I received a phone call saying I was being charged with check fraud and not paying a loan company I never borrowed from. When I called the company they said was charging me they knew immediately who was calling. Why cant they be stopped? My info has been taken and now I wont stop getting calls from people who.have somehow got my info.

I recieved a call also from officer Daniel Richards claiming I had a payday in November 2013. I never got a loan last year. He claim that there was chargers file against. I called him on it. He told me  ok call the courthouse to get my chargers dismissed the number was 202-241-5147 a DC number

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Threaten Arrest or Lawsuit

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I just got a call from that number 813-774-5528 it was a recording message telling me that I have a pending case that might include a restraining order against me to contact my lawyer , I got very very scared that never happen to me bfore I try to call back and just say that the mailbox is full I don't know what to do , I check on line all the public record, court and so on and I didn't find anything with my name on it . please any advice

I have responded once before and paid money and never heard another thing, but after receiving MULTIPLE phone calls stating basically the same story, I ignored them... and nothing ever happens. GOt nothing in the mail or anything... just more phone calls from other ppl and other numbers... ANNOYING.

I recieved a call from an Emergency 9-1-1 on my cell stating that i needed to contact this Officer Daniel Richards at 904-436-9001 right away due to complaints being charged against me. I called this person and he stated that i applied for a payday loan and it was delinquent and i was now going to have to pay $2,182.54 to keep warrants being issued on my behalf. He had my ss# and other information, made me promise to pay $600 on this Friday and then every two weeks thereafter until payment was in full. I called my bank and had my card blocked, called the payday loan office that i went thru and was told that i am not the first person who has been reporting this. My account is not delinquent and I also called local authorities and filed a complaint with the FBI. Officers will never accept a payment in any fashion, you would have to make a payment to your county clerk.

I had applied for a payday loan online.  Shortly after that I started getting calls from people claiming to represent the law firm that filed suit againt me.  They told me I was on a recorded line and was being charged with financial crimes for receiving a $500 payday loan that was not repaid due to NSF.  I never had a loan with CASH NET USA.  I was told that the suit was seeking to recover over $5000.  They could tell me the date of the alledged deposit of funds.  I'm going to report them.

I just inquired about a payday loan and never got it.  They are harrassing me too but they cant do anything to you.  They are hoping for 1 out of the hundred to pay.  You have been scammed.  I have all their numbers blocked and hopefully they will eventually go away.  That really sucks for you

I am a law enforcement officer, and these are indeed scams as is this post claiming Officer Daniels saved someone from getting into big trouble. We have reports of these kinds of scams daily. Do not give them any information and contact your local police with any information you get from these callers.

i also got a call from this number same mode like always saying you have allegations on your ss# they usually give the last 4 numbers just to get you to comfirmed that this is you/ and they always end with god bless you and good luck always a  person with a very heavy accent giving you an american name like mr. griffin/ and if not get your attorney to call them if not you will be arrested at your address.
please this is urgent. and then they keep calling and harrassing you at work/ i had to change my cell number due to this/what can we do with people like this. these are very rude people, they donot know a lawsuit it does not exit another is any public records will be reported to the credit bureau right away. if they cannot get in touch and usually by the person who press charges, as per an attorney i spoke to.how to speak to people./ also if you are not given any papers from an attorney or lawyer you not serve  with any lawsuit, be ware of these scam artists.

1.    The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

I just recieved a similar voicemail from Morgan & Associates stating I or my attorney needed to call back immediately.  If I didn't the caller said he wished me luck surrounding what was going to happen around me.  So I called 760-582-0303 and asked for David kennedy.  He was not in and (both him and the person who answered the phone had a thick Indian accent).  He stated there was 3 criminal counts against me from last yr where I supposedly got a loan of $350 deposited into my account and when they tried to get payment on the loan they couldn't.  I never applied for any loan on line! Now the lawsuit is for $2584.87 and I was been charged with criminal charges. They actually called a friend of mine and said he was a reference and he was being held accountable in the law suit too.  I asked the very rude gentleman questions after he told me the 3 charges against me.  He couldn't give me the date I got the loan or when it tried to be backed out of my account.  He wouldn't tell me how he got my friends cell number.  I told him I was going to research it with my bank and my lawyer and I would get back to him.  He then hung up on me.

