Debt Collector
Got a call to my place of business stating I was being served with a subpoena and sued for an old credit card that was charged off. They claimed I was being sued for double the amount that is on my credit report and what I owed but would settle for half. I asked for proof. They faxed me letter and after I did research, I found out it was a scam. I believe my information was compromised off a recent auto loan application. SCAM!!!!

CANCEL ur debit card and ask for a new bank account # as well. These people are snakes and will find any means to find out ur personal/private info. Safe guard urself from these pesky bill collectors.

General rule of thumb...

NEVER do anything based only on a phone call.  A legitimate collector should be willing to put agreements in writing BEFORE a payment is made.

I am getting the exact same message, tells me to call back but doesn't leave his number...multiple ones on my work phone. Then I actually answered and Louis Torres states he is a courrier..when I press him for what service, he says he is an independent courrier.  I asked him who the sealed documents are from and he doesn't know.  He states he will have to have my supervisor sign as a witness if I don't meet him someplace...ok, am I supposed to bring her with me? lol.  I asked for a phone number and he asks me if I am crazy..I think so.  I told him to stop calling my work and suggested we meet at the local police station.  The phone number that he does give as the originator of the sealed documents is for Outsource Legal Prep.  All sorts of nasty stuff online about them as well.  I reported to my lawyer, local police and the FTC.

Legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint.
Be aware that scammers are using bought/hacked/phished loan application data to extort payments for fictitious debts from victims and victims' families and friends.
The FBI warns about payday loan extortion scams here http://www.fbi.gov/news/pressrel/press-releases/paydayloanscam_120710
The BBB has issued several alerts on this scam, just google "bbb.org alert phony debt collector"
Report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Communications Commission http://esupport.fcc.gov/complaints.htm , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG, as appropriate.

Update... No "courier", nothing to sign. Will be getting a case number form the Attorney General.

Question, did these people once say how much you owed? Not me. Keep this thread going. Under the FDCPA, you can sue them for up to $1,000.

Received a call on June 16,2011 from a Ms. Woods saying they were trying to get me some papers to sign and if I did not call them back they were going to deliver them today between 12:00 and 5:00.  Also they sent a verification of employment to my Human Resourses department and told them that they had to send it back within 24 hours.  I refused to give them any information and also I have reported them to the Federal Trade Commission.

yes they are awful people! I had an LPA look them up by phone number and she said no such company exsists. I then spoke with the fraud dept. of the original lender and she said she had never heard of them and also looked them up and sent me fraud verification. They are SCAMMERS!!! do not give into them!! Your info was sold to them. they have only bare minimum of info on you, they are hoping you give up the rest!! CRIMINALS!!! file a complaint with the FTC the Attorney General and the FBI.... these scams are being investigated across the country. I also sent a cease and desist as well as had my cell number changed (thats the only # they had....which was fishy to me....if I really owed money wouldnt they have ALL my number??) JERKS!!

DO NOT GIVE IN to these people. DO NOT CONFIRM anything what so ever!! They want to confirm your personal info especially your bank account. They will use every lingo and scare tactic in the "FALSE STATEMENT" book. UNTIL they can provide you a LEGIT DEBT VALIDATION LETTER just send them a CEASE AND DESIST letter because they are most likely breaking every FDCPA LAW to man kind. Mail and fax them a letter stating that you want communications done in writing and that a debt validation letter is needed however look into your specific state to see if this so called "client" of theirs can even lend in your state--pay day loans. IF it's for any other debt it's a good idea to take time to research and don't forget every state in the USA has a JUSTICE DEPT with ATTORNEY GENERAL'S. FILE a claim if you have to! It's unfortunate people make a living off old, sometimes false debts. They are what you call bottom feeders. They take a debt and quadruple the amount for their own immoral benefit.

A man by the name of Jacob called from a withheld number.  He stated that he would be coming to my house to deliver a letter and that I needed someone as a witness there and if he couldn't reach me at home he would come by my place of employment and have a supervisor sign off as a witness.  He left this number to call back so that he wouldn't have to come.

They are doing the same thing to me. Obviously, if they were going to serve me they would've done it already. The message states, "My name is Michael Mason and I will be stopping by your place of employment late today so please make yourself available." I've been here everyday and they haven't done it yet. I think my info. has been sold to them.
