I really have no idea who this is and never owed them money. they seemed to be threating me over a law suit of some kind plus calling at 0700AM was not a good time as I just got home from a trip and was in bed for 1 hour before being woke up. The man was very hard to understand maybe he just got home too. He sounded like under the influnce or something. This was a prerecorded message so he must use it a lot and was not intended just for me.

Returned a call from a Mr. Baggal from Sage Capital stating he represents Crown Asset Management who represents a card from US Bank that has been sold to them for collection and a 10% settlement or its going to suit...said they sent out a letter to x address which is not ours, I simply stated I would like the letter sent to me and gave him correct address at which time he became extremely hostile and would not, kept saying the banking authorities authorized collection etc. debt is x and I needed to make a payment right now or authorities would pursue and suit...all b***s***..they need to send out the letter of offfer and what the debt is, all the numbers he was quoting were in excess of 6,000 dollars of what was originally due and he finally hung up when I stating I needed the letter and verification of where and what the debt was.  Domestic Terrorism in our own back yard by creditor.

Phone Number Report: An Aleged employee from SAGE Capitol Recovery Contacted my Wife at her place of business. He informed her that she Owed a bill that was questionable. My Wife Being scared paid the Bill. However he did not stop their he attempted to make other large Transitions from my account. I immediatly contacted my Banks Fraud Division and had the money Refunded to my account. Additionally I contacted the Police and filed a Credit card Fraud Charge on the individual which is real and they ordered he be charged for credit card fraud. It appears SAGE Capitol Recovery is a front for Illagle activities.and is not a leagalLicensed agency. My advise is to have charges filed on the employee, Officers, and directors if thisA Hole calls you. If convicted he is looking at a minimum of 7 years in Prison.

Steve Kwidkowski just called me, saying that the firm (Sage) has assumed a debt from Pinnacle Bank which, in turn, has taken over the credit card from Chase Bank.

"They have come to me with the instruction to engage legal counsel on their behalf, early next week," which means he is not a lawyer, but rather someone paid by an attorney to call me, do some leg work, and get back to them.

"They are poised to pursue a civil remedy...."  My only thought is, "OK, get in line."

"There is no indication in my (sic) client's transcripts that they have ever offered a settlement..." so they'll reduce the debt by one third.  The sic applies because Pinnacle Bank is not his client, the attorneys representing Pinnacle Bank are.

Here are my thoughts.  This account has been dead for more than 3 years.  We have not filed for bankruptcy because, frankly, we need money to file when our problem is that there is no money.  We know an excellent, and very helpful Adjunct Professor at two very good law schools in the area who specializes in bankruptcy.  He wonders if our best solution might be to wait things out because the statute of limitations is approaching, or past, to file a civil claim.  (See LAMET's comment, above,)

Our only vulnerability appears to be claims that have already been filed against us, and a judgement was rendered.  There is no statute of limitations issue if the party initiates the lawsuit within the time defined by the statute.  Such cases can go on forever, and the claim by the debtor is valid, so long as the case is initiated before the statute of limitations kicks in.  The caveats are that small claims in my state get wiped after seven years because, by statute, District Court civil cases are purged after seven years, but Circuit Court cases last forever.

I have to give the guy some credit.  He is a smooth talker.  Maybe a radio personality, or a guy who does radio commercials.  He can ready copy well.  But if Sage Capital thinks they are getting one penny from me, think again.  You can't get blood from a turnip.

We are going through the same thing, same Rorbert Cohen, he keeps on calling and sending us e-mails but when we respond to his e-mail's they come back as undeliverable!!!
Nothing is in writting on paper with this company!!! They want us to send a settlement check over the phone and just believe that it will be settled.
Very shady!!! We will not send a phone check! I am trying to reach him to let him know that we want written proof that Sage represents Advanta or it's successor.
So far nothing!
Anyone else has dealt with this company??? And? How did it ended?

