Debt Collector
Just reciebed a call from Forensic Check Services saying I owed money to Bayside loans. I did research and requested a debt validation letter. They told me it was beyond that and that they were going after me for bank and check fraud. This was for a payday loan that I did not pay back. Is this legal for them to say they are going to charge me with bank and check fraud for default on on a loan. The account they are talking about was closed. I even told the guy I researched this company and it was a debt collection agency. He yelled at me and said no we are not we go after people who commit check and bank fraud

I was contacted today by someone named Brianna James she stated she bought the debt from a company in which I told her it was false and she proceeded to give me her extension and address and I also told her I will be contacting my attorney and the CPB and the FBI to file a complaint and sue the company.

No: It is not legal look at the consumer protection laws in the state where you reside. I am in Texas and I am also a former Police Officer. I do know that any attempt to collect a debt by insinuating that a court action ahs been warranted is illegal. If in fact a debt were collected it would be done so in a civil court and a summons or subpoena to court is required with your notice to appear on a specified date and time, and in a specific court. Any attempt for a collection agency to act as an attorney, or threaten you with lawsuit is illegal in Texas. Check with your states attorney general for further information

I've been getting calls for over 9 months looking for a Brian Garland, who is not me. I've read the other posts & it all sounds similar. I got called three days in a row this week so decided to call back & was told my number will be taken off but they keep calling. I asked where they are located because the automated call came from a 702 area code which is for Las Vegas but said they are in Washington D.C. I kept calling them, figured if they wanna harass me I'll harass them too. Finally one of the idiots said they have a corporate office in Las Vegas but then put me on hold then eventually they hung up. CAN YOU SAY SCAM???? This is why I hate most people in this world! I plan on harassing them more, it makes me happy.

This number is repeatedly calling me leaving this message:

This notice is intended for_______ your payment placed on file to secure a stop order has come back as a stolen card with strict instructions for immediate pick up, your recorded authorization has been pulled and reviewed and instructions to escalate your claim has been ordered.  If there is a misunderstanding pertaining to your method of payment, we request an immediate response, if you provide no response all new evidence will be submitted and your file will be expedited for further action.  Contact my office at 855-305-5110 and refer to file #112197.  Thank you"

I called them back and stated that after learning they are not a legitimate company I had my debit card canceled. I fell for their scare tatics but after doing research I had my card canceled so that this sham of a company couldn't retrieve the payment I was going to give them.  They are relentless in harassing me. I filed a complaint through the CFPB but the calls keep coming.  How do I make it stop?

You have a right to demand a stop to all calls. Anyone at the workplace can declare it off limits to them. A written notice sent USPS Certified with return card is best for the job. Thugs like these will frustrate your exercise of those rights, you have found. The final call blocker will be a summons and complaint from you.

That's Fair Debt Collection Practices Act, and Section 807(4) or USC 1692e(4). A couple other parts of the section can apply, too.

Is that so, Mister Never Reads the Terms of Service? The federal Do-Not-Call registry exists to help enforce the Telemarketing Sales Rule. Please note the operative term ''marketing''. A debt collector is not a sales person and is therefore not covered. The few remaining state lists share this limitation. Here are the DNCR service terms you were supposed to review at registration time:

National Do Not Call Registry Q&A
http://www.consumer.ftc.gov/articles/0108-national-do-not-call-registry

Also, if you expect all sales calls to stop just because a registrant tosses a complaint into the Consumer Sentinel Network, you haven't seen very much of this site.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

-is seeking payment on a debt for a loan you do not recognize;
-refuses to give you a mailing address or phone number;
-asks you for personal financial or sensitive information; or
-exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a  law enforcement agency.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate but you think the collector may not be, contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They have a case number. I am tired of them part of me wants to pay them just to get rid of them.  I had pay day loans in the past but I payed them of off.  They say I closed my account and they have me for defrauding a federal institution.  This is craps they need to be stopped.

I also have received calls from them at 877-318-0965, 405-529-5460, and they tried with a blocked number. These happened within days. After reading all of the complaints online and seeing everyone say the same person has called, I reported to FCC and FTC. These people have nothing else better to do than try to steal hard working consumers money. DO NOT give them any information.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

The website seems fly-by-night to me.  Use of the term 'forensic' is meaningless since they do not do forensic work for  anyone that an ordinary police department and/or bank couldn't do better.  They have no police powers.  They're  just a debt collector dealing in bad checks.  They don't investigate crimes, they just try to collect money.  At least so far as I can see.

These people also buy local numbers wherever you live and try to contact you. They have been harassing me too, I don't answer and block every number they call from. Also turn them into the FTC. They are scam artists! I had a loan consolidation company I called and they have never heard of these people, meaning I have NO loans out and everything I did was paid do obviously this is a SCAM!
