Debt Collector
I too received a voicemail that a complaint was being filed against my ss# and that I needed to call back. I called them and some woman answerd. She said that a complaint was being filed because I had an unpaid loan with quick cash advance. I said " oh - really....I told her she was like the fourth or fifth company that has called regarding this company that I had never heard let alone did business with. I told her to stop calling - she got kinda snotty and said well I am going to forward this to ur local county (like what is that supposed to mean. ) was that to scare me ? So I said go ahead and she said I will -- I hung up -- I am so sick of these people calling saying the same thing and trying to collect money for the same company that doesn't exist!!!!

I just received a call from these people yesterday! I was told it was for a bill I did acquire but couldn't find, older than 7 years. They threatened me with court and garnishment. I unfortunately gave them my bank account info and set up a payment plan. Are they legit? Or should I freeze the account?

You need to report these illegal debt collectors.  They buy out of limitations debt for pennies on the dollar. They are not legitimate debt collectors.  Please take the time to report them to the Consumer Financial Protection Bureau.  You can do this online.  This is the only way to put them out of business.  They are not allowed to call relatives and people you know  and divulge information on debt.  That is illegal.  If they call your work, you need to tell them you cannot receive these calls at work.  If they continue to call they are in FTC violation.  These places have been closed down  but it takes reporting them to the proper bureaus.

I receive two or three calls a day for the last week from  404-254-3788 with a recorded message stating I am under investigation and to call back at 855-798-1893.

I have filed a complaint with the Consumer Financial Protection Bureau.  I have sent recordings of all messages from them and the contact information I have found from job placement ads online for the 855-798-1893 number.

I did find a link to a collection company that was looking to hire experienced collectors to work during tax season.  "ItsTAX season and you all know consumers pay during tax season. Don't miss out on this great opportunity to join one of Atlantas fastest growing collection agencys."  (Not too good with their grammar and spelling).

They list the same 855-798-1593 number and a direct number to Mr. Wright at 404-326-8188.  The address they list is 3575 Habersham at Northlake Bldg. L Suite B, Tucker, Ga. 30084.

they also have a facebook page and list this number on it. 770-912-5652

I've been receiving recordings from a number in Georgia, usual 404-254-3788 and 404-410-7820. This happened a few years ago. Usually when they call I'm asleep, since I live in Hawai'i. This morning I made the mistake of calling back just to see what it was all about. Later in the day a real person called from 855-798-1893. It went to voice mail and Ms. Smith told me that my social security number was being investigated for Depository Check Fraud.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

THIS IS A BIT LONG BUT PLEASE READ:  Here's the low down folks; Do not let these collection agencies (yes, thats all they are) scare you into paying something you do not owe. I shamefully admit that I briefly worked for one of these collection agencies several yrs back and collected on payday loans. I know all their lingo and scare tactics they use to try to scare people into paying up.  Often times they will insinuate (or come flat out and say) that unless you pay them now youre going to 'be arrested', 'taken to court', 'have a warrant put out', or that 'a process server is going to come serve you papers', etc.etc. Read my lips: IT IS ALL B.S.!

For example, I've been getting calls from 855-798-1893 about an online payday loan they said I took out in 2009. I told them I did no such thing and the collector said that a "detainment order' will be issued against me unless I paid it. At that point I decided to have some fun with him and I called his bluff.  I asked him to define 'detainment order'. After a pause he responded by saying: "you know what that is".  In turn I replied, "yes, I do know what it is, it means that you're full of crap".  At that point I made him aware that I used to be a debt collector and I put him in his place.. He got so frustrated that he hung up on me.. It gave me a good chuckle!

Bottom line is, dont fall for their scare tactics and whatever you do, DO NOT pay them a dime!

Btw, It is a violation of the FDCPA (Fair Debt Collections Practices Act) for a debt collector to threaten anyone with arrest or criminal proceedings. If found guilty they are subject to a fine of $1000.00 per offense.
