Debt Collector
I was contacted by a lady about 2 months ago, she started out by saying her name was something really official that I can't recall right now, but she told me she had a court document to pursue me for a hot check I wrote for a payday loan. First off, the debt was 4 years old. She didn't know the name of the payday loan place and gave me amount I should pay today, and that I can get it lowered if I pay faster etc. I hung up on her eventually cause she got loud and rude with me. Today I got 4 calls to my cell, they called my boss and sent our corporate offices a "order to withhold". I did research and found this site with all the similar scam. I will be reporting them to the BBB.

Yea they called one lat time som guy"mitch tanner" n said I maliciously intented to defraud them by lying since I reported my card los.  I told him of their violations based on texas state law.  He backtracked and said wait to get served and said good luck then hung up. Texas. Debt law doesn't allow you to get served without being notified by a sheriff. When their "processor" wanted to serve me he called restricted.  I spoke to the sheriff's dept. And they told me they identify themselves at all times to summon you.  If their is no answer they leave a message and call from a direct lime. I also went to the place I owe and they immmediately told me "scam".  She said she also got a call n hung up.  Thank you all for these posts cuz I almost paid them.  They are "fake" its been 4 days now and no "processor" has bothered me...lol!

Yes, their two weapons are fear and intimidation. And ruthless efficiency. This company threatened me to prosecute me and scared me. Then they got my account number but I feel they are scamming me because when I called them back they answered "larrry" instead of a professional answer. Plus a server told me he wanted to meet me to sign a court summons or make arrangements within a half an hour. I've heard they are scammin me because they never answer or their message says they're closed. I'm confused

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

These people called my brother a year ago and was hostel on the voice mail.  My brother gave me their number, I called them and found out it was about a payday loan that I had never made.  These people had my social security number and other personal information that I have no idea how they got.  I told the person I talked to that I didn't take out any payday loan and it is illegal in West Virginia.  They assured me that they wouldn't call back.  Yesterday Oct 26, 2012 my brother informed that he go a voice mail that was very hostel
telling me that I had better get in touch with them and even gave a case number.  They want me or my   to call them. I don't even know how they got my brothers number as I never give my brothers number out. How do you get these people to stop.

I recieved a very disturbing phone call today from Mrs. Kittleston @ Westwood manangement phone number 1-877-454-5563. She said I owned a payday loan from 2006. The addresses they had on file did not add up nore did the fact that it has been 6 years and they are just now contacting me. Afeter being threatened that a judgement would be placed against me as well as charges pressed for writing a bad check I was sent to Mr. Mike Mathis whom stated that he was the manager and was willing to offer me a settlement of $667.49 but that I owed $1,4020 and the payday loan was for 420.00!! I agreed to make a payment arrangement to clear up the matter and told him I would follow up with my attorney. After sepaking to my attorney I decided that I wanted to follow up on the matter in court. I called Mr.Mathis back to inform him of my decison. He told me that I was a liar! I was a piece of s*** for now paying my bills! (exact words.) I was a looser and that he would not send out the request to have the payments removed. I am appauled! I cannot believe that bill collectors have the gaul to stoop so low! They should be arrested for harrasment! Now, I have to place a stop payment on my account to assure that they don't get the funds from my account! I was hesitant at first but now I'm 100% sure this was not my debt and I would love to see them in court!  I will be filing a report with the loal sherrifs depart to file a report and I will follow up with the BBB! UNREAL!

Sue them!!! Save your voicemails and try and record your conversations, every violation they make against the FDCPA they are fined and thats money in your pocket. That will definitely close this business down.

I too receive calls like this all of the time but blocking them does not work because they only use a number for 1 week and then they change numbers. They also can make a call look like it is from out of state and really the call is coming from someone that is probable only 28 miles away from you. Please do not answer your phone when a call like this comes in, as soon as you do they know they have a live number and charges to your phone can start to occur. Just let your phone ring, no voice mail and no answer means dead call.

I just got a call from Westwood Asset Management. First they asked where to send the summons for theft for my wife. I ask for what and said that I am the husband, then it was ON!! "Sir, are you aware that you guys are stealing?" and the wen I asked more about the debt it was from 2005 I informed them that I know the statue of limitations in Nebraska is 5 years and that far exceeds that. He informed me that the company that sold them the debt most likely made a 3 dollar payment on it to keep it alive. I told him that sounds deseptive as hell and I am making a complaint. I asked how much it was for initially and he told me $258 but now it is over $3000 and they didn't care if it wrote off for more because "Either way, I get paid"

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Huntington Asset Management has been acquired by Westwood Asset Management, same scare tactics. Man named David Brown claimed he was an independent process server who called on behalf of Westwood and the number to call is 855 844 3537. Said he was going to serve me a summons and I needed to provide 2 forms of ID to sign or if we did not meet at my place of employment or at home he would forward to my county where a court date would be assigned. David's "message" was pre recorded.

I got a call from a Heather Gould and she said that I would be served a summons to my home or if I am not there that they will serve me at my employment.  She said that I was recorded of stating that I was going to pay and dates that I had scheduled.  She said that the call would be presented to the Judge for his hearing....I was being charged with check fraud and malicious intent to defraud a banking institution. The call came from 855-844-3537.  They have called and left messages several times but it all seems bogus because who calls you with telling you that you will be going to court just like that....SCUMMS!
