Debt Collector
Today I figured out this scam because I just happened to be gone and my machine picked up both calls.  They work together.  DSS Debt Solutions Services 855-673-5298 and Pre Trial Resolutions 888-278-8565 John Spencer.  The first call is from DSS around 11 AM today 3/31/2014, then three hours later Pre Trial Resolutions aka John Spencer with a case file and 48 hour warning.  I started out with DSS, called them first to see if I could find out why they were calling my deceased son after 16 years of being dead.  It was for a car loan with Capital One in 1975 when he got a loan bought a car and then told Capital One to come get it and repossess it.  My son was born in 1966  so at the age of 9 he took out a loan for a car and actually bought a car????  That was 39 years ago and in my state you have only 5 years to collect a debt on a contract and 3 if it is just an unsigned loan.  Then they changed their story to it must have been my husband who does not have the same name as my son.  However they had the last four digets of his SS #.  We never defaulted on any loan ever and pay cash for most things including cars and houses.  She informed me no matter what I said,  they were turning it over to the county where I now live and it would go to court and we would be sued.    I said well we will not be there so good luck to you and hung up.  Then I called the John Spencer number who it turns out is the second half of the scam, once you are told you will be sued, you are supposed to be sooooo scared you will quickly do what ever John Spencer says including paying him some huge amount of money to keep the thing out of court.  I just laughed when they told me this and hung up.

This is a debt buying firm that buys old debts for cheap amounts and then attempts to collect on them by using unsavory tactics like telling you that you can be sued.

Do not EVER pay these people even one penny.  DO NOT CALL THEM BACK.  DO NOT WRITE TO THEM.  The only contact you should ever have with them is when they call you and then you should be the one asking the questions like:  What is your name, What company do you work for, what is the street address of the company.  I assure you the call will not last long.  After they hang up on you report them to the http://www.consumerfinance.gov/.

You might also get an attorney and follow his advice.

This is a debt buying agency that is trying to collect a way out of date debt from me.

These guys can dish out the attitude but if you start to give one back they hang up on you.  Some snotty punk from here called me and before I could even figure out what debt he was talking about he got snotty and then hung up on me when I started asking questions.  I think he said his name was Jordan.  I reported this place to the consumer finance protection bureau.  Anyone else who hears from these idiots needs to do the same.  I have also hired a attorney and am waiting for this punk to call me back again so I can record him threatening to sue me.  They might wind up putting some much needed cash in my pocket if they ever call me again.

I just received a call yesterday. Not going to bother with all the details, however it is a scam!!!! I did extensive research and I am taking action!! They had personal info on my family as well, thats what threw up the red flags! If you have the spare time you should contact FTC as well. Along with other avenues. Who knows what could happen.

Also, he made a huge mistake in his message.  He said "Hi, this is Rick Dawson calling for ___ ____ (my ex husband that I divorced in 2003).  I am calling about a civil complaint on you that has crossed my desk.  This call is confidential and if you are not Rick Dawson..." then he hung up.

Just received a call and message from "Rick Dawson" for someone that I divorced back in 2003!  I didn't even have this number back then.  He said something about a civil complaint against him and to call back.  Strange.

Got a call on my cell from 855-673-5298.  Guessing from above, it is a scam.  Did not answer, as usual, and no message was left.  I hope my number is being called at random and it is not some mining program from something I legitimately signed up for.

Just got of the phone with Jordan Daniels:
Debt Solutions Services
PO Box 381
Cheoukowaga NY 14225

He claimed that he could not find my phone number in their system.  He was defensive.  I let him know that a letter might be headed to our Texas Attorney General as I am being harassed by continuing phone calls for somebody else's debt.  He just can't understand it!  855-673-5298.

This has been going on for several years.

I get messages and calls from these folks for another person.  I keep letting them know they have the wrong number.  They keep promising to take me off their list, update their records, etc.  Once I refused to identify myself, and they said they'd have to send an agent out that day.  I asked them to please do that.  They are rude and obnoxious, always.

They rarely give a true picture of who what they really are - a collection agency.  They use a variety of names for their company and imply that they have legal authority to do things they do not - such as serve warrants in criminal cases.

Received a phone call from {785-783-5380} the number to call them back was {855-673-5298}.  The message left was:  I am calling for name given {our son who has been dead since 1997} a local merchant has filed a claim against you for a bogus returned item that you used your driver's license for and we have that information and he will be filing suit against you unless you call the 855 number immediately and this is the only warning you are getting on this matter.  Recorded message which is illegal and calling about someone dead for over 15 years is a little weird and also very disturbing for us.  I called the 855 number, it was answered by another recording no one is available at this time.    SCAM and a very cruel one at that.  I have blocked the number but imagine they have more than one number to call from.  We moved to this state 10 years after he was killed and he never lived here so they are just fishing.

If it is a scam collection agency.  Then it will probably be hard to trace them in the first place.  Much less be able to file any sort of charges against them

Any debt collector threatening you with a lawsuit that they do not intend to carry out is illegal. Every state has a different statute of limitations on debt after so many years the the lender cannot file a lawsuit. When the statute of limitations is reached the lender usually sells the debt to some shady debt collection agency. These collection agencies rarely follow the rules of  the fair credit collections act put in place by the FTC. My suggestion for anyone who is dealing with harassment from these illegally operated collection agencies is to first report the company to the FTC, and if it continues you can file a lawsuit against the company. In some cases victims are entitled to up to $1000 in punitive damages. It is stressful having debt, but no one should be harassed and bullied buy crooked collection practices. Know your rights and stand up for yourself.

They keep calling and asking for someone that is not me. I am not picking it up but they keep leaving messages on my cell phone someone named Tammy White keeps calling me. It is really annoying they keep telling me something about a person being in arbitration for a pending civil suit and they wish that person good luck.

I began receiving calls from this number earlier this year. I immediately got on the case and asked them to identify themselves and the supposed debt. They have claimed several times to have emailed and mailed information to me: regarding the so-called debt. I have never received it! They stopped calling for several months and recently began calling again. I answered for the first time in 9 months. I was told the same thing and again told them that I had not received anything. This time I was told that they would email it and call me back (this is not the first time this has been said by them). The last time this happened, they of course did not call back for several months and then started all over again. My next plan is to contact the original creditor.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They claimed to be the arbitration office of the county in which I live. Claiming that unless I pay X amount by Y time they will have me charged with felony credit fraud. My first clue they were fake was that they were in a different time zone from me. This business is b***s***. Do not negotiate with them. It is a scam.
