The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I got the same call yesterday with a number for me to call them at 888-783-4057. I called them and they said that I was being sued by a company that I do owe money to but we are in the middle of a bankruptcy. The guy told me that they were suing me for criminal check fraud over a payday loan I took out and couldnt pay because I lost my job. He wanted to make arrangements to pay the debt but I told him I had no way to pay. He got beligerant with me and hung up on me. I called my lawyer and she told me it was a total bs deal and not to worry. The set up lady called me again today and I told her it was bogus and she said well ok see you tomorrow. I have a feeling she wont show up.

Record all their calls. DEMAND written validation of any debt be sent through the MAIL. Inform them you are recording and will sue for each and every violation of the FDCPA. Log and record every call. Report them to the FTC, their state attorney general and your state attorney general for every violation. Demand a physical address to send a cease and desist letter telling them to stop calling. Research the FDCPA and SUE EM for every violation, lawyers will take these cases on commission.

Just received a call from a "Private Number".  Caller identified herself as Ashley Cruise.  Said she "had papers to serve me and told me to call 855-804-1795".  By doing so she claimed it would prevent me being served at my place of employment or my home.  She gave me a 6 digit "release number" to provide when I make my call.  When I continued questioning her about what the call was concerning and how I was supposed to know it was "ligit" she told me it was regarding "fraud".  WHAT??!!  She said "the company was RPS and she had the envelope with the papers right in front of her".  She informed me it was not legal for her to open it when I asked why she couldn't provide me with more information since it was sitting right in front of her.  I asked her how she knew it was a claim regarding "fraud" if she was unable to read the charges.  Her answer was that she "deals mostly with that type of charge".  I said "then you are guessing about the nature of the charges"?  Her answer was "not exactly".  I told her to feel free to "serve" me any papers she had any where she saw fit because I was NOT calling a phone number without more details regarding the reason/situation.  She wished me luck after saying "I was free to do what ever I chose".  I said "thanks" and hung up.

Got a call from some broad saying she was going to serve me with a court injuntion for a PayDay One loan from 4 1/2 years ago. Told them it was not me then got threatened it would be $4-5000 if I did not pay them $593.95 by Wed. Seems like the scam is alive and going strong

Received threatening voice message from a Shawn James , order submitted to his office w/ a request for me to sign a certified notice of intent for impending litigation regarding a claim being placed against me.  Unless I contact by 3/9, he will come to my home or business to serve me.. " YOU HAVE OFFICIALLY BEEN SERVED" ... really, I owe no one.. I think its a scam...

Caller said that "I've been served" and will need to appear in Court on March 6th?  A Bella from 855-804-1795.  Must be a scam for I've paid off all my debt years ago.  Still a bit nerve-wracking, though.
