NO    its not always the case in a  lot of instances you use old records or old phone numbers , lots of documented cases of that,    and you still will not stop calling so, get over yourself.  And stop pretending to care about ownership of something.  Calling a person to get ahold of someone else is not responsible at all.  Especially if they have told you that person doesnt exist at that number.   And some people have hard times and after several years of interest I am sure they had paid for thier purchase and a lot more........maybe banks and lenders should be more responsible, and not overcharge or enter in an agreement with people that cant clearly repay it ever.  Or they should maybe give you a break once in awhile if undo hardship is the problem.  Gee sorry my dad feel off roof while working and he cant repay for the tv he bought 4 years ago still,  but I do like to have cereal in the morning before school....things like that,  they happen buddy, so once again I say get over yourself.

I keep getting annoying phone calls asking me to call back.  They say there is an important matter in their office for me to discuss.  They do not identify themselves nor do they give me any idea what the matter is.
I did respond and pressed the #1 to speak to a representative once, and was put on hold, with annoying music playing in my ear. What do these scammers want? It must be some form of identity theft or bank account information scam.

this is a company that looks for you over 10 years later, to collect debts made in the past... mine had to do with a debt made by an ex boyfriend, credit card with an ex boyfriend. a debt of $163.00 accrued since 1999... and they were looking to resolve it... then they day he works for the current company i own? lmao !!!

For years now I have been receiving calls from this number.  They do not use my correct name.  They request me to call back and use a file number.  This I have never done.  I received a call almost every day and on week-ends as well.  The time varies from 7:30 a.m. till 9:40 p.m.  Is there no way to stop this?  I am tired of running to the phone only to see this number come up on the display.  I will never answer it and never call back and yet they keep on calling.

It seems that person who wrote the note has been leaving on the moon.
The United States, all 50 of them are bankcrupted and cannot pay their debts.  The cities, counties and boroughs are not able to pay their debts. The banks are the one in charge of the economy so they are the ones that screwed up and they are the ones that got bailed out.  Whether or not any businesses should have gotten bailed out is a different story so to answer the question about responsibility, dont ask anyone to pay their debt when they have been unemployed years due to greety bankers & real estate brokers who wanted to pocket their bonus and hide it in the cayman islands & switzerland. As you are working for collection agency, that means you are not a banker and could not find a better job.

You and I both know its a scam. I have been getting an electronic message left on my phone twice a week for 10 years. Initially I called to tell them that I didn't anyone anything. The calls continued. Its an attempt to bully and intimidate people into paying them money. They told me the debt was $200. Give me a break. Last time I looked, a creditor has 2 years to claim against a debtor. Why didn't they sue? - because there is no debt.

statute of limitations in Canada (Ontario) came into force on Jan 1,2004. It sets 2yrs as the term. This limitation will be reinstated where the debtors acknowledges the debt or makes a partial payment towards the debt. If the default occured prior to Jan 1,2004 the creditor will continue to have 6yrs to pursue the claim. However, if the default occured after Jan 1,2004 then the 2yr rule applies. Collection companies buy old claims that the original creditor closed. I went to clear my credit with a bankrupstsy lawyer and he said that by law they could not collect on any of the claims against me (which was due to loss of job and ex who took me to the cleaners) Check out  bankruptcycanada.com  for more information

The individuals at this number have been calling and threatening my two sisters, who are both in their 80s, indicating that they owe money.  Despite the fact that this is not true and they are aware of it, it is extremely upsetting to them.  These people should be prosecuted for their actions.

This number has called our house numerous times, ironically always when no-one is home, and have left vaguely threatening messages asking that a "James Conway" call back, quoting a reference number. Initially, we called back, left message on their voicemal quoting reference number, advised wrong number. However, we have also now decided that this is a scam so just ignore it. Police once advised us years ago to blow a loud whistle into the phone when a harrassing/unwanted caller calls repeatedly - haven't tried it yet with an automated system, which I think this is, but might be worth it!! Sure worked with live callers years ago!

I am sorry Sam,  you don't seem to realize that the company doesn't seem to employ people.  I have never had a person call me or identify themselves.  Just an automated system with an automated voice.  No company name either.  If that is how Activ Kaptial Aquistions wants to do business, then thats okay.  I will just have my automated system hang up.   Ohh, and if Activ Kapital could learn to spell the words active or capital, it would help me take them seriously.  They also may wish to consult the legislation with regards to statute barred debt.

