Debt Collector
I was scammed by these people. I've already paid 1200.00 to them. They are asking for 1700 dol to repay a payday loan from Evergreen. I stopped paying when they lied and said a payment  had been declined from my bank. They tried to intimidate me into paying 350 dollars in late fees plus the debt they claim I owe. They keep reminding me that if I don't pay I will be charged with bank and wire fraud and malicious intent. Danielle is the name of the girl that makes the payment arrangement.  I never received anything in writing from these people. They agreed to send me information via email.

the people with debt collectors can do anything they want no matter what. if you ss is compromised and someone has used your number to take a loan you are responsible for that loan and they will do anything even make a senior have an anxiety attack and they laugh. sure we all want to pay bills that belong to us but they break you down to the point of giving in to save a person and incur more debt from emergency room. you write to dispute and it does not matter. they care none. maybe on judgment day God will look at these people and say Nope Nope Nope..not worthy of being here.

Nothing happened in his "situation". The callers from this number are smoke-blowing frauds. They use tactics that are so old that they smell worse than their feet.
A legitimate debt collector will mail you a notice of validation. Have you received one? I thought not! Tell the caller from this number to do so. As per federal regulation under the FDCPA. He won't? No surprise! He's nothing but a fraudulent and/or bogus debt collector trying to collect on an invalid, time-barred or purely bogus debt.
Be Safe. Be Aware.

This is a scam.  There are no legal papers and you are not going to be served.  They are trying to scare you into giving them money.  Don't do it.

See: https://www.consumer.ftc.gov/articles/0149-debt-collection

They've thrown a lot of legal jargon at you , but it makes no sense at all.  This is a total scam.

Report 'em.  They call again, tell them you've researched the issue and that they are scammers.  Reference this site and the phone number.   They give you any more nonsense tell 'em to go to hell!    In the future don't answer calls you don't

Go to the bank, that handles the CC.  Tell them there was fraud and perhaps they can reverse the transaction.  Do it quicktime!  At least change your credit card number! Never give financial information or CC #s to anyone over the phone.  That's just asking for trouble.

Debt Collector
Cont. from 4/23/14..So today I received a call on my work number from 855-904-9727. It was an automated system stating my file was in their office for fraudulent activity and I should press #8 to speak with a representative. The guy answered the phone with no company name or even his name he said "how may I help you?". I explained that he called me. He found my file and started telling me I owed for a payday loan from December 30, 2012 etc. I explained I spoke with two people yesterday and December 30, 2012 was a Saturday and no deposit was made into my account before or after this date. Then I told him he didn't even identify the name of the company or his name. He said his name was Ike somebody and he was calling with Vanguard Processing. I started to explain he should know the rules of the Fair Debt Collection Act and he started yelling over me saying he didn't want to listen to banter about laws I know nothing about. He said "he was in charge of the call and he was the only one that would determine if my file stayed out of court!" I listened to his crap and then asked for a turn to speak. Once I started speaking he started talking over me again. Then he said I could call the attorney that hired him. I asked for the name of the law firm and he started giving me 1-855 I said no, I needed the name and he hung up on me. WHILE I was on the phone with him, the same number called my personal cell 855-904-9727. I listened to the message and the caller said he was calling from Great Arrow Check Services and was calling about fraudulent activity on me. He left a call back number 855-675-3332. Funny how two people called from the EXACT same number but worked for two different companies. I called them back using a restricted number so they couldn't identify me. A lady answered with "how may I help you?" I asked for their address and she "axed" who she was speaking to. I asked the name of the company and she said Vanguard. I asked if it's also Great Arrow Check Services and she said yes. I asked again for the address and she said she needed my name. I said if it was a legitimate business, she should be able to give out the address and she told me to have a blessed day.

