I love your message and it is ok to insert politics.  So not paying a payday loan is a civil suit?  I do not know because I have never had a payday loan. I checked online to see if I had anything against me and I did not see anything. I think these "agencies" should be shut down. They are just bullies who want to take it out on every person they call. I did think it was weird that the collection agency would call AFTER the fact.  They would have nothing to gain.  I enjoyed reading your post and thank you again

Did they tell you which judge at the court was issuing the warrant, and who sent the alleged "notice?"  I would think it would be quite strange that a law firm would call rather than the court itself.

I suspect the court clerk may tell you that they don't issue bench warrants for not appearing in a civil matter but rather just enter a default judgment against you.  And you shouldn't be receiving a call from a law firm if it is a criminal matter.  Law firms are not there to prosecute criminal matters.

Forgive me for making one somewhat political statement here.  (I know, I criticize others for injecting party politics into these discussions, but I don't think this has anything to do with political parties as such.)  I think it is really scary that people can call and intimidate like this too, but the reason they continue to do this, in my opinion only, is that kids grow up in homes in which their parents either don't know or have forgotten a lot they learned (or should have learned) in their basic Civics class.  With all the sensationalist and politically slanted "news" organizations around these days influencing them and their parents, it is quite likely that Civics classes in schools are being cut, or students are avoiding them, or the lessons they are teaching are being ignored.  As a result, people do not learn the basic mechanics of the government and become more susceptible to charlatans of all types.

"I know no safe depository of the ultimate powers of the society, but the people themselves: and if we think them not enlightened enough to exercise their controul with a wholsome discretion, the remedy is, not to take it from them, but to inform their discretion by education. this is the true corrective of abuses of constitutional power." -- Thomas Jefferson, September 28, 1820.  http://www.monticello.org/site/jefferson/quotations-education

Debt Collector
This guy called and said that the court was issuing a bench warrant today because I had not responded to a 10 day notice, a 10 day notice I never received. Said I could go downtown tomorrow to the court house but I should bring a friend because I would be arrested.  Has anyone had this?  It is really scary that people can call and intimidate like this.  I could not find the law firm on the web.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I just got a call from this number and his name was Mr. Palmer and he said he was from Bohman and Greenburg and that I needed to provide him with 2 pieces of ID or I would be arrested.  I asked him to mail me something in writing so I could verified what it was I owed.  He said he couldnt do that and then he said I have been legally notified and that someone would be coming to pick me up and take me to the courthouse.
I'm still waiting and no-one has showed up.  The scary part is he had my social
