These people have been calling my work for the past year, I am not sure what they are referring to but they always mention MY name and tell whomever answers the phone to tell me that an officer is on his way to arrest me or a summons is on its way or I will be arrested!  Yesterday an automated call came thru that I happened to answer because the operator was out and it just said to let - my name - know that I was under investigation and about to be prosecuted. I was in shock and didn't grab the number off of our caller id fast enough. It rang 10 minutes later and a co worker got the exact same call and the look on her face! She got the number and we googled it and saw all of this and the scams going on so we now understood what was going on. Today a call was made to them to remove the work number and we would give them my number so I could find out what the heck this was exactly, but what sounded like a black female, as others have noted above, started screaming and saying NO, we dont want her number we are just going to prosecute and an officer will be there with a summons shortly! A few minutes later our work phone rang again and this same lady, and I use that term loosely, said, please tell Miss Susan that an officer is in route and will be there to get her!  She then hung up and it rang again right away and without saying anything hung up again!!!! Wow, how crazy is all of this?  The only past due bills I have are hospital and I am dealing with them and they wouldnt act like that anyhow so why in the world wouldnt they want MY number and instead keep calling and harrassing and saying these awful things to my co workers and myself? So Scary, I work for a TV station and I am going to see if our reporters can look into this and I am calling BBB and everyone I can to report all of this craziness!

Call blocker is your best bet.  At this point, no one knows precisely where these calls are coming from. Also, don't pick up on phone numbers you don't recognize. I understand this is difficult if you depend on your phone for business.

This looks like an attempt at extortion to me.   Go to the police and make a complaint.   This is most likely a scam company of kitchen-table debt scammers working out of someone's house.

Yes, that's true, up to a point.  Thing is, the more people post, the more the chances that these scammers can be found.  Sometimes they make a mistake and give a call-back number that can be traced to a physical location.  This information can be fed to local law-enforcement.

Prank Call
I received a call from this company, in which a voice mail was left for a male. I promptlyvreturned the call to inform thecompany they had the wrong phone number. I spoke with a black female by the name Rebecca (may not be her real name.. this may be her Dunn Name) dunn name is a name used by a third party collection/ collector when conducting business. Anyway I preceeded to advise her that I do not know this person and please remove my number from their data base..upon ending the call I stated in a joking manner.."Do your thang..3rd party collection agency"...Rebecca in return called back and asked what I said, once I repeated it..she informed me that "she was not going to remove the number and would callvback everyday"..Then hung up, I attempted to call back and speak with management or the owner and each time was transferred back to Rebecca who told me she had no time for me once I asked to speak withmanagement or the owner...I finally reached an individual who was mature, at this point explained her the simple situation of wrong number.. I also decided tobnotify her that they are breaking the law by impersonating law enforcement, a law firm and threatening criminal action upon an individual and could be sued to the tune of $10,000 an occurance and thanks to the representatives recording on my phone I currently have proof.  Barron Gibson and Phillips, LLC is a third party collection agency located in North Carolina they have had 11 complaints filedvwith the BBB in a 12month period...some phone numbers listed is  (855) 315-0695, (877) 760-4721, (866) 783-6805,(855) 853-6568 just to name a few. I also advised her rep that if I ask her to remove my phone number, they are required to do, as I am not the intended party that they are seeking..this tobis illegal as well as providing any informatoin in regards to the intended party's situation.. Any other information provided is considered thirty party disclosure and is also in violation of Fair Debt Collection Pratice Act...The information that I did find out is that the owner of this company name is Mr. DION BARRON. Contact person is noted as Ms. SUSAN BAILEY (ADMINISTRATOR)....There are two addresses listed 7925 N Tryon Street, Suite 200, Charlotte, NC 28262-3409 and 9009 Albermarle Road, Suite 257, Charlotte, NC 28227...email address is admin@barrongibsonphillips.com....In regards to prior post especially the one where the individual was not the intended party/debtor and they began harassinv you.. they were definitely in violation and you may want to catch them in the act of haraasing you and seek legal acttion against the company...