I had the exact same situation as "Worried". "Dan Smith" called from National Express Couriers stating he had sealed court papers for me. The call came from a Restricted number. He left a message for me to call 855-904-9727. I called them two or three times and the phone rang about five times and then it hung up. Last Thursday, 4/15/14, he called again. I explained I called the number etc. I didn't believe he was a process server so I asked him where he was located and he paused and then said the name of the city I live in. I believe he had to look at the file to answer the question. I told him I would try to call the number again and asked him to call me back on Monday to schedule a time to meet (again, not believing he's is a process server in my city). I called "Vanguard Processing" again and the phone would ring once, someone would pick up and not say anything. I could hear a lot of people talking in the background. I called several times and the same thing happened each time. One call I held on for over seven minutes shouting "hello hello" and no one would answer. I never received a call from "Dan Smith" on Monday. He just called today Wednesday and said he went to my house on Monday and I wasn't home. He said "you have the blue door correct?" He must have looked on Google Maps. I asked if he noticed if the house was empty because we moved last year. I also said I asked him to call so we could meet, not for him to come by. Again, I could hear a lot of talking in the background of his call as well. I would think a process server would be out of the office serving papers and not sitting in a crowded office. Maybe I'm wrong. He also told me that by not signing for the papers admits guilt etc. just like he told Maxine. I called Vanguard Processing again and "David" answered the phone. All he said was this is David. He never said the name of the company. He said Evergreen Financial was suing me in civil court for check fraud. I asked when I took out this loan from "Evergreen" and he said December 2012. I asked exactly when and he said "I told you, December 2012." I asked again and he said December 30, 2012. I looked at my bank statement and December 30th was a Saturday. I told him another company had called me a month or so ago claiming I owed for a loan from Evergreen and they gave me a date and deposit amount that I never received. He yelled over me and said I would have to go to court "because I was running my mouth" and he hung up on me. I called back and asked for David and held for nine minutes and he never picked up the phone. I called back and "Danielle" answered the phone I asked her to explain her company. She said they are arbitrators hiring process servers. I asked her how much money I borrowed on 12/30/12. She said she didn't have the information. She only knew I owed over $1,000.00. I told her I was looking online at my bank statement and the only deposits I had between 12/28-1/2/13 was my payroll. She said I would have to explain all of that in court. She never offered a settlement to me I guess because I was doing my due diligence and I also advised Danielle and David that I have never heard of Evergreen Financial and they are not licensed to loan money in the state of Florida. I was also looking at the Florida Office of Financial Regulation's website while I was speaking with them. I tried to search for Vanguard Processing, arbitrators, 800 directory assistance and could never find this company. I also have never received any mail from Evergreen or Vanguard Processing concerning this "debt". All three calls that were answer were never answered with the name of the company, only the representative's name. I guess I will just have to wait and see what happens next.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

+++ATTENTION+++
Anyone who may have the false impression our firm is a "collection agency", you are incorrect.  We have ZERO to do with the collection industry.  A quick Google search shows numerous companies with similar names.  This may be the reason we get so many calls here asking about collection agency related questions.  NO calls are made OUT of our office.  We take ONLY incoming calls.
Please be sure you have the correct info before attaching our name to any of the complaints on this site.

Totally understand, I'm a Sr Citizen too.  Your best bet is a call blocker.  Also, don't pick up on numbers you don't recognize. Don't waste your time trying to contact them.  Don't talk to them; don't give them any information.  Report them.

They are basically kitchen-table debt scammers; little better than white-collar criminals, working out of a house or apartment, usually just a few people.

They are mostly all talk, no action.

You can't stop them from calling, but you can simply avoid picking up on their calls.

>>  They told me that legally they don't have to provide me with that information.  <<

Incorrect.  Legally, they MUST provide you with the information, and it MUST be in writing (not email).

This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

* Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don?t pay your debt
- say they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
- say that legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;

The debt collector may not garnish your wages unless there is a court order to do so.
+ Many Federal benefits (including Social Security Benefits) are exempt from garnishment

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

Report any problems you have with a debt collector to your state Attorney General?s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

They called and sent me a letter today saying that I owed 1500 for a payday loan company called Evergreen that I don't remember getting and they would not give me the information that I asked for.  They told me that legally they don't have to provide me with that information.  It would come to me via processor serving papers and I would have to fight it out in court.  When I pulled my bank statement for the date in question, there were no funds deposited plus when I asked for the account number that they deposited the funds into they only game me the first 6 numbers of the account.  Five of those numbers were right but the sixth number was not.  Red Flag!  They told me that they were sending over the sealed court documents to my county clerks office and that I would be served.  Do I need to worry about this or get legal counsel?

