I?ve been getting calls from these ?company? recently (They told me they are UPG but when I called the automated system said they were UCG). They stated that I owed a debt for an amount of $430 from back in April of 2010. I wasn?t smart enough to try to get more information from them and set up payment arrangements. (this was after they called my ex-husband) After thinking about the whole thing, I googled them up, and after finding stuff like this, it made me call them back. So when I called back and asked what the name of the pay day loan company was that deposited the money into my account, they refused to give me that information. Then I asked what day in April the money was deposited and they still wouldn?t give me an answer. This brought up major red flags. So I called and canceled my card (that was what I set up payments with) and requested bank statements from my account back in April of 2010 (which has been closed since 2011). I got my statements and it showed that I NEVER had any deposits into my account other than from my work. So I called my bank and reported this. Luckily my bank did look into this and prove this wasn't a legit company and I was able to get my money back, but now I?m getting threatening calls from them telling me they are going to serve me papers and GOOD LUCK. Every phone number that they call from is a blocked number, but I?m saving voice mails from them (I refuse to answer the phone when they call) just in case I need to press charges or anything against them.

If you're not sure that what they're claiming is true, get bank statements to verify their claims. It's scary when they call and they have your bank account and SSN. (Not really sure how they obtained this) but DO NOT PAY ANYTHING until you've verified that info!

Debt Collector
I have been receiving calls for the past three weeks about owing a payday loan debt, but each week the loan companys name has changed. It has went from SSM Group, to DJR Group, to St. Armis Group (sp?) all of the amounts have been different with each call as well as the dates.  Today I received a call from Biana Newberry stating she was a locator and she was calling to speak with my supervisor to know the proper protocol to file a claim against me.... (ugh if you are legit you would already know that)  She did not give the # to the firm and stated she did not know what was in the sealed envelope but asked if I would like to make arrangements to meet. I replied, no how about you put it in the mail.  Once she was told that we do not give you the protocol on how to serve, etc., she hung up and then called my cell phone and asked the same questions.  Once I did not budge she gave me 844-803-1872 as the number I could call regarding my claim.
This company name was called UCG Group and the lady gave me the $990 amt that I supposedly owe and stated that this was my last correspondence, and attempted to verify my banking information which I did not verify and then she asked me what I wanted to do. I told her nothing becaus I do not owe you anything and I am not paying anything.  She then said ok, hold on please.  WTF are you serious????  I hung up the phone. I have filed claims with FTC and I am going to with my attny general here in KY. I can only imagine she put me on hold to figure out their next plan of action.
Ridiculous!!

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Just received a phone call from a blocked number stated that they are going to serve me court papers for breach & fraud. Have no clue what they're are talking about! Begin to ask more questions, what's   company name (said UCG) what does that stand for (It doesn't stand for anything) what's your address (we don't give out our physical address) however would tell me that they are located on New York! Well what's a PO Box #(that's for corporate office only) I ask are you trying to collect a debt (no), but in the same breath Sylvia Bristow name she gave me is trying to get money from me!!  This sounds like a bunch of Bulls**** to me. Told them I would have an attorney get back with her what number should they call, gave me this 844-399-9756. Who should I tell them to ask for you, her reply they can speak to who ever answers the phone.Mind you each phone call they give you no info about company, one phone call you keep getting transfered to different people. When does the harassment stop!!

That's amazing.  I just got the same call with all the same threats.  They didn't want to send me anything in the mail showing the origin of the debt.  They just wanted me to pay them asap.  I knew something was wrong when they used an address that I lived in 5 years ago but said the debt was from last year, from that old address.  I told them that I will see them in court. .

Funny, because when I asked for the company information, they wouldn't provide it. When I asjed what "debt" they were calling regarding, they wouldn't answer. I was asked to provide my social, my job addresd and my home address, but if you have a locator to serve me shouldn't you have all that information.  The "nice" lady told me to grow up and deal with my problems like an adult bc I was in big trouble,  yet they wouldn't provide me with any info. Total scammers.

Received an automated voice mail message, they stated they were calling from UCG and that they had a matter in their office but unfortunately since I did not respond to their previous contact attempts they were telling their client to proceed further to protect their interests.  They left a number of 800-352-3898 with a case number.  They said I needed to call within the next 48 hours.  I have not called back and I don't intend to.  While payday loans are legal in my state there are some restrictions and since I have not been able to get any information I will not respond.

I just received a call from an unavailable #, it was an Xavier Riley who wanted my address and that I had a claim against me and gave me a claim # and the # of 855-553-6352 to call regarding the claim against me and said that I have been WARNED.  I called the # and a lady answered and said it was UCG.  I told her an Xavier called me and I wanted to know who he was.  She said he was a locator in my area and asked if I got the papers. She wouldn't tell me what UCG stood for and wouldn't tell me what the claim was, only that they handle a variety of claims. I told her if they filed a claim against me, then she knows what it's about and again she would only say that they handle a variety of claims. I told her there was no claim against me and they are a scam and don't call me again.

I have been receiving relentless phone calls from them! Two years ago, I was scammed by them or a company like them that told me they were calling from the county sheriff's office with someone otw to arrest me. Mind you I have a lot of sense and I just don't fall for anything but, she said the only way to resolve this is by me paying 1k and at that time I was going thru personal things and didn't want anymore problems so I gave them my CC# which they processed. I was given a confirmation# I was told the debt was satisfied.  Call a frd. told them what happened and they told me I was scammed. (shortening up the story) lol I call the number back and was told that no one called me from that number because it's a out going# only. Thank God I didn't give my bank account # but a Turbo tax (Intuit ) who sucks as well! I was given a number to a so called refund depth that never picked up. Big scam business! Don't get suckered!

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Amen to all the nasty comments about this UCG bunch. They have a Jessica Lawrence making threatening phone calls to several of my family members, some of whom are in another state.....how do they get these phone numbers? The very same thing happened to me just today, that is why I am researching this so called " Law Firm". They were actually harassing my HR department trying to get information on me.
