This Michael rentoul- what a clever alias........ Called me saying he was going to freeze my bank account and garnish my wages. I live in a state that garnishing isn't even legal....Said chase hired him for an old visa card I had? What the hell would chase have to do with an old credit card having nothing to do with them..........Anyways after reading all the other complaints I can tell these guys are bill collectors. Scam and lying ones but damn good ones. Rentoul scared the crap out of me, but after I got on here and researched their company I realized they are in new York and grimey new York collectors.. I filed a complaint with the new York ag, I suggest you do the same so you don't have to feel scared and threatened like I did.

Please see Shillkills post on page one, and the others on this page.  It is not unusual for the scammers to try and use legitimate company's, Attorney names and spoof ID and phone numbers..  There are a few shady outfits that attempt to get away with breaking the FDCPA laws, and those usually get hung out to dry rather quickly. The scammers usually break every law they can plus.   See my post above and read up on your rights.

I got a call from Michael Rentoll as well. I was told correspondence was sent to me, but of course I did not receive anything. If it is a matter of legal action, seems like it would have been sent by certified mail, right. He repeatedly said I owed on an account but couldn't specify what account was deliquent. First he said it was a Chase Discover card then he mention 2 other store cards and it would be either one of those, but he didn't know. One or the other, really! He threatened to garnish my wages, but a lien against my property and freeze all accounts if I didn't make payment arrangements or pay in full right now. He knew all of my vital information and called my place of employment and harassed a co-worker to let me know he called. I filed a complaint with the BBB and Attorney General's offce.

First- file a complaint with the NY atty generals office. Next file a complaint w the atty gen in your state- they're all online. Finally- dispute the claim in writing to the address listed above and request that they only contact you by mail. Done and done. Ohio has laws.

Use of aliases is common in the collection industry, which I don't blame for mitigating threats against personnel. Aliasing is not considered fraudulent until the same person adopts multiple names. In some states the agent has to register a chosen alias.

I ran out of fingers counting the agent's lies in your story even before your bulleted breakdown. I'd say the operative part of his name is "tool". These are obvious Buffalo Bullies using desperate tactics right from the starting gate. Courtesy of ShillKill, you have SoS data revealing the agency's location. Paint 'em a target and sue them in a real court, as opposed to their phantom case. If you don't want to work pro se, a competent consumer attorney should gladly bury them for you on contingency. By the small chance you're asked for a retainer, it should not exceed the $400 federal filing fee. You'll make that back easily. The loser company pays all your freight when you win.

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I too received a call from 855-306-7366 and received a voice mail message that said This message is intended for Jennifer XXXXXX. We have been instructed to obtain a statement from Jennifer XXXXXX prior to filling your jurisdiction. You can provider your statement directly to 855-306-7366. Good day."

Some background Information. In 2005 I had to leave my job for medical reasons. In 2006 my husband lost his job. We went into debt bad. We had 4 civil suits brought against us for nonpayment of medical bills and credit cards. In 2009 I was a full time college student and working 15 hrs a week. My husband broke his arm at work and was on workman's comp, we filled chapter 7 bankruptcy. The bankruptcy was discharged in June of 2009.

So I made the BIG mistake of calling this number to figure out what they want. The first guy that answers puts me on "hold" for 10+ minutes. Then I get this Michael Rentool on the phone. He says this is in relation to a Chase Bank checking account or credit card. I advised him I have never had a Chase bank account or a credit card with them. He then put me on hold.

When he comes back he proceeds to tell me that Chase Bank is suing me for a fraudulent bankruptcy filling. Stemming from a GE Capitol credit card that I filled bankruptcy on. He said that it was kicked out of the bankruptcy filling. He goes on to say that Chase Bank has bought GE Capital and that they are making this claim because they now also own Merrick Bank and my Merrick Bank credit card was excluded as part of my bankruptcy filling in 2009. He goes on to say that they see I am trying to fix my credit so they want to "resolve" this issue.

He tells me that my Merrick credit card is going to be cancelled (they just gave me a credit increase last month). That my bank accounts are going to be frozen and my wages garnished. When I tell him that I have received no paperwork on this, he claims to was sent and that I threw it away. He that tells me that they took me to court and received a default judgement because I did not show up to court between 8am and 5pm. He also claims they did this 6+ months ago. He tells me that I now owe some $8,500 with court costs. He tells me that they are only required to ATTEMPT to notify me three times of a court hearing. I asked for the court filing/case number and he said it was my social security number less the last number and the state abbreviation: XXX-XX-XXXIN.

Several problems:
1) In Indiana (where I live), if you are suing someone you MUST sum them in the county they live in. This man claimed to have sued me in St. Joesph county where i used to live.
2) In St. Joseph county ALL court fillings has case numbers at start 71 then a letter followed by 7 numbers 2 more letters and 5 more numbers ex: 71A1234567BC12345. The case number he provided was never going to pull anything in the courts.
3) In Indiana if you are not in small claims court (small claims court limit is $6,000) a process server will deliver the lawsuit paperwork to your home. If you are not home they leave the paperwork and also mail you a copy of it. This is done by the court and NOT the collection company.
4) The ATTEMPT to notify me 3 times is a rule of small claims court and is not applicable because the amount is over the small claims court limit of $6,000.
5) When you are sued you are sent a notice and you have 10 days to respond. Then you are sent notice of the court date. So you receive a total of 4 notices (2 for each)
6) When you have a court hearing there is an actual date and time. It is not a show up between 8am nad 5pm thing.
7) Nothing was kicked out of my bankruptcy. I called and court and my lawyer and they confirmed it was a straight forward Ch 7 bankruptcy and nothing was kick out.
8) I called Merrick Bank and they are NOT owned by Chase.
9) GE Capital is not owned by Chase Bank.
10) 3 months ago my car needed new brakes and tires. I opened a Discount Tire Credit Card which is funded by ****drum roll*** GE Capital. Now if GE Capital/Chase bank sued me 6 months ago for fraudulent bankruptcy filing would they really have given me a new credit card? Also won't they have cancelled my Merrick account BEFORE suing me?

I called the FTC and they took a report. The woman was laughing at this man. She said I did not need to send in any evidence because based on what I told her there was enough proof to prove fraud on his part.

So if you get a call from this SOB DO NOT PAY HIM A PENNY. He is a fraud.

Don't bother with the toothless BBB. If you get a call from these people which breaks the law (by threatening arrest or such) you need to file a complaint with the attorney general for your state. These people ? who are most likely the ones responsible for the posts you see above (with the negative scores) trying to frighten you.

Don't fall for their lies.

They are collection jackals running a rinky-dink operation skating on the razor's edge of the law. Apparently they feel that "asking for a statement" and mentioning the words "your jurisdiction" will scare ignoramuses into sending them money. They're growling, toothless but annoying tigers who'll be out of business in a few months, so any arrangements folks might make with them are not to be trusted. They'll take the money and run.

I got a call from David Michael Anthony with Foster and Monroe Firm. With the number of 855-306-7366. In the message I was told to call back and speak with Michael Rentool. I answered the second time they called and was told that my file was locked out by another agent and they couldn't provide me any information. But was told that it was related to a judgement against me from Chase Bank. Since they didnt have my file at hand I told them to call back. They called again and left another voicemail. When I called back It seemed that someone was answering from their home. This person was unprofessional. I told her I received a call and was calling back to see what was needed. She asked for my information (name) which I did not provide. She told me she couldn't help me. So I told her I would wait to hear back if they called again. This is Collections company. And it is NOT accredited with the BBB. Don't pay any money until you verify that you do owe money to Chase bank.
