No you don't.  Your jaws get tight and you come on a board like this and pump your BS trying to boost you chances of collecting.   Otherwise,  you'd be back on those phones shaking down grandma out of her social security and little Jimmy out of his lunch money.

Of course people know whether or not they have a debt.  But,  here's the thing.  The question is not whether a debt is owed or not.   The question is "do you have the cajones,  and the legal right to claim and collect in court". It's up to you to prove that it is legally collectable, by you and in that state.   If you can't validate,  you don't collect....

I received a call from a woman named Diane Wilson stating that I am being investigated and a warrant being issued for my arrest over a three year old payday loan. When I called her back I was transferred a supposedly lawyer who at first said he cannot do anything for because this situation has gone to warrant status, BUT then put me on hold to check something. He came back to the line and started talking about I got a payday loan and they have me video surveillance and so forth. He said that I would need to make a payment in the amt of 1610.00 to stop the warrant process. I asked so you said the warrant was already issued but now you are telling me that it has not been issued. He said no and asked if I had the money to pay, I told him yes so that he would move forward. He then transferred me to his assistant Ms. Campbell, I asked what the name of this company was, she said The Law office of Mediation and Arbitration in Dallas and the telephone number is 9729687218. She proceeded to give me Money gram information  that entailed me using the BLUE and WHITE express form and to put the receipt code #7031 at the bottom and to write the company name VANTAGE POINT SERVICES. I asked for verification in writing of this debt be faxed to me before any monies is sent to anyone and this woman told me to get the info from some processing place after a payment is made and that is all she would give and said that we are not a collection agency and we don't just sit around writing letters demanding payments from people!!!!! I told her I did not say that but I do feel that you all are a scam and I need written proof provided to me or there will be no monies sent to anyone. She said I would get documents once I make payment of my restitution then forms will be emailed to me.    I AM SO SICK OF THESE HORRIBLE PEOPLE CALLING AND HARASSING AND DISRUPTING PEOPLES LIVES WITH THIS UNETHICAL MESS AND THREATS OF WARRANTS AND JAIL!!!!!!

Kimberly next time she calls, tell her first that having an "affidavit" means Jack S***, and that if she wants to continue trying to scam decent hardworking Americans out of money she should brush up on her legal jargon. Ace Cash Express handles almost all collection from inside the company. It costs TOO much money to outsource and the payday scumbags like their money too much to pay outside bottom feeders. My advice, download some kind of call blocker. If you cant, get creative and call her 50 times in a row and just hang up when she answers. Then get a whistle, blow it in her ear when she answers. As soon as you hang up - call her again to see if she answers, if she doesnt you should be good. If she does answer, blow it again and repeat until the dog learns. Dont let them scare you, that is what it is all about - intimidation. Be a Bi***! She is threatening you, get pissed and deal with it.

New Variation on Telephone Collection Scam Related to Delinquent Payday Loans

02/21/12?The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

?Contact your local law enforcement agencies if you feel you are in immediate danger;
?Contact your bank(s) and credit card companies;
?Contact the three major credit bureaus and request an alert be put on your file;
?If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
?File a complaint at www.IC3.gov.

they are a scam, they called my phone looking for someone else, and when i gave them my name to prove i wasnt, they told me now they would put that debt in my name, i told them good luck. please report them. and what ever you do DO NOT PAY THEM OR GIVE THEM YOUR INFORMATION!!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

These people have been calling my phone this entire week . I made the mistake of answering a phone number i didnt recongnize. I answered the phone and it was "Investigator Miller". First off she was a bi*** from the start. Then she started talking felony charges and all this BS and tried to get me to pay over $1300 she even stated that she was just giving me a courtesy call before she sent these papers off to have a warrant sent out for my arrest. I have to admit at first i was a little shocked...but the way she was acting so unprofessional just raised a red flag for me. I started asking her questions that she couldn't answer so she hung up on me. Of course at the time  i wasnt sure if this was legit or not so i called her back. Well she answer the phone liek this "oh your calling back oh so now your ready to talk". She then proceeded to say that i had to make a payment today if not i would be arrested. So by this time I had gotten the hint that this was just a collection agency trying to scare me so i played with her a little. I said ok ill give you 300 dollars...boy was she happy and wanted the payment on the spot. Well i then started asking her more questions and eventually she got frustrated and said that i was wasting her time and good luck on my case and proceeded to hang up on me. Well i kid you not....about 3 minutes later i receive a call from a Mrs. Wilcox calling me from phone number 972-546-8592 saying she received information from Investigator Miller that I had agreed to make a payment. so I ask Mrs. Wilcox where shes calling from and she says HOUSTON.....WOW WHAT A DUMBASS..DOES SHE NOT KNOW THAT HER PHONE NUMBER IS A LANDLINE IN DALLAS!!!!! At this point I was done with them...so I tell her as well that im going to make a payment just so they would shut the hell up. Well of course i didnt make a payment and now they are stalking my phone calling from all kinds of different numbers. I have received calls from 972-546-8592 from Dallas Tx, 585-633-0269 from NY and 855-760-8955....they are the same people dont answer!!!!!!!!!!!!!!!!!!!!!!!!!!

