Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Received a call from Karen Banks, shown on my cell as unknown.  Told me to call the 855 number with this case number. Was told 48 hrs to respond or they will make a decision without my consent.  Well in my state you can't harass me owing money it's illegal in pa! And really if they have something against me, why no mail or letter, huh?  It's a scam!  Had one similiar from a company calling from Texas a few months back and nothing happened!

I got a call from a private number and was told to call back at 855-549-8901 about a complaint filed against me. They said I owed some unpaid credit card debt of $4800 and would summon me to court unless I settled on a lesser amount of $2800. It was a person named "Michael Wells".

I first received a call saying he had a summons for me. then I got this number from them. when I called they said they are suing me.threatened to garnish wages, bank account and take my driving license away. this debt is 990.00 from 2008. they say I owe them 3680.00 that includes court costs. offered to make payment arrangements on original 990.00 but said I must pay full amount immediately. Guess I will be going to court, although no summons yet and they did make threats which are illegal in my state of PA.

This is a scam. 855-549-8901. they said to pay them $500 on my credit card and they would pay off the lawyer to get rid of the complaint. They just needed my credit card number, they would even spread out the amount on several credit cards or would take my bank acct number and take $500 out of there.
 They said lots of people are no longer paying their bills so they are a debt settlement service, pay them $500 on your cc or bank acct and they get rid of the filed complaint for you.
If you do not pay, they say you will be sued in court and the court will take everything you own and leave you on the street homeless.
SCAM hang up on them and report to your local police. If they leave a message, call the police to have them listen to the scam message to make a report against the scammers.

Sounds like your typical extortion scam.  Debt is civil, not criminal, however scammers know that threatening people with "charges" scares them enough that they might pay them.

t is illegal to threaten people with lawsuits, charges, jail time etc, to intimidate them into paying an alleged debt.  Report the caller to the FTC, FBI, Dept of Justice and your state's Attorney General.  Do NOT pay them any money!  If they were legitimate they would not use threats, and they also would have no problem mailing proof that you owe the alleged debt to them.  No proof of debt mailed to you = nothing owed, per the FDCPA.
