Really I was told they can legally keep buying old debts every 7 years that's why they keep putting crap from the 80's and 90's on my credit reports because they own the rights to collect. If this is not true how do I get the crap off my reports because I wrote to the 3 reporting agencies and was told since they purchased it it is allowed no matter how old.

Also where do I get a copy of a great Desist letter and where can I find a copy of a intent to sue with correct verbiage? I need help my 2 debts they are stalking me about were from the 90's yet they still come after me and put them on my credit report.

I got a loan through AMERICAN GENERAL, and was keeping up my payments so well, AMERICAN GENERAL offered me a Sears credit card with a $1,500 limit. This took place in 1993. Even though I was the top-rated announcer in my city, I'm one of those "always be prepared for a 'rainy day' or unforeseen disaster"-- type folk, so every single time I made a payment to AMERICAN GENERAL, I paid the extra few dollars that insured my account would be paid in full, should anything (such as illness or injury) prevent me from working and paying back the full amount, AMERICAN GENERAL would pay it back. Nine months later, I was diagnosed with cancer, and after my surgery, I was involved in a mass-firing (oops, I mean 'downsizing').

Suddenly, AMERICAN GENERAL forgot all those extra "insurance" payments I made. They pestered me for years, claiming I owed them, and I responded that I would happily meet them in court -- along with all my receipts I'd saved. To top it all off, when I told them I was considered "terminally ill," the calls tripled in bulk!

When I asked for a copy of my rights in re: the "insurance," they refused to provide a copy, stating: "Your lawyer may come to our office to view these papers, but we won't send either of you a copy."

That's when I started getting the calls about the Sears card, in which every collector lied and said it was separate from AMERICAN GENERAL. (I didn't even use the card, my ex did, against my wishes.) Every time I pointed out that AMERICAN GENERAL. and not Sears, was responsible for offering -- and then issuing -- the Sears credit card to me, they straight-up lied and said it was a separate deal from my AMERICAN GENERAL loan, I told them that I knew they could see that American General, not Sears, offered me the card due to my "exemplary" habit of paying bills in full, on time, and always with the added 'insurance/protection' fee each and every time I paid.

By 2006 I was deemed "in remission" (even though I still had other life-threatening conditions), but also close to winning my disability hearing (which I did win a year later, stating in plain English that I'm unable to work any job). At this point, PORTFOLIO RECOVERY had been calling me for years, and some were pretty nasty about it. On more than one occasion, after getting ten+ calls on one day alone, I responded by saying, "Gee, I sure am sorry I went into remission and didn't die to satisfy you people."

Sometimes they called over 10 times a day, daily, until one day I put my foot down and said, 'If I miss any more of my doctor's or hospital calls due to your frequent day-long   phone harassment days, I vow before God to sue your company for "intentional infliction of emotional distress" AND harassment, which will show up easily on my phone bills, and then we'll see who walks out of that courtroom with a generous amount of award money, not counting the payment of all those court & lawyer fees as well. Is that how you prefer we do this?'

Immediately the number of calls -- and number of days in the week -- fell very sharply.

There was no sense of victory though; rather, I was sickened that I was forced to issue a threat just to be treated with any decency whatsoever.

Next they tried conning me by offering to settle the debt for a lower amount. First it was a thousand, then $800, and eventually said they would settle for $400. Few ever asked if I could pay anything -- yet several said things like "I KNOW you can pay this bill right now."

Where do such ppl come from, and how do they sleep at night, after badgering dying people?

Each time I answered that by AMERICAN GENERAL'S rules, I owed them nothing, Their only response is that they intend to keep calling (and threatening to turn it over to a lawyer). My reply is this: "You should be calling American General to collect this debt; and you know that by law, you cannot take nor garnish nor freeze my disability payments."

They simply answer that they intend to keep calling me, in a tone which is frequently, unmistakably threatening.

I'm in GA; why is Portfolio still pursuing me for this debt after 11 years, if 7 is the maximum? Thanks for any advice.

At least my threat about suing them for keeping my telephone so tied up I missed so many medical-related calls *did* seem to help; they do call far less often now, so don't fall for their lies when they claim they can't control how many calls you get daily. Otherwise they'd be calling the same amount as they used to.

Had a call at 815am this morning. Didn't leave a message and I didn't call it back. Next time if I'm awake I will answer it I GOT questions I want answered . Like to know How or why they have my number. I will take legal action. I'm not playing.

It has been 10 years and they are still calling me.  It is all removed off my credit report and I just purchased a house!  But, always ask them to ID themselves first and never confirm that it is you on the phone.  I told them this number is no longer this man's and she started to ask me questions.  I said thank you so much and hung up.  
We are SOOO protected by consumer laws that these people can not harass us-  It is illegal for them to do that-  A few links that can help-  Stay strong and it will be fine!!

That Portfolio outfit calls with a lot of different numbers. Not all of them will show the company name on the caller ID. Most if not all will have the 858 area code.

A debt will fall off your credit report 7 years after the charge off date. If it is sold it does not start the time over again. If that happens and they post it on your report send them proof of the charge off date and demand they remove. If they do not they are liable.

Actually a company will weigh the amount of money owed versus the amount of the filing fee. In California the filing fee is a little over $1,000.00 so I would not file on a debt of 600.00. that is a 400.00 loss for me. If you owe over that amount I just may file.

Each state does have and SOL. I stated in the industry collecting out of stat debt and I was very good at it. People need to keep in mind that the FDCPA really only governs third party collections. Most collection companies follow it any way, but they are not held to the same accountability as a third party collector. that does not mean they can get away fully with threats, disrespect.

