Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Sister in Law got a call from this number in search of my husband regarding an unfamiliar personal loan they did not elaborate much on when my husband called back. This Derek person claimed if hubby did not pay he could go to prison and demanded payment immediately. When asked if an arrangement could be made, "Derek" said he needed to speak with the original loan agency the debt came from and put my husband on hold for like a few seconds (no way he ever contacted anyone!). Hubby told him we are in the process of filing bankruptcy and "Derek" said nothing. I decided to look up this number and its a good thing I did...total scam!

Debt Collector
Piece of crap debt collector using illegal scare tactics to try and scare you into paying a debt that they cannot prove that you owe or may not even owe. Don?t verify any information or promise to make any payments. Good chance statute of limitation has already passed. PAY THEM NO ATTENTION!!!.

Warning signs for companies like these
Requires immediate payment
Is seeking payment on a debt for a loan you do not recognize;
Refuses to give you a mailing address or phone number;
Asks you for personal financial or sensitive information; or
Exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
Claim to have mailed you items (but you never got anything)
Says? it?s to late to mail anything out now? (when you ask them to mail something)
Calling from a blocked number
Want to verify what you owe by email (always only accept U.S mail for debt verification nothing else)

Debt Collector
Called from an unknown number, a Derek something. He called earlier this week with a case number and said he would be at my place of residence today. This am another message and said he didn't get a " stop action notice"from the client so he would be out today to serve papers. Since I know the worst he can do if this is a legitimate debt is garnish me I'm not going to freak out.