If anyone calls you and says they have a lawsuit against you, tell them to file papers through the courthouse in your local county and you will take care of it from there. A lawsuit has to be filed in court. Even if they truly were filing suit, just sending them money would not settle it under the law, it has to go through the court system. They cannot hold your employer responsible for your debt. If they have a legitimate debt, the most they can do is garnish your wages. No law firm is going to call you and say they have filed a "criminal lawsuit." If someone has a criminal complaint against you, you will find out from the police when they come to arrest you, or possibly from your own lawyer.

Do not give them money. Do not confirm or deny your social security number to them. Insist that if they have a lawsuit to file, they file it in your county and you'll accept service of the papers, and the suit will proceed from there. That is the only way a lawsuit can be legitimately filed.

They called me to day. I talked to "Mike Johnson" who had  a very thick Hindi accent and all he would do was repeat that there was a lawsuit filed against me. I kept telling him to file the lawsuit in my home county and I would accept service but I would not discuss it over the phone, especially since he would not tell me who the plaintiff was. He did, scarily, have my correct social security number, but I said I would neither confirm nor deny that. He screamed that criminal charges would be filed then hung up when he couldn't get any more information from me.

The phone numbers I found on this company who goes under 2 different law firm names, Cooper Law firm as Well as Morgan and associates the phone numbers that I have for them only one of which they provided me with the other I found researching them and the same idiot Dominic answers I think he was a bit suprised when I called him on his other number. Now neither number works the ring busy. I have contacted the FBI. Secret Service and filed a claim with my local police department, federal trade commision as well as my states Attorney General. These Idiots need to stop and not get any more of our hard earned money. If anyone has any more information about these extortionists let me know I can let the people who are handleing my investigation know.

I received the same phone call from Morgan associates and Dominque saying I had a lawsuit against me for 5,000 dollars and I was been charged with criminal charges. They also said they were going to call my employeer. I got very scared and sent them $350 to settle my case. I'm thinking now it's a scam. What happened to the people that reeived the call and never send money? If anyone can resond, please. I'm afraid I will keep receiving calls from different companies.

I have received 2 calls from someone named "Officer Daniel Richards" from a Morgan & Associates at my employment.  My receptionist reported to me  he even went so far as to tell her they were filing a criminal lawsuit against my social security number (is that legal?) and they wanted to speak to my supervisor, and also told the receptionist that since I gave whoever they represent (which they would not say) my employer's name as job reference they would hold them responsible for any debt I owe.  Is that crap your what...first of all they gave her personal information regarding me, which I feel is illegal because of privacy laws.  I believe this person has called me before with another name, cause his speel was the very same words as before, i saved the message from this person from a couple months ago and it is the very same person.

I just got a call yesterday also saying the same thing. I go very nervous and almost did it to avoid any charges I used a payday advance company a while ago but thought I had it taken care of.  I have done some research and can find nothing on them. The address Dominic from the company gave me is 1365 Chula Vista Drive San Diego CA 91903. First of all there is no Chula vista drive in San Diego and the zip code is for Alpine CA that is not even in the same county. This is fishy. Be very careful with this. I am going to do some more investigations on this and will post more as I find out.

Call shows up on cell as unknown. Same people I have been receiving the scam phone calls that have to do with payday loans. Foreigners want you or your retained lawyer to call back. Wish you good luck as to whatever unfolds. Same crap, different name and number. Now they are saying they are from lawfirm of Morgan & associates. Called my work and told them not to call here last time they called, didn't work