Robert Cohen called me on 5/15 at 11:01 am stating he is calling on behalf of Advanta Bank. He said he is going to have his council in my state file an involuntary bankruptcy proceeding in the US Bankruptcy court against my entity (which is no longer active). He wants me to address this matter and told me to call him at: 866-757-7243 ext. 508. He called frim 856-773-4724.
Advanta Bank increased my rate to 36% for no reason and without ever informing me in writing 2 years ago. When I asked them why I was transferred to their "law" department. Then their so called lawyer actually yelled at me at the top of his lungs when I asked him why they raised my % and never informed me of this. When he was through with his temper tantrum he hung up on me. This happened numerous times. I also wrote them a letter and never received a response.
Advanta Bank are scam artists and need to be stopped.

Lamet,

A lot of that stuff is out the window because Advanta was a business lender and therefore not subject to the FDCPA.

There is only one tiny sliver of case law (Moore v. Principal) that applies the FDCPA to business debt, and it's roundly criticized and not followed.

Sage collecting for Advanta.

Don't believe anything they say.

Cardworks is servicing the former Advanta portfolio, which last I checked was in the hands of Deutsche Bank trust (or trusts) which financed advanta's portfolio in the first place (in other words, in the BK the assets simply went to the idiot they were pledged to, who was at least smart enough to make sure they were securitized in said idiot's favor).

Cardworks rotates the debt out to Phillips & Cohen, Sage (and perhaps still Sentry) for collections calls.

A tiny, tiny fraction of debtors may get sued ... these would be folks who have few if any other debt and who are foolishly obvious about their financial recovery in one way or another.

I experienced a person with the last name of Bagell calling my cell phone from the 866-757-7243 ext. 503 today and he left a detailed explanation that Mr. or Mrs. ****** or whomever is listening to this message, needs to make sure that they gets this information becuase a liability claim close to (specific amount) is about to be processed against them and I [Bagell] thought they should know about it. They need to return my call at 866-757-7243 ext. 503.

(1) the debt he is reffering to is a business debt from a business that is no longer in business.
(2) I explained this to the original debtors (Advanta) and have even tried to make payemnt arrangements with them, the first creditors they turned it over to and they were not happy with the amount I was able to pay every month. I have a family to feed and a roof (not fancy roof either) to keep over their heads. Although my husband works, he doesn't make enough to support us. I offered up 25% of my monthly bring home pay (about $150.00) a month and was laughed at. I can only give what I can. I understand the debt is mine to pay back. Hindsight is always 20/20 and as time progresses, and income increases, I will revisit the debt and pay it back.
(3) The debt was obtained for business purposes and although I am the guarantor on the debt, I don't believe they can process a liability claim on both me and my husband...can they?

They have called me twice now. Sent me a bill. What I saw was I owed the original creditor 9 g they are charging me 16 g. They also went under the name of MRS & Associates. Reported to NJ BBB then filed a report with the ftc/gov. They cannot charge you additional interest which is what they did. They have threatened to sue me not once but twice now. Blocked there number so they call from another one. Had one screaming me me tell me what a low life piece of crap I was for not paying her. Been out of work for over two years. Went back to school to learn a trade. In the process of doing just that. They want to know what I live on, told them financial aide. They told me to give them that money. I told them if I did that I would not have a roof over my head. They then said, well live outside just pay us. I gave them my attorney's phone number they refused to take it. First one must have the money to do a bk, of which I do not have. They have even left a message on my answering machine saying they were going to sue me. What I do not understand, is I sent a cease and desist letter to the original creditor; isn't that illegal to call when there is a letter on file? According to the ftc and the bbb they said they cannot charge all this interest and they are doing just that. All I know is, I report and complain.

Told this guy last week I'm not allowed to receive calls at work.  He kept talking and I hung up.  He called again a couple of days later (today at 1:07) and I told him again I could not accept calls at work and hung up.  He called again at 1:08!!!!  I picked up and hung up...  I do believe that that is a FDCPA Violation that is illegal according to [15 USC 1692c] section 805(a)(3).  Anyone know where I can file a complaint?