I dont even have a bill. I asked for proof of the debt and they told me they couldnt give me any statements or bills cause they need it if they have to sue me. Well the law states you have to be given a bill and than you have 30 days to dispute. But they wont show me any proof. They said they are going to sue me for frauding them. Yeah ok, and just how did l do that? Because l know my rights!! Thanks for your post

These people have called me.  I give them my lawyer's number over the phone and tell them that it is now the only number they are allowed to call and that this is their legal notice that they can only call that number.  I also ask them alot of questions about their company, which they don't like to answer.  My lawyer has yet to hear from any of these scam artists to whom I have given his number.  And it seems to have stopped the calling....for now.

I recently activated a new cell phone with att.  I received a couple of phone calls looking for "a woman's name" and a return phone number.  They made it seem quite important about legal action and district attorney, blah, blah, blah.  Well, I called the number to let them know " a woman's name" didn't have this number anymore and that I was the owner of this recently activated number.  What a stupid thing to do.  Now they have my name and have looked me up and gotten my relatives phone numbers that I have used as references on employment applications and other documents.  I always do a internet search to see if there is anything online about them.  I have no way of knowing who these people have called because most of information can be easily obtained online, such as place of employment, previous numbers and relatives.  This kind of harassment and personal image damage that these people inflict is irreversible.  The first time I got contacted by these "type" of people was at my previous job.  I tried to explain to them it was a scam, but I don't think they believed me and who knows if any of the other people they contact that know me will believe its a scam.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

just received a message from my brother that they had called. already had settled up my debt and had a letter sent out to me of this and tried to tell the first guy when i called to settle it like an adult. i asked him for his email address to which he gave me a fake one and when i called this place back to ask for an email address the guy who answered the call screamed and cussed at me and would not give me the email address and told me that he would rather take me to court than get money from me. I called back only to be sent to voicemail and left a message saying that the phone call was being recorded and that i didnt appreciate being screamed and yelled at when i simply wanted an email address and that i had contacted my lawyer . too funny , no self respecting law firm is going to yell and scream and cuss me out

Harassing phone calls from this company. Leaving messages saying a bench warrant will be issued, left messages with relatives advising to tell me to pay my bills, live up to moral obligations, stop being a loser, etc. Continues to call others and leaving messages advising of jail time, warrants, court orders when others have repeatedly told them to stop calling. Horrible people. Rude and they DO NOT follow 3rd party collection practices.Filed complaint with FDCPA and BBB.

Received a phone call for them asking if I've received my summons yet? I replied no. About a week ago, they called asking for someone with the same name as mine. I replied, " this is he " . When he asked if the last 4 digits of my social were, ***, I replied that I would not give out any personal info. He told me about a Capital One CC that needed to be paid. I knew it was the wrong person with the same name, he didn't. I replied, " ...and..?" He said I was sarcastic and that I would receive a summons for court, in Broward County, to go to court. I simply said, " please do, I sincerely want to go to court to clear this matter up"
Received a call from the same number today. Today's callers name was " Nick " . He asked if I had received my summons yet, I said no, I've been waiting for it, where is it. Nick then said, you sound Gay! Well, I lost it! 100% lost it! He of course, not being able to be a " real " man and listen to what I had to say, hung up! I lost my temper even more. I called back, the operator answered. I went off on her, regretfully, with some very colorful words. Words that I was not proud of. Needless to say, they called back with some of there own colorful words then hung up. This went on for about 15 minutes. The next time I called, I talked to a Mr. Spoon. ( ? ) really, think of better names, it was Def. the same voice as Nicks. I calmly explained that I sincerely wanted and was willing to go to court. He then asked me to apologize to Ms. Lorraine, the secretary. I apologized up and down, left to right. I was able to talk with her in regards to this matter. As I helped her look further into the matter and my phone number and yes, I did validate my last 4 numbers, she ended up apologizing to me, red flagged, supposedly , my phone number, had Mr. Spoon apologize to me, who in turn informed me that they listened to Nick and I's exchange on the phone VIA tape and told me he was packing up his desk as he was fired for calling me gay. RIGHT! I'm sure if I called from a different number, Nick just might answer. At this point, Ms. Lorraine told me that I would no longer receive calls from her company. I told her, if I did, and again, I was being sincere, I would have to take legal action against them. She claimed she wholly understood. All this and I'm still waiting for the phone to ring again, either by them or whomever they sell my number too.
I feel bad for anyone who has to deal with BARRON & GIBSON PHILLIPS! Good luck all.