I respect your comments, regarding paying your bills.  I have been receiving phone calls and threats of coming to my home, and my place of business - regarding a court matter.  I AM NOT THE PERSON THEY ARE CALLING ABOUT.  I DO NOT HAVE ANY DELINQUENT ACCOUNTS.  I DO NOT HAVE ANY LEGAL MATTERS  AND I am really concerned with their comments as to what their next step is with the courts.  I am a senior citizen, a proud American, and this definitely is not the American way.  Who ever these people are, they definitely do not have the right information.  If in fact hey are connected with the courts, wouldn't you think they would have the correct information?????   I am not who they are looking for.  After the first call, I did try to contact them.  The phone rang 15 times then I hung up.  I believe if this was a legitimate business concern, someone would answer the phone or at least have a recording machine to take your information.  I personally, should I reach a live human, will not answer any of their questions, I just want them to stop contacting me.

The guy called on: 03/06/14 saying he was I Clark with National Courier Services and that he was coming to my house on: 3/7/14 to serve me because my name and SS number are attached to some alleged file, fraudulent activity. Then he gave me the number 855-233-7310 to call and this long file number.  He said he would be at my house on Friday, 3/7/14 between the hours of 11 am and 4:00 pm and wished me good luck.  Fast forward, here it is: March 7th, 2014, the same man called again and claimed that he stopped by my house and  recited my street address but never gave the City or State or zip code.  So, now he claims I wasn't home but on the message he left the day prior, he was going to come today 3/7/14 but left a message on 3/7/14 saying that he stopped by when no one ever showed up.  It is a scam and these career criminals are getting craftier at what they do to the point that they sound legit.  He even went on to say that a refusal to sign is an admission of guilt and that it will be filed with the court.  This is why I strongly encourage people to stay away from online applications for pay day loans etc. because no matter how much the websites tell you that it is encrypted and totally safe, newsflash, IT IS NOT.  These hijackers and scammers have new and interesting ways to crack codes on computers and access your personal information which is why a lot of these people will call your cell phone and land line.  I just say thank you Jesus.  God knows what debts I owe and what I don't owe and Satan has sent his serpent creatures out there to collect and falsified information.  I never respond nor will I respond because that is stooping to the level of the devil.  However, I do encourage victims like myself to do what I did and that is contact the FTC and the FBI through their website and speak to a live agent.  I was able to do that and explain the situation and even the FBI Agent Rep on the phone said it sounds like I was the victim of a scam.  She even reiterated to refrain from putting any information online because what happens is that the information you put goes out outside the parameters of the United States and it thus it makes it difficult for them to process complaints.  However, when I further researched this information, the number appears to be based in the state of no-good, sinkhole, stand-your-ground-Florida, which to me is already a bad state anyways.   Well, I apologize for the long post but in reading it, I do hope something I said is informative and helps other victims.  Godspeed.

Yeah... what she said.  Any caller that calls and says it's up to you to prove that you don't owe the debt is lying to your face and through their rectum.  The FDCPA says that proof of debt lies with the debtee (is that the right way to say it).

Yes, NCI Nationwide Credit Inc. This may be one of their non disclosure numbers with calls used to prey on family and friends under the disguise of "just doing their jobs." Search for NCI reference "NCI is one of the largest CRM and ARM. agencies in the country. With multiple call centers. and thousands of associates worldwide,. NCI has the strength to" Yes, with multiple "call centers" and "thousands of associates worldwide" they can disguise themselves to harass, abuse, and exploit all being called with non disclosure calls using deceptive and unfair business practices and tactics. It's industry wide, preying on families, children, elderly, vulnerable, and uninformed. Their BS excuses that include wrong name, wrong number, didn't know they were calling family, vendor supplied numbers, using disguises as charity, survey, credit card, mortgage or whatever, calls you are receiving. Denials of how they were NOT told that they were calling wrong numbers, wrong names, or whatever. How you can tell these cowards industry wide that they are calling family members  and stop the harassing, abusive, exploitative calls with absolutely no acknowledgement of anything said. This network is well disguised as shown with few complaints made. http://www.bbb.org/atlanta/business-reviews/c ... atlanta-ga-6231# wonder what relationship they have with Convergys?
