Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Yes this jerk - "Claims runner" aka "locator" John Houston called from 713-936-2599 and left voice mail on my office phone re: a claim number and stated an order has been submitted regarding a formal claim and charges are being filed against me.  I have one opportunity to resolve the matter by contacting the firm at 855-680-2883.  So I call and talk to the lady.  She said oh did you once live at [my former address]?  She then says this is for a payday loan with Integrity Advance which I took out in Month/Day regarding checking account ending in ####.  The total due was over $1000.   I advised the runner was not allowed to call my office and talk to coworkers and say he had a claim filed against me and pretend to be law enforcement.  She said if you are calling to complain about him, I cannot do anything about that.  She said they could call employers and family.  I asked her what her address was and she would not give me that information.   I asked if they had a license to collect Debt in my state, she said we are not a debt collector we are a Pre Litigation Processing Service.   So there ya go.  They have an answer for everything don't they?  Skate around the law.   Well - I am going next to Attorney General and a consumer law attorney.

Yes this is a SCAM and same thing happened to me about the same day as the rest of you all.   They called me at work and they have called before and talked with our CFO's secretary which was very embarassing.   When you apply online for a loan, the information is "shopped" out to many  lenders - some are legit and some are thieves who steal your information and use these scandalous tactics to trip you up.  They call my elderly mother and she gets so upset.   I plan to go to the media.  I have also filed complaints with the FTC and they keep a record of it but really cannot catch the crooks because they use VOIP phone lines which are non traceable.   They are virtual ghost.    Good luck to you all and do your research.   DO NOT PAY THEM.  DO NOT TALK TO THEM.  If they call you at work, speak to your HR dept. and let them know what is going on.  Your identity was stolen.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I was contacted by 973-1033 (Kay Thomas) and told there was a claim against me. She told me it was with Accurate.  I was then given 855-680-2883 (Heather) to contact and get more information. She told me it was with Integrity Advance Payday Loan.  This lady told me I have a claim for 885 out against me.  Then she said it was for $1200 that I took out in October 2012.  Then that she showed I made a payment Nov 9 and that is why it is 885.  She said the 1200 was deposited into my Chase account in October 2012.
I never took out a 1200 loan in October. I would not even qualify for a 1200 payday loan.  I don?t make that much. I closed my Chase account early October.  I never made a payment Nov 9th because I didn't take out a loan. She said I must have made it from another account. She couldn't tell me who made it or how the payment in November was received (cash, check, card, etc.).
I did have some difficulty over the summer 2012 and took out a loan with Integrity Advance online.  I paid this loan back to them in full.  This may be why they have some of my information on file. I lived at a different address then. They said I?d been contacted at my current residence several times by mail. I?ve never received any mail from these people. I have a forward from my last residence still. I just found out about this 10/18/13.
Heather told me she was not with Integrity.  That she didn't have a number to contact Integrity. She could not give me anything in writing. That this claims runner (Kay Thomas) was going to contact me to bring fraud and breach of contract charges against me. That was the only way for me to get anything in writing on this matter.  That I would then enter into litigation.  Kay Thomas told me she would need to talk to my supervisor and bring charges against me.
This is fraudulent and a scam. Integrity?s computers are wrong or something.  I recommend you report these calls to the State attorney General.  In Indiana the law states that a payday loan company cannot auto renew a loan.  Then in any state after the 5th renewal they?d have to do a pay down.   The runner and Accurate are using strong arm tactics and aggression to harass people.

Received a call yesterday (10/16/2013) stating that I was being notified of charges. I asked several times what type of charges, what are the charges and what was this in reference to. Each time the lady told me that I would have to call 855-680-2883 and give them my claim number. I did call the number and left a message, but have not been able to speak with anyone at this point.

The subversive nature of my initial conversation and the intentional aversion to anything resembling a direct answer leads me to believe this is a scam.

I was called on my job by a Jack Warner who stated that he had a claim number and wanted to know the protocol for reporting a claim. I work for an insurance company so I immediately transferred him to our claims department. Claims flipped the call back to me because the call was actually for me: Jack Warner (if that is his real name) informed me that I had charges against me -- it sounded all very official and had I been a criminal or someone involved in criminal activities, I would've thought that there was a warrant out for my arrest. Jack Warner wanted to speak to my supervisor to ascertain what the "protocol" is for a situation such as this - what situation??? When I was finally able to get a human being at the phone number above, it turned out to be just an old debt. Calling someone's job, asking to speak to their supervisor, telling them that there are charges against them, etc.... is really over the top for collection on an old debt. The fright tactics aren't necessary and uncalled for.
