Process servers dont call and say they are looking for you. It would give you the oppertunity to hide. Which defeats the purpose. If I cant find you, i cant serve you. and they cant sue you.

I got a call from the same number on my father in laws phone saying that a fraud investigator was going to press criminal charges on me for a loan and that they were from my county's court fraud department.  I called my county court and asked if they had anything pending for me, and they explained that they did not have any record of this, and that they do not make outbound calls anyway.  So I called my state's attorney general to talk to the consumer complaint department.  Even before I explained the whole situation he interrupted me and told me they had fifty complaints about the same thing this week alone and that it is a complete scam.  He also told me that if you ever had a payday loan in your past, those people sell your private info to the highest bidder and that is generally scam artists or zombie debt collectors who buy it.  Either way this practice of trying to frighten you with criminal charges is highly illegal.
Another important thing he said is that you should never ever talk to these people! He says screen your calls through an answering machine because they will try to digitally record all of your yes/no responses so that they can use it to say you claimed the debt or authorized a payment.  Even if they call a hundred times, he told me not to answer.  Sadly, it is hard to track these people down because they move so often and rarely have landlines.
I hope this gives some people some peace, because I know how awful it feels to be afraid to answer your phone.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

WOW!!! Reading these posts was freaky. It was like reliving my phone conversation with this fool. This dude calls my phone all the time called my hubby & said I was gonna be arrested for fraud. So I talked to this "investigator" he claims I comminted fraud & would have me arrested. I said mail me some information that I can read with my eyes tha I owe you something but he said I can only get that if I let it go to court. I said so basically you want me to give you my credit card info to pay a debt you claim I owe with no documentation. He said that is how its done unless I want it to go to court. I said see ya in court! Do these people think we are all that stupid?

FYI, I just found out "Fraud Investigations" is apparently their new company name, less than a day old. VERY interesting. I think they're just picking intimidating legal-like names to scam people.

Today 4/17/2013 at 12:30-ish, I received a call. It's usually daily around this time, and they never leave a message. I got curious and called back. The man who answered the call claimed to be "John Riley" from "Fraud Investigations." A simple Google search made me think, hmm.... based on another John Riley being involved in investigations, I think maybe the caller was a scammer.

Federal Debt Collection law requires providing a mailing address for written correspondence, c&d's, verifications of debts. I asked for a mailing address, but was denied, and the man hung up on me.

Me too! They refused to give me their address or any numbers or even the contact for the (Fake) original creditor "Web Payday" GEE! sounds like a legit name to anyone??? I dont think so.

Federal law provides us with rights to this info. They refused saying that it was because Id just send them a Cease and Desist letter. What I had already told them was that Id send them a Validation Letter. (which WAS originally my intent) Sometimes these guys are the unwitting pawn in this because they simply buy accounts to collect on. They cant tell if they are fake. But thats OVER NOW - Im pissed! Cease & Desist was given Verbally on my recorded line since they refused to give their information. It will hold up in a complaint because of their refusal.
I wish just ONE of these jokers would actually take me to court so I can see them and get them fined for fraud and harassment.
Tired of whoever keeps selling my ID info making up fake payday loans I NEVER HAD.

They think that because they threaten me they will get somewhere! CLOWNS! They believe that since they have my info that this proves I owe some debt! IDIOTS!.

WHOEVER GETS THEIR INFO OR EVEN THEIR STATE WINS CUZ IM GONNA SUE THESE FOOLS!
