>>  he said he couldn't send me anything because it has already been proven I owe it.  <<

Typical lie told by an abusive "collector".

This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

* Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]    <<<<<<<< READ THIS CAREFULLY

* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don?t pay your debt
- say they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
- say that legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;

The debt collector may not garnish your wages unless there is a court order to do so.
+ Many Federal benefits (including Social Security Benefits) are exempt from garnishment

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

Report any problems you have with a debt collector to your state Attorney General?s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

A man named Bill Davis called and said I owed 2 payday loans from 2012 and that if I didn't make arrangements to pay they were going to start the legal process.I asked from paperwork to prove I owed these loans and he said he couldn't send me anything because it has already been proven I owe it. I threatened to report him....

I got a call from a Washington, DC wireless cell phone of 202-779-9983 and the toll free number of 1-855-477-8864 about 2:15 pm today. Spoke with Mike Baker and then spoke with his supervisor regarding a payday loan from March 2012. Looked there company information named Advanced Capital Solutions from Canton, Ohio. This company is not located in Canton, Ohio. I have done further investigation on my own. Mike Baker's supervisor did a three way call to the Ohio's Secretary of State, but could not get through. I also looked up the Ohio Secretary of State Office and looked up Advanced Capital Solutions.

Never let bullies on the phone confuse extortion with debt collection. Honest debt collectors do not typically send their claims straight to a judge, and they don't take your ransom money to broker quick deals with so-called "process servers". There are no secretive "arbitrators", "mediators", or "prelitigation specialists", only sweaty criminals with a script full of bullying remarks. Lawful debt collection is a process, not an ambush, and you are due a chance at each stage to raise a dispute. The agents' horrid threats are empty and their conduct is illegal. Do not reward lawbreakers with your money. Challenge them always, sue them if you can.

A caution from the *real* IRS, excerpted:

WASHINGTON ? The Internal Revenue Service today warned consumers about a sophisticated phone scam targeting taxpayers, including recent immigrants, throughout the country.

Victims are told they owe money to the IRS and it must be paid promptly through a pre-loaded debit card or wire transfer. If the victim refuses to cooperate, they are then threatened with arrest, deportation or suspension of a business or driver?s license. In many cases, the caller becomes hostile and insulting.

... "Rest assured, we do not and will not ask for credit card numbers over the phone, nor request a pre-paid debit card or wire transfer,? says IRS Acting Commissioner Danny Werfel. .... Werfel noted that the first IRS contact with taxpayers on a tax issue is likely to occur via mail.

The FTC echoed this warning a week before Tax Day this year:

Fake IRS collectors are calling
http://www.consumer.ftc.gov/blog/fake-irs-collectors-are-calling

A former IRS employee commented in another 800Notes thread a couple weeks later:

http://800notes.com/Phone.aspx/1-202-506-9141
"... I reported them to the IRS CID division. The scammer tried to say they would call the cops on me. DON'T believe that! The IRS hates to call anyone! They do everything on paper, not by phone. I told the scammer as much, and also told him that he was using a false caller ID and I was reporting him to the FBI as he was calling from Pakistan. He hung up on me. ..."

Voice mail left with some scripted message from an "Advanced Capital Systems" guy, claiming they "needed my signature on some documents sent to my address" and "my attorney's name and number" (both non-existent). Another collection scam - these guys have been "dinged" before for this crap

they're just scammers, don't gve them anything. don't even call them back or pick up the phone. they steal your info online and call you threatening legal actions but when you ask for paper work they never send anything. they're a load of bs making up stuff to get money from you. they'll tell you to pay them and once you pay them nothing happens. you'll get another call a month later from a different person and different company with the same bs line.

report to ftc and report to fbi tip line as money extoritionists.

Recieved a call from a local number saying they were advanced capital solutions and they were looking for my husband. Taylor Greenery said to have him call her back at this 855 number ext. 109. Just found it a little odd seeing as the pre-recorded message said that it had something to do with his 2013 fiscal taxes and Taylor said that there was a case pending with his name and social. Wouldn't the irs contact him if their were something wrong with his taxes? Sketchy!!!
