I hope you pay the people you actually owe the money to.  Just because someone calls saying you owe them, does not mean they have the right to collect the debt.  You can check with the payday loan company yourself - they can tell you if they sold your account and if so, who they sold it to.  However, if a 3rd party debt collector is calling, make them MAIL a debt validation letter, as is your right under federal law (the FDCPA - Fair Debt Collection Practices Act).

This company called my manic jack # today looking for my daughter who is a victim of identity theft! First I don't know how these bogus companies get our numbers! They are a scam co just trying to go after people that do not owe the money they claim they owe! They never give you substantiated information, but leave messages that you can't understand! Harass family and friends and make all kinds if threats! Report them to the FTC! You have rights that they are trying to take away. Any real law firm would not block their number when calling and leave a message like these less than dishonorable people do! I am so sick of them for years already! Know your rights!!

Actually, your caller is a scammer or junk debt buyer - it is illegal to impersonate a lawyer.  It is also illegal to threaten someone with charges or arrest for failure to pay back a debt - debt is civil, not criminal, so no one is going to be arrested.  Per the FDCPA, you should not pay any caller unless they MAIL a debt validation letter which shows that you owe a debt and that they have the legal right to collect said debt.  Refusal to do this within five days of their initial call is another violation of federal law.  They also violated your brother's privacy (another no-no) when they disclosed the reason of the call to you.  Remember - if a caller won't prove he owes a bill, your brother should NOT pay them!  More info here:

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

More scammer BS.  Your husband doesn't need to give any kind of "statement" in order to be served a court summons (btw, a subpoena is used to compel either witness testimony or production of evidence/documents).  Your husband can't have his wages garnished either, unless he's already been to court, lost his case and had a judgment against him.  No one gets a heads up they'll be served either - if a firm is going to be suing him, they'd have sent out dunning letters, and if these were ignored, they would then sue him.  And they wouldn't be calling to let him know either.  Per the FDCPA, you should not pay any caller who refuses to MAIL a debt validation letter showing that (1) you owe a debt and that (2) they have the legal right to collect said debt.  Refusal to mail this documentation within five days of their first call is a violation of federal law.  More info on this type of scam here:

Follow the steps in what you need to know. A legitimate debt collector agency should not have a problem with giving you a real business name and address you can google and verify via google street view, BBB etc.

This company called the human resource department of my employer and left the name Nationwide Arbitration Law Office and a case docket number for our county. First thing I did was check case dockets for my county, and found nothing. Then I looked up the name and found this site.

Got a call today from a Rick at number 855-839-5148 ex. 335. Saying that I needed to contact them with a case number and that we need to get matter resolved. Than it sounded like he was reading from a script cause he was repeating the words and was messing up what he was saying. I have spoken to police officers and they all have said that people are not going to call you and tell you that they are sending you to jail, or taking you to court, that they would just go to your local courthouse and file the papers and than have you served with the papers. Which in than only a judge can put you in jail or make you pay the money if in fact you owe the money. People have being trying to call me all the time saying that I owe this money and that which I don't and they have being calling me since July 2013, so year to date still have not seen no one at my house to serve me papers.

Nationwide Arbitration called claiming I owed a debt from a pay day loan i took out with Net Cash Processing, after further investigation it was found out this company is not legitimate and is indeed a SCAM!! Please be advised this company is no legitimate and they had my social which is even more frightening. Don't give them any personal information. Patrick transferred me to the lead Senior Arbitrator who was full of it, and very rude, I told them to get real jobs instead of trying to scam innocent hard working people out of their money.

This company left a voice-mail stating that my brother had many complaints in their office. I was told he needed to speak to a Mr. Jazinsky. This was the third phone call I received from them and after the first time I asked them to never call my number again.  I called and asked for Mr. Jazinsky and the woman (Amy I believe her name was) I spoke to said my brother had serious charges pending against him and before he gets arrested he needed to call them.  I then was able to speak with Mr. Jazinsky who told me he would let me speak to their lawyer, Catherine Vaughn, but that she was in a meeting and would have to call me back.  Catherine called me back from a blocked number and denied that she was their attorney and she said that she was a para-legal.  I told her it was unlawful for them to pretend that she was a lawyer and that my brother had charges pending and could be arrested at any time.  She said I was acting out and that they did nothing wrong....well I disagree, in these tough economic times people are having a hard time paying their bills.  For these sharks to buy people's bad debt and use scare tactics and lies to get money out of them is unlawful.

I received a call from a "Nationwide Arbitration" calling on behalf of Net cash Processing. Alleging that they need a statement from my husband or else he is going to be "served" next week at work or home with a supena and will likely have his wages garnished, etc. etc. They asked for his social security number from me to verify that I was his wife- I told them I would not give that and then they gave me his birthdate, and last 4 digits of ss #. Supervisor that I asked to speak to said his name was Joseph Allen at ext 327
I could go on and on with the bs he was saying- it was a bit frightening- was giving dates of loan and letters sent and talking in terms of 3 counts being filled. Call on my phone should the number as unknown. They gave me a number to have my husband or I call back with a statement and potentially to settle.

So was the caller an attorney? Sure sounds like the guy wants to be one when he grows up. The "pending case" and "series of complaints" lines imply a lawsuit threat, which is illegal if empty or cannot be carried out. It frankly sounds like typical talkoff bluster from an agency which cannot or does not want to prove you owe. The usual premise is that only the debt collector, by the grace of God and your rapid donation, can keep the nebulous "process server" or "legal team" or whoever chained up.

Don't be in such a hurry to "take care of it" with your money. Where's your initial dunning letter, the one federal law requires you get soon after the first contact? Has your 30 day window for validation opened? Do they even have the correct amount or numbers or names? Is the debt way past its "sue-by" date? What "seems legit" isn't good enough. You have to be certain, and it's your right to be careful.
