of how long that time is in your state. You do not have to pay this company. Instead contact the payday loan company. The loan company will tell you your debt has been placed with a collection agency. Payday loans are never placed in an actual attorney's office. To sue you is far more expensive than to try and convince you they're going to sue you. The only way it's worth suing someone is in a wage garnishing state and even then they won't get their money. The payday loan will NEVER be on your credit report either. Any questions don't hesitate to ask I will help you.

Yes their is. If you enter the building and walk 20 feet to your left is a stairwell. Take the stairs to the door. Turn right the office is located at the last door on the left. Their are many different companies at this address. The building also has a keylock system that is not engaged between 8am and 6pm monday through friday. Stop down and pay your bill if you'd like. I'm sure they take cash.

I received a voicemail from these people and the lady that was on the voicemail was almost impossible to understand because she was talking so fast. I had to listen to the message like four times just to get the number and case number. I don't know who these people are and I don't believe I have done anything to make these people think I have committed fraud. I did call them back to try and get answers but no one has returned my call as of yet. I think this is a scam but how can I be sure?

Keep getting calls from this number.  Just got one left on my voice machine that said they have my ssn and all my assets that go along with it and they will proceed with action. Have talked to them in the past and they would not tell me why they were calling, just said it had to do with Cash Net.  I have never recevied anything in witing.  If they have all my info, you would think that they would have my address.  They are getting meaner each time they call now.  First it was a girl who called, now it is a guy named Ken.  They call from several different phone numbers.  First they said I owed 200 and now they say I ower 7500.00. They said on the phone message to get ready. (for what, I do not know) and said I must call their number.

Are they legitimate or not? Yes I was with cashnet and they told me to ignore all calls like that. They told me they would send paperwork in the mail for balance due money. I have received from all types of bogus companies which are looked into by federal trade commission. This one claims to be NCW National Cash Works LLC and they can call themselves anything.
I do know that there is a huge network in NY with scams in which I have talked to at least 3 or 4 calling me in the past.

Called this number back.  Told them my name...they said that wasn't the name they were calling for.  This is after they have called every day for weeks, threatening me with garnishment, the usual.  When I asked to have my number removed, Nicole at ext 108, acted like it was MY fault she didn't have the right person.  Told me very sarcastically, to have "a nice day."  Hopefully, the phone calls will stop.  We will see.

Has called and threatened me with a lawsuit and garnishment of my wages.  I have no outstanding loans anywhere and haven't had any for over twenty years.  I am considering talking to an attorney because they have threatened to garnish my wages.  I think it is a company calling around trying anyone with my name to collect some loan that is floating out there somewhere in loan make believe land.

I got a call and a message left on my machine saying that they have tried to contact me regarding this matter, however there was no mention as to what the matter was. I returned the call and got a voice mail stating that You have reached the office of Ken Newton I am either on the phone or away from my desk leave me a massage as well as your file # and I will get back with you. The first time I called the phone rang several times then went to voice mail, now it just goes directly to voice mail. Collectors can call anyone to try to locate debtors per section 803 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf but cannot say there are fraud charges if none has been filed. Suggest reading sections 803 through 809 of the FDCPA, then call your local courts  to see if a live lawsuit  against you exists. You can sue collectors for abuses like this guy did and won 2 times http://www.killthecalls.com/

This is either an abusive debt collector or a scammer. If you are a delinquent debtor, you have to figure out if this is a legit-but-abusive collector or a scammer call. Legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for it, the FDCPA requires it), treat the collector like you would any SCAMMER. Scammers are using bought/hacked loan application data to extort payments for fictitious debts from victims and victims' families and friends.
The FBI warns about payday loan extortion scams here http://www.fbi.gov/news/pressrel/press-releases/paydayloanscam_120710
The BBB has issued several alerts on this scam, just google "bbb.org alert phony debt collector"
Report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Communications Commission http://esupport.fcc.gov/complaints.htm , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG, as appropriate.
