For at least the last year, an illegal group of debt collectors have been terrorizing consumers, their family, friends, and employees threatening to arrest the individual of an unpaid loan or other debt (their generally don't even owe). Be aware debt is a civil matter, not a criminal matter, and you can't be arrested. They threaten a warrant if the victim does not pay a sum of money by the credit card over the phone.

Some of the people they are calling do not owe a debt.  Others they are calling have already settled their debt with the organization who owns the accounts. Even if you do owe a debt, do not be deceived by the actions of this group.  Many of the accounts they are attempting to collect they do not own.  In other words, if you pay these people, that is not going to clear your debt with its rightful owner.  

Although when pressed the callers give the victim an address in Columbia South Carolina (usually a vacant lot) or Atlanta GA (often a parking lot near the bus station or a Peachtree Road Address). They are actually out of the Charlotte North Carolina area. The scammers are using the following business names (and there are many others, and they seem to create new ones daily).  They will normally answer the call back number as ?Investigations?

I received a threatening phone call out of the blue from a lady calling herself Inspector Morgan Taylor of Kennedy & Klein.  She claimed that I had an outstanding debt with a Cashnet company and was a third party collector and would be sending me a summons to my house and 'would see me in court'.  I pointed out to her that she was breaking the law and that written proof of the debt would be required prior to any summons.   When I quoted the   I will report them to the FBI.    When I quotes code 809 and its contents she hung up.

I didn't call back. Two seconds later my parents house gets a call saying the same thing. Glad I looked it up. This is a messed up attempt trying to steal money.

It is not your responsibility to prove that you don't owe the alleged debt,   but his to prove that you do.
It is absolutely stupid to ask someone to prove that a debt is not owed  If you didn't owe the debt to start with.
What an Amateur his is.  He wasn't expecting you to ask for validation of the debt,  so he tried to bluff you.
Good work and I hope others will stand their ground also.

Called me about a pay day loan, said that they were going to file court papers in 24 hours if I did not have proof that they were paid. Called me a dead-beat, very rude. I asked for paper work and everything, and they said that it was too late for that. I told them that I reported it to the FBI and that my attorney wanted the paper work, asked who my attorney was, I told Scot Majors that it was none of his business, and he said it was his business, I told him that my attorney would be getting in contact with him after we receive the paper work and that I reported them and the phone number to the FBI and he got rude and said I was a dead beat.

Left a voice mail on my cell with a name that had my last name but is not related to me in any way.  Should have looked at this site first before calling the number back.  Said they would take my # off their list.  I don't like dishonest people who pretend to be official and are not.

I have received a call from this number numerous times at work.  I decided to call them back and was passed around from Cheryl Davis to a Ms. Johnson.   They proceed to tell me that I took out a loan online that I did not pay.  I said really, I never have heard of that company before.  She said that she had all my information but would not give it to me.  She also wanted to know what time I wanted the officer to come serve me.  I told anytime would be fine.  She did not want to embarrass me at work but she guessed she would have too.  I asked where they were located and she said Columbia SC and that is where I would have to come to court.  I said apparently you do not know the laws in Texas.  She said and she would know them?  Yeah not very smart!  I also asked that they not call me at work.  They kept saying that the next person I talked to would take the number off there list.  We shall see.  Am seriously going to talk to an attorney about this!

Just spoke to Andrew in the "Closure Department"  oh my goodness.  Can you get any ruder than this person.  He was awful.  If they are truly trying to collect on a debt they give you NO information on what this is all about and have no concern that you may be a victim of idenity theft.  I am contacting my local law enforcment agency to report them for threat. and harassing phone calls.  They told me I have already seen a contract that I signed borrowing money.  I told them to send it to me and give me a address so I can coorespond by mail. Refused to do so.  This is so sad.

They called me back in '11 saying I defaulted on a payday loan. At first I thought it was identity theft. After I asked them to send me a letter in the mail with the amount owed and more info they went on and on about the payday loan company sent out numerous letters and they couldn't. Recently they called my father telling him this would result in jail time without bail if I didn't pay. Guy name "tony" and "Andrew". I asked why the company's name didn't come up when I googled the guy started laughing. Total scam

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. They pretend to be investigators and make it sound they are calling from courts etc.  They scam people of money thinking they will pay if they are scared.  They call so many times that they break the law.    They even harrasing family and friends.  Keep record of their calls and messages and get an attorney to go after them.