I am posting this message here, but it also pertains to phone number 678-894-2050. This number possibly belongs to a company who says their name is: Reid and Associates; address 210 Pryor St SW, Suite 218, Atlanta, GA 30303. This number (678-894-2050) is a 'work cell' for 'Elizabeth'. Their e-mail is lreid.assoc@gmail.com or my favorite, Elizabeth's 'personal' e-mail: bensonandfuller@gmail.com (which btw comes up as a third-party collection company in FL). They will claim you have a pay-day loan you never repaid. They will tell you it's going to court and you are facing two felonies if you don't pay THAT day. It isn't true so before you MoneyGram (using the blue and white Express Payment Form, they will tell you) a ton of money, or worse- have them take it out of your bank account- contact a lawyer in your area. I am in Texas so I contacted one in Houston. You cannot be charged with criminal offenses, such as "malicious intent to defraud, etc....' for this. Secondly, the statute of limitations is four years in the U.S. And third, if you do MoneyGram the money, MoneyGram said they are unable to get it back for you. I also contacted the BBB in Atlanta, GA and the Federal Trade Commission and filed a complaint. Tell them not to call and hang up. I knew something was up when they wouldn't provide me with any kind of information.
More info on the MoneyGram- they want you to send it to receive code 7031, company is called VPS, which stands for Vantage Point Service which is why I am also posting this here.
I've tried to provide as much information as I possibly could to help anyone else. I had no idea what this 'payday' loan was from more than four years ago, but was totally freaked out when they started talking felonies. I am so glad that my gut told me to look into it and I did. Hope this helps.

Same MO....They said that i had a pending court hearing, and that if i paid it right away, they would stop the court process. They did have some good info to make you believe that the debt was real. They even had the last 4 of my SSN.   Make sure to ask all the questions.....He was unable to tell me what county the pending date was in.

You should also know that they are in compliance with all New Hampshire collections laws including (but not limited to):...............Fair Debt Collection Practices Act (FDCPA) and your rights

The FDCPA is a federal law that provides residents of all states with considerable rights and protections against abusive, unfair and deceptive debt collection practices used by debt collectors. Examples of debt collection practices prohibited by the FDCPA include using profane language, lying and calling a debtor at work if the debt collector knows the employer disapproves. The debt collector must also protect the debtorâ??s privacy by not disclosing the debt to others such as friends, family members or co-workers.

A debt collector, as defined in the FDCPA, is anyone who regularly collects debts on behalf of an original creditor.

The FDCPA covers only consumer debt, which includes personal, family and household debt, but not business debt or any debt incurred for business purposes. Common types of consumer debt are credit card debt, automobile loans, home loans, utility bills and medical debt.

A debt collector may not contact you if, within 30 days after you are first contacted, you send the collection agency a letter stating you do not owe money. However, a collector can renew collection activities if you are sent proof of the debt, such as a copy of a bill for the amount owed.

Debt collectors may not:

   Use threats of violence or harm against the person, property, or reputation
   Publish a list of consumers who refuse to pay their debts
   Use obscene or profane language
   Repeatedly call on the telephone to annoy and without identifying themselves
   Advertise your debt
   Falsely imply that they are attorneys or government representatives;
   Falsely imply that you have committed a crime
   Falsely represent that they operate or work for a credit bureau

Illegal Actions of a debt collector include:

   Calling you at work and knows that it is inconvenient or that your employer disapproves or forbids it.
   A debt collector knows that an attorney, whose contact information is known or is easy to locate, represents you and the debt collector continues to contact you.
   Debt collectors can only communicate with other people to obtain contact
   Misrepresenting the amount, character, or legal status of a debt
   Communicating false credit information about you
   Refusing to honor your dispute or cease communication rights
   Threatening to take your property or garnish your wages without a court order (judgment).
   Intimidating you, AND your family
   Endangering your reputation, or your property
   Using profane or obscene language
   Painting the Debt and credit issues are matters of criminal law while in actuality it is civil law
   Tricking you into accepting charges for collect calls, telegrams, or a C.O.D
   Attempting to cash a post-dated check before the date written on the check
   Claiming to be an attorney or sends a letter made to look like it is from an attorney when he is not an attorney
   Sending a letter that is made to look like a government or court document when it isn't

You can sue:

You may have the right to sue a collector in a court of law. If you win, you may recover money for the damages you suffered and, in certain jurisdictions, you may recover statutory damages. In addition, court costs and attorney's fees may also be recovered.

You can report to the office of your state attorney general and the Federal Trade Commission;

Report any problems you have with a debt collector to the office of your state attorney general and the Federal Trade Commission. Many states have their own debt collection laws and your state attorney general can help you determine your rights. In addition, you may contact a local attorney to determine your legal options regarding an alleged FDCPA violation. ............................................................So It seem to me that they are violating their policy.  Or am I wrong?

This number is NOT legit. Phillip Schultz with "Integrity management" made me believe I needed to make payments to them for a pay day loan that I hadn't paid, but I did pay it off. Then they try calling me later as a different company "VP Mediation Services" and it was a different person asking for a larger amount. They were rude to me and hung up in my face. Luckily my bank was able to give me all the money they had been taking out without my consent! If these people call do NOT answer. They also called me at 855-760-8955 it's a total scam and my bank and I are prosecuting!!!!!
