A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. I received a call from this rude threatening guy who said he was from ABC Recovery.  I told him to send me something in writing and he started yelling and threatening.  Are these people for real!!!!!????  Was rude and was yelling when I hung up on him!  Jerk!

I have been receiving many phone calls from this number with no messages left. Finally I answered it and it was a collection company looking for someone else. The man was very friendly and once I told him my name and that I was not who he was looking for he was very apologetic and said he would take my number out of their system and the calls would stop.

Got a call from someone who said they were from ACB Recovery, yet the caller ID on our phone indicated Plaza Recovery.  Wonder if Serenity knew for sure who she was calling for.  

Had a similar instance with another company...about 8 calls in a 2 week period....The person they were looking for called them back...said he/she owed something on a MasterCard.  He/she told the 'collection company' that they had not had MasterCard in 2 years.  Then asked who the card was through (which company or business)...the collection person wasn't able to find that information.  He/she asked for the collection company to mail the details to her, giving his/her current mailing address.  This was almost 4 weeks ago.  Finally this person's mother called them back to find out what they didn't understand and they said they would remove the phone # and the calls have quit.

I'm wondering if the ACB, Plaza, or whoever will be able to produce some details this time ;)

Had a ruff patch with medical stuff ... 4 hospitalizations in a short period and even with insurance I got behind. Doesn't make me a deadbeat or a turd but saying it sure makes you look stupid.

Looks like this company is going by several different names.....so far I have heard, ACB, ACD, ACE, and ABC.....makes me wonder if they are following the Fair Debt Collection Act in their collections.  I hope that the different company names is due to people not hearing the caller correctly and not the company feeling it has to use several names in  order to collect debts.

Oh yeah.  I do think the call was legit and there is no problem with you giving the last 4 digits of your SS#.  But in the future, it probably wouldn't be wise to do.

Never give even a portion of your SS# over the phone (or in person unless you feel it is legit...job app, credit card app, etc).  Ask the person calling for a call back number and company address.  If they are legit, they will provide it for you.  Then you can google the number and company to see if they are legit.  If YOU know that you do not owe a debt, you have nothing to worry about.  He cannot sue you, turn you over to an attorney,etc.  Tell him you do not owe the debt and that you do not want him contacting you.

I work in collections.  Collectors are only allowed to contact family members or relatives ONE TIME in order to locate someone.  They cannot continue to contact you concerning your brother-in-laws ex-wife.  Next time they contact you tell them: 1) You have no idea where she is and don't really care; 2) They are breaking the law by repeatedly contacting you and you will report them to the Attorney general in your state and theirs (and follow through); 3) Tell them that you do not want them calling you again and ask for an address where you can send that in writing (and follow through).  A legitimate company will give you an address and stop calling even before you send the letter.  You have a hard copy of evidence that you requested the calls to cease if they continue.

Also, if they are telling you WHY they are calling (that she owes money) they are breaking the law!  They must identify themselves each time (This is Margaret Hawthorne) but need not identify the company unless you ask, then they must tell you the name of the company.  They CANNOT tell you the person they are calling about owes money (unless the person has authorized in writing that they can disclose this information to you).  They cannot call before 8 AM or after 9 PM (your time zone).  They cannot use profane language, make threats (I'll beat you up, etc) or threaten to turn an account over to an attorney, if they do not intend to do so immediatly.  They cannot threaten YOU with any action since you are not the debtor.

While talking to a 3rd party, the collector must identify himself and tell you that he is confirming or correction location in formation concerning the person.  He must identify his company if requested.  He cannot tell the third party the person owes a debt.  The collector CANNOT contact a 3rd party more than ONCE, unless the collector has reasonable beliefs that you gave false information.  It is a good idea to ask the person to identify the company they are with and keep track to see if they call again.  If they do, they are breaking the law.  Legally, as a third party, YOU do not have to tell them to stop calling.  After one call, they must.  But it doesn't hurt to tell them to stop.  Just one more thing on your side if you do need to contact the Attorney General of your state.

For anyone that owes a debt or anyone that receives calls about the debt of someone else, it is best to google FAIR DEBT COLLECTION ACT.  You can find it online and it goes into detail what a collector can and cannot do.  It also lets you know civil liability if someone breaks the law while trying to collect a debt.  It will really throw a collector if yoou start quotiing the FDCA to them and penalties for breaking the law.

Sorry so long winded but there are some real jerks in this business and they make it bad for the rest of us!  I understand that with this economy several good people that pay their debts have troubles and I am always willing to work with someone in order to get them back in good standing.  I won't work for a company that will not allow some  leeway.  There are deadbeats and there are those that would pay if they could.  I try to work out plans with those that would pay but are bad off financially.