The number one thing to remember is that when you get a collection call verify the minimal amount of information. A lot of companies just want to gather as much info as they can to track you and complete the profile. NEVER admit to a debt unless you plan on paying. ALWAYS, ALWAYS, ALWAYS demand documentation of the debt. Know and understand your state laws on debt and judgments. Understand the difference between collectable and non-collectable debt. Identify if the collections company your speaking with is the in house collection for the original debt holder, third party collections company or secondary owner of the debt. the secondary owner has the same rights as the primary. The third party is governed fully by the FDCPA.
So this is coming from a person that has worked all sorts of collections and has two diamond rings and an oyster rolex (from the company) for collecting $3,000,000.00 over two and a half years in out of stat paper - legally & respectfully. I now work for a private company suing  collection companies for illegal and grey collection practices.

a. learn to speel
b. learn some punctuation (english preferred)

d. dig around in your sock drawer and find what little compassion and kindness that you were born with.

And you are a "bill collector"...I sure hope you have spell check on your email at work and what not, cause if not you will look as dumb as these idiots that call me from 50 different numbers. I never answer, I never get anything in the mail..and there is nothing on my credit report..so I will never pay a debt that i may or may not have. And there is nothing they can do about it...Go ahead and sue me....they will lose...and then they will even have to stop calling or I sue them and I win...Sucks to be them, but in these days of TARP funds and bail outs to big companies no one bailed me out when i needed help so i just consider what i owed many years ago as payment to the working man....ha ha ha....

Hey Jimmy  . . . take an enormous dump or go have sex or something, OK?  People who are trying to survive in this snake pit country on minimum wage don't need a terse lecture from you. Bankers stole billions and got away with it without getting as much as a parking ticket.  Some people might be jerks, but most are juggling their meager finances to make it in a society that dangles goodies in front of everyone's nose and tells them they're losers if they lack the latest trendy gimmicks.  Of course, people might have the money to pay their bills if the fat cats hadn't shipped everyone's job off to India.  But hey, no billionaire left behind, right?

And incidentally, if you'd ever taken even a glancing look at the practices of credit card companies, you'd know they are worse than the Devil.  I think you must have watched too much "Captain America" as a child.

Not true they will do the filing I work a Judgment file. The debtor has already been to court and has already been sued (court order signed by a judge) so don't think that a "debt collector" is lying to you when they say that they (the collection agency/attorney) will be taking you to court for your wadges/lein or freezing your assets.

the SOL (from last pay date not open date) is good for so many years (varies per state) if the creditor places a judgement against you  before the SOL runs out it give the creditor an additional time to collect on it from 4-30yrs (depends on state)    THIS INFO COMES FROM A BILL COLLECTOR not a DEBTOR/CONSUMER

This is the 9th new phone number for these people in the last two weeks.  Never agree to pay them anything.  If you are outside the Statue of Limitations (SoL) all they can do is threaten you.  If you pay them even .01 they reactivate the claim.  If you reach an agreement with them for a partial payment to pay off the claim, they will renege and sell the remainder of the loan to another company, and it starts all over again.

If you want to take them on, demand documents which show the actual bill from the original company.  Never give your credit card, ATM, or bank account number out over the phone, and let them know that they can't have them.  Do not give them your Social Security number.  Make them provide the documentation; they have to prove you owe money.  You don't have to prove you don't owe it.

And finally, check out the SoL in your state.  There are many sites with good advice from attorneys who deal with credit problems.  They will tell you exactly what your liabilities are, if any.  All credit cares and loans (except mortgages) are open ended and subject to the SoL for your state.  

For more information, type Statute of Limitations (your state) in Google and that will lead you to a lot of interesting sites.

got a call at 8:30am. guess these losers must not know the florida laws. no calls before 9am or after 9pm. still i dont care... I don't answer and it goes to voicemail. HA-HA!

BTW... florida law says 4 years SoL, after 7 years (since last payment) it's off the credit history.
And if they do decide to sue me... that's when I'll file for bankruptcy. Afterall what do I have to lose?? they already lowered my credit score as low as it can go.

Yep, a new wave of numbers for them. It seems to have started this year.  My phone carrier has a service which allows you to block 30 numbers at a time.  Portfolio numbers comprise all but one.   Time to clean out the old ones and in with new.  If I had the time, I would seek some kind of industrial sabotage on this company.

i got a call from the number-858-346-1184 and when i called it back it said it was not in service and that it was not a debt collector phone number, but it said it was some phone sex hotline info they gave me but i called back the same number and it was working. strange i know and maybe some may not believe what i wrote but it was true. but that does not matter at all. all you with immature comments about these people grow up. look you may hate it and you may not want they bothering you but listen to me i like all you other people on the site at one time did not pay your bills so whatever you say on here it you complaining about bills you decided to not pay for whatever reason.
They would not harrass you if you Paid your bills like you were meant to do. credit card companys are trusting and other loans are trusting people pay it back. now you people sit on here and complain that they wont leave you alone its stupid. i understand i did not pay my bills and for 7 years you can not get a loan again. i dont think its fun when you get declined for trying to get a loan when you could of done some thing about it in the first place. pay your bills. by the way if any one wonders i am not part of portfolio recovery or any other debt service im just a man that has an opnion and hates that they call but understand that as an adult i have to pay my bills if i dont i get in trouble. good luck

Another new number.  How many times should a company be allowed to call your number if they decline to leave a message.  If they had legitmate business shouldn't they conduct themselves in a professional manner instead of behaving like a telemarketer??  I receive mail 6 days a week so that method of contact is available if they think they have a legitimate reason to contact me.  I purchased my house at forclosure several years ago and have gotten calls for the previous owner from other agencies.  I have no idea why they are calling but based on the advise posted here I'm not going to answer their calls.  Where is the FTC on this.....Maybe asleep like the air traffic controllers!
