Rick Collins is full of S**t. They are scammers and very rude. They failed to abide by the FDCPA. I have several addresses and names that they use. They are not to threaten anyone with jail/arrest its against the law and they are lying. The debt/payday loan they informed me of was over six years ago and I paid it. I have the proof. It is best to file a complaint with BBB,
Consumer Financial Protection Bureau, Attorney General, and FBI. This has got to stop. I recently found more information on them. They also have several numbers. They are the one's that need to be arrested for fraud.

Glad you didn't fall for his scammy spiel!  Debt is civil, not criminal, so even if you had defaulted on a loan, you cannot be arrested for this.  The loan has nothing to do with your parents, unless they actually co-signed for you.   In fact, threatening you with arrest is a violation of federal law (the FDCPA).  Per the FDCPA, you should not pay any caller who refuses to mail - do not accept email or fax - proof of debt and proof they have the legal right to collect said debt.  Refusal to mail this documentation within five days of their first call is another violation of federal law, and as such, no written, verifiable proof mailed to you = they can go pound sand, per the FDCPA.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I forgot to mention that he works for the Treasury Department. I think he pulls your information from payday loan applications and then searches every aspect of you and uses that as scare tactics. Be wary of this guy.

Ok, so I got a call from Rick a few weeks ago and said I had a body attachment against me for a payday loan I didn't pay. I don't doubt the debt, I did take out a payday loan. At first I thought he was crap, so I just dismissed it. He then called again and this time he said that since I took the loan out through my computer at my parent's house he was going to have them arrested for fraud also. This time I paid attention. I got the info I needed. Then I told him I would call him back after I do some calling. I called the original debtor and it has indeed been paid. I called him back and he said he would verify. This was about 6 hours ago. Still waiting for him to call so I can totally throw it back at him. Oh, contacted the local PD.

All in all, don't trust this guy. If he tells you the original creditor and then go through the gambit until you get the answer you need. I had to call 4 different debt collectors, but then when I got the the last one they told me it was paid and even verified the reference number from all 4 previous collectors. Tell him you have to verify because I know he will never give you any information about who he is and where is is from. You will have to play the game and act the victim until you get proof of his scam. Also, when you do your homework ask for the creditor to send you an email, and hard copy through standard mail.

Tell him you have to have some time. PD told me that there is no way you can be taken to jail for a civil debt. IF... IF he calls back I will just tell him to serve me with the court papers and I would be happy to go to court. I thought I was pretty saavy when it came to scams and stuff. But... this one got to me.