I also got this call from a Bob Hudson from ACB.  Very limited information in the message.  When I returned the call Bob advised me it was in regards to my Macy's account.  I politely advised him I was in the midst of preparing a bankpruptcy case due to losing my job 10 months ago.  Bob asked me for my attorneys name and number and said he would note the file.  Now, as far as debt collectors go, this guy was about as polite and courteous as they come.  Very nice, not pushy and at no time did he ask me for complete personal info with exception of verifying the last 4 numbers on my account.  I would much rather deal with him, than the non-english speaking a-holes from Macy's!

wow! you guys are really that stupid to think that ANYONE can do ANYTHING with only the last 4 digits of a SSN if that were the case why would they even need to call???
they could just sit back and randomly put 4 numbers together all day long...duh
Also, on a side note if by chance they are calling a wrong # don't get mad at the company for a few reasons 1. the person they are calling for has given that # to them at one point in time (could be old # or could be a made up # that they gave to dodge a debt)the company DOES NOT make up a random telephone # to call and search for people come on be serious!
2. if you are rude and defensive it can cause the caller to get defensive and may give the impression that you are either that person they are looking for or you are helping that person dodge a legitimate debt they owe and 3. if you ask POLITELY to remove your # and POLITELY explain that you do not know the person they are looking for there is a REALLY GOOD chance your # will be removed also there is most likely more than one company looking for the person they are calling about so to be sure that the companies are removing youR # and you are seriously worried about repeat calls KEEP A LOG ask for the company name, representative's name, their phone # along with the representative's ext and note the date and time of the call that way if they do call more than once you know that it's the same company and PLEASE IF you call back to have a number removed DO NOT say "you called my number you should know what it is remove it" then hang up GUESS WHAT your number WILL NOT be removed due to the large volume of calls that a collection agency makes on a daily basis it would be IMPOSSIBLE for them to 'know' your number just by you calling in and leaving that general message and you will get called again
i understand it is frustrating to continually get calls that are not for you but, please act like you have SOME common sense and some manners debt collectors are just people and they are not psychic by any means they are acting on information provided by the debtor they are looking for.

JUST SO YOU KNOW IF YOU ARE THE PERSON THAT THEY ARE LOOKING FOR DON'T BE SO QUICK TO HANG UP ON THEM.  A LOT OF THE TIME THEY CAN OFFER REALLY GOOD DEALS ON KNOCKING SOME OF YOUR INTEREST AND PENALTIES OFF YOUR ACCOUNT AND CAN SAVE YOU HUNDREDS OF DOLLARS AND IN SOME CASES THEY CAN EVEN HAVE CERTAIN LINES OF CREDIT RE-ISSUED. WHEN THEY CALL THE LEAST YOU CAN DO IS HEAR ALL THE OPTIONS AVAILABLE AND TRY TO GET THE PROBLEM SOLVED.  BE AN ADULT AND HANDLE YOUR BUSINESS!

It wasn't a scam, Mr. Brown had to make sure he had the right person before giving out personal info. When you gave your last 4 digits of your ss# and it didn't match he knew the account didn't belong to you. No body can do anything with just the last 4 digits of your ss#.

MR BROWN CALLED ME FROM THIS NUMBER LEFT A FIRM MESSAGE ON MY CELL WITH A CONTROL NUMBER.HE ASKED FOR ME TO RETURN HIS CALL TO MR BROWN I KNOW I WAS STUPID TO CAL BACK. HOWEVER I DID AND ENTERED HIS EXT NUMBER. HE SAID FOR PRVACY PURPOSE HE NEEDED MY LAST 4 DIGITS OF MY SOCIAL SECURITY NUMBER.I GAVE IT TO HIM BEFORE I GAVE IT MUCH THOUGHT HE SAID I WAS THE WRONG PERSON AND APPOLIGIZED FOR THE MISTAKE. I THOUGHT ABOUT IT FOR A WHILE THEN GOT WORRIED I CALLED HIM BACK BUT ONLY GOT A MESSAGE. I LEFT HIM MY NUMBER TO RETURN MY CALL AND ABOUT 2 HOURS LATER HE DID. I answered and the caller asked for my ex husband.  My ex husband from 25 years ago.  I am remarried have different last name and different state.  The caller said her name was Heather Johnson.  The caller ID showed Kentucy call on the screen.  I told the rude woman that I never heard of the person and not to call again.  She slammed down the phone!

WOW...some REAL winners here trying to collect a small debt that i do owe but have not the means to pay now. I've never talked to such a#$-holes that do not listen and keep trying to get me to refianance my home where the closing cost alone would be 300% more than the $400.00 debt i owe !! WOW... if you get a call from these folks... just act stupid and hang up... that is if you answer their call !!!
