My sister got a call from these people today. the first call was from  a M Mortenson 612-287-5307 saying she had to call the 855 731-5140 number and give them a case number.do to a legal complaint against her. So we did and this guy that finally got on the phone David started in with. Telling her she was going to be taken to court over a phone bill that was from 2006 to 2011 from Embarq. told us he mailed letters to 3 of her addresses. but could not tell us where the phone service was hooked up at. He asked her to verify her DOB and last 4. but she kept yelling at him to tell her where the service was . after my sister filped out on the guy and i fliped out on the guy telling him if he felt he could take her to court go for it. I got on line to look up this embarq and found out they are owned by century link called them to see if she had a bill and nope no bill ever. didn't think so she has never had phone service in her name at all. What a scam

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Yea I received a call from them too, well they said I had a judgement from Sprint from the times of 2006 to 2011 which I know better! I dint have Sprint I had either Boost or T-Mobile during those times so beware of those numbers!!! To me it IS A SCAM!

Same story as others. A call came from 720-437-7129 to my Father In Law's mobile phone, and they asked for me by maiden name. He was given the 855 number, and was told I had to call within 2 hours or be subpoenaed to court. When I called, they stated it was a collection from Sprint, and I had until 1pm tomorrow to pay the debt, or else it would go to court and I would be responsible for over $4,000 in fines, plus they could garnish wages, put a lien on my cars, and house for the next 10 years.

I've contacted the FTC and Attorney General, as well as their website host to have their site taken down, and, hopefully, their identity revealed. Please do the same if you hear from them.

I got a call from a Colorado number which when called back is a Magic Jack number that left a voicemail for my to call 855-731-4140 a California number. I called the number the woman on the other line had my maiden name and social security number she told me I had a Verizon debt and I was going be sued for non payment of the debt.  I asked her when the service was and she said between 2004-2011 I told her I never had service between those dates and I asked where the service address was and she said it was privileged information and would come out in trial. Needless to say the conversation with her then became very heated and I was using profanity like there was no tomorrow. She demanded payment and I refused because I didn't order the service. She then threatened me with bank seizure, income take seizure, wage garnishment and leans on my property. I again asked for the address she refused I said then see you in court after swearing at her several more times. The next day I received a phone call from a North Carolina number asking me if I was available to accept legal papers (again they used my maiden name which hadnt been used in 9 years). The earlier in that day day I confirmed with Verizon that there was an account that was in default but at a location I never lived (second blow my identity had been stolen). I did further investigation and found out street address who lived there called the police federal trade commission credit reporting agencies and my bank and a lawyer because of this pending lawsuit. He told me to call them back and have them go ahead and serve me. When I called back a different person told me they sent it to their fraud department and closed the account.  I asked him to mail me a letter saying that it was closed he said they don't  mail out letters but would be happy to email me a letter stating such. I receive the letter and it seems fishy there is no address for the business on it just their  business name V&L assets and phone and fax numbers and there is no associates name on there either. With further investigations I looked up the address that I got off their plain Jane website and found out it was a plaza I type in the plaza name into the search engine and discovered that V&L assets is not listed in their directory. I believe somehow they find out there is old debts that have not been collected and they try to scare people into paying money to them. DONT PAY THEM TELL  THEM GO AHEAD TAKE YOU TO COURT. Good news is I was able to find out through the internet and public information who was living at that address at time of service but I am unable to prove that he was the person who made the phone call or paid the bills. I will let the police figure that one out. There operation appears to be in multiple states which will make it harder to locate these people.

if you have debt, you can indeed be taken to court for it.  no matter what the debt is.  but you should always verify it with your local courts to see if there is anything on their docket with your name on it.

Received a call from 720-437-7129 for my daughter asking that she call 855-731-5140. They claim if my daughter does not call there will be a summons against her. I decided to call the number back (720-437-7129), and you get the message that the Magic Jack customer is currently unavailable. I call the number 855-731-5140 which yielded a person answering V & O Asset Management.   If you do a reverse look-up for both numbers 720-437-7129 you get no results found and a box to file a telemarketer complaint. I did a search on 855-731-5140, it they are a telemarketer.

