Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I got a call from a lady named Sue Ryan. She told me she had papers to serve me for felony fraud and that I needed to call Michael Cox at 716-235-5869 and ask him for the details. I called and this guy Michael told me I was being investigated for fraud. He said I had a old payday loan for $535 from 2+ yrs ago I hadn't paid. He said I could pay it off in 6 payments of $110.95. Then he transferred me to another department. I don't remember a loan for $500 and I got suspicious and looked the above # up online while I was on hold and saw all these reports, so I hung up.  I called the police but they were no help.
So i talked to a police officer that came into the gallery i work at. He is going to investigate, and get back to me.

Received a call from a local phone number from a "Terry" (couldn't understand her mumbling last name) who states that she will be out to my home in a few hours.  She referred me back to the 855-775-2582 number.  Is there anyway to stop these calls? They are driving me crazy!

In a matter of minutes I received first on my house phone a Restricted# that was calling that I let go to vmail & they didn't leave a message. Then a couple of seconds later another call from 805-482-9064 that went to vmail & a Ghetto Low Life speaking with no grammer Black lady named Nicole Martin stated that this was regarding a case filing and summons to appear in Ventura County Courts 2/26/14 on case#171373 & that tomorrow on 2/26/14 (same day as my summons to appear) that Nicole Martin herself would be showing up at my home to serve me some court papers with her supervisor & that I would need to provide valid ID of which is the reason her supervisor was coming along (but wait if she's serving my "supposed court documents" on 2/26/14 how in the heck can I be in court on 2/26/14 when I'm being served on that same day. This is where the Red Flag went off in my head). Then If I wasn't home when she arrived that the court documents would then be returned back to the courts and marked as being a Direct Refusal by me as if I was here and declined to accept served court documents. Also she stated that in order to take care of this I would need to call her back at 855-775-2582 for further detail & that was the end of her vmail. Within seconds of this my sons cell phone rang & a Restricted# appeared so he let it go to vmail. Again a couple of seconds later on my sons cell phone the same Ghetto Low Life speaking with no grammer Black lady named Nicole Martin left the same vmail on my sons cell phone. Both vmails the POS Black lady stummbled on what sounded like something she was reading from a script & she tried to hang the phone up by pressing #'s on the dial pad but didn't work & then she continued with her script. Needless to say these F'in idiotic morons didn't know who they were messing with this time since I myself am an FBI Investigator based out of Los Angeles, Ca & always have my own landline monitored/recorded at an offsite location. The moment an unknown call comes through its curtains for these scamassholes & even better if they leave a vmail since there's more time they spend on the phone leaving a vmail allowing for my IC3 spiders to work themselves back up thru the line to the originator & I can save their audio/vocal signature digitally & catalog it within our database...Crooked lowlife POS Scumsters What are you going to do now?

got a call from Robert Benson said he was a local courier company and he has court documentation that his needs to serve me with and said if he doesn't receive a cease and desist from the company that is serving me he will show up within 24 hours at my work or home and gave me the phone # 855-775-2582 and a case number to call them ....  when I called it's a company called ICS Collection agency ....  I just hung up the phone ....  I've had these calls before and I just ignore them because if they could of served me with papers they would of done it, they've been trying to threaten me for over a year now ... I think if they could take me to court I would of been served by now ... not to mention if they had a valid debt they would of reported it on my credit report which I check all the time and there's nothing ....

It's against the law for a creditor to threaten you with jail time. If they do hold a debt that you owe, then sue them and you will win.

These people keep calling me concerning another individual who they claim listed me as a reference.  I know nothing about this and told them to stop calling me about something that doesn't involve me in any way whatsoever.   They say they have a summons to serve.  One time it was a Kenneth Moreland.   Another time it was a James Cole.   The caller gives me this 855 775 2582 number to call them back.   But I told them to stop calling me about something I have absolutely nothing to do with and have absolutely no knowledge of!

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