Nope.  A subpoena is used to compel the production of evidence or testimony of a witness.  If you were being sued for a debt, you'd receive a court summons.  You don't hear about a civil suit first via phone call - you would have received numerous dunning letters prior to service of a summons.  Which would have been your cue to mail a letter to the debt collector stating you do not acknowledge the debt and ask for proof that you owe the debt to that caller.  If they refused to mail this proof of debt/proof they can collect from you, then you don't pay them.  Simple as that.

At the request of the Federal Trade Commission, a U.S. district court has halted a debt collection operation that allegedly extorted payments from consumers by using false threats of lawsuits and calculated campaigns to embarrass consumers by unlawfully communicating with family members, friends, and coworkers.  The court order stops the illegal conduct, freezes the operation?s assets, and appoints a temporary receiver to take over the defendants? business while the FTC moves forward with the case.

The lawsuit, part of the FTC?s continuing crackdown on scams that target consumers in financial distress, charged four individuals and seven companies.  The FTC alleged that the defendants were part of an elaborate debt collection scheme operating from locations in Orange and Riverside counties in California, and that they used various business names including Western Performance Group, as well as fictitious names, which they changed frequently to avoid law enforcement scrutiny.

The FTC alleged that the defendants called consumers and their employers, colleagues, and family members posing as process servers or law office employees, and claimed they were seeking to deliver legal papers that purportedly related to a lawsuit.  In some instances, the defendants threatened that consumers would be arrested if they did not respond to the calls.  But the debt collectors were not process servers or law office employees, and the defendants did not file lawsuits against the consumers.  The FTC charged that the defendants? false and misleading claims violated the FTC Act and the Fair Debt Collection Practices Act.  In addition, the FTC alleged that the defendants violated the Fair Debt Collection Practices Act by:

improperly contacting third parties about consumers? debts;
failing to disclose the name of the company they represented, or the fact that they were attempting to collect a debt, during telephone calls to consumers; and
failing to notify consumers of their right to dispute and obtain verification of their debts.
The complaint names as defendantsThai Han; Jim Tran Phelps; Keith Hua; James Novella; One FC, LLC, also doing business as Western Performance Group and WPG; Credit MP, LLC, also doing business as AFGA, CMP, AFG & Associates, AF Group, Allied Financial Group, and Allied Guarantee Financial; Western Capital Group, Inc., also doing business as ERA, LMR, WCG, and WC Group; SJ Capitol LLC, also doing business as SCG; Green Fidelity Allegiance, Inc., also doing business as WRA; Asset and Capital Management Group; and Crown Funding Company, LLC.

What does the subpoena actually say?  Subpoenas are only issued by government agencies or sometimes by a court.  I think you have gotten a bogus document.  Debt collection companies do not have the authority to issue subpoenas.    You have to post more information.

OMG!! I got a call from someone telling me to call this phone number about 2 months ago. When I called them, they said that it was about a civil law suit against me. I refused to verify anything with them cause I thought it was a scam. I just received a subpoena yesterday saying that I'm being sued for a debt I had. I thought if you owe something it just goes on your credit. Can they really do this???? Can anyone help me please???

I got a call on a Saturday saying they were a law firm and they were collecting a debt and I needed to call them back within 2hrs. When I called them back I asked for more information and they said they couldn't give me any information until they were sure they had the right person and they asked for my social security number. When I called a recorded message came on and said they were a "Asset Management" company. When they answerd the phone they didn't answer in a professional way, they just said "hello".

original call from 213-283-9175 requesting me to call the 855-731-5140 with a case number. It's allegedly a pending civil lawsuit for a debt that is well past the statue of limitations for my area (allegedly from Embark). The account is not on my credit report (verified) and just a scam very old debt collector. Woman was rude with me, and very unprofessional. Neither callers identified themselves as debt collectors.

Basically they are phony debt collectors trying to scare people into sending them money for false debts.  Ignore 'em.  Call blocker might be a good idea.  I think most of these calls originate somewhere out of the US.