I tried talking with a Collection Agency knowing Federal Laws.  I spoke to 3 people.  I'm sure they were using me for training for their people.

But I was even upset after their call for 2 hours.  Even though I have posted my comments, I'm putting it here also:  GOOD LUCK TO YOU!!!

Debt Collectors – Collection agency’s do NOT fall under Do NOT Call registry, as they are not telemarketers.  However, they do constantly violate other Federal Laws, because us American's don't know the laws to protect us.  They are counting on that.  

- Federal Law says you don't have an obligation to Collection Agencies or Debt Collectors; you can send them a written letter and they cannot contact you after that.   This includes Attorney's in state's other than your state of residence.  The only Attorney's that can sue you, have to be licensed in your resident state.

A word of caution:  Some Law Firms do have Firms in other states, and Lawyers licensed in other states, so you have to do a little research before sending a Cease & Desist (Do Not Call & Go Away letter) to make sure they aren't in your resident state or you're likely to get sued by these #%#&*@!#%&@$^*.  

Once a debt collector makes contact with you, they also have to contact you within 5 days after the first phone call, letter etc., and give you validation/proof or judgment of the debt.  You are not required to ask for it.   They never do this!!!!

This law is known as the Fair Debt Collector Practices Act.  You can get it at FTC.gov; as well as other Consumer Protection Laws.

Most collection agencies, purchase your delinquent debt for pennies on the dollar.  Guess what? It is no longer your debt!!!  You don't have any agreement/contract with the debt collector or collection agency.  Your only agreement/contract was with the original creditor.

Do NOT agree to any payment arrangements, or you'll be creating an agreement/contract, where upon initial contact by the Debt Collector, one didn't exist.  The collection agencies are counting on you not knowing this little bit of information.  

The best advice I can give you is, do NOT talk to these idiots - they will leave you in a frustrated heap on the floor.  They lie, and will tell you whatever they need, in order to get you to commit to paying them. The lies are illegal, but they honestly don't care, they're probably on commission for how much they collect from you and others like you.  

If you do answer the phone, do NOT give out your employer, social security #, DL #, Credit Card and/or Bank information, or any personal information.  Tell them to send you a written statement & you'll respond. Then hang up.  When you get that statement, google, Fair Debt Collection Practices Act and you'll probably find a letter you can send them.  Or simply tell them not to call you again, as you are exercising your rights and putting them on notice, per the Fair Debt Collection Practices Act Laws.  Sign and mail that letter Certified Mail, so you have a signature and confirmation of delivery!!!


For the Calls to Stop, The request HAS to be in WRITING and sent Certified Mail!!!  The cost for Cert. mail is approx. $5.50, but you'll get a signature and date returned on the green card!  Keep track and Log all calls, and you can sue them for $1,000.00 each violation per the Federal Fair Debt Collection Practices Act.  Again I am not an Attorney, but I have fought two Debt Collector Lawsuits on my own.  The calls are coming from Genpact Services LLC.  After you send them the following letter - Certified Mail, you will get calls again and eventually a demand/letter from a company called NARS at 866-315-4860.  Google that number and I'll enclose information there so you can send the same letter as follows.  Be sure to put in your own personal information where asked for (name address, etc. and Date) and the phone no. you are being called on at the X's in the body of the letter.

In the Law of Novation: if a debt is purchased by another, for that to be a legal owed obligation, a new contract / agreement has to be written and signed by all parties.  Google Law of Novation and read up!!!

No I am not an attorney, just a well knowledged, educated consumer.  I have spent the past 2 years studying various Federal Consumer Protection Laws.  

I wasn't just satisfied knowing I could send a letter to a Collection Agency/Debt Collector and they had to go away.  I read that in the Fair Debt Collector practices Act law;  I needed to know why, what law tells me the reason why I can.

Everything I have typed, I have learned basically on my own through reading, studying, printing out and binding the laws and underlining/highlighting them.  Not to mention the knowledge I have gained on my own fighting two lawsuits without an Attorney.

I was sued by a Collection Agency, and waiting for a Court date. The Collection Agency Attorney, sent us a letter willing to dismiss with prejudice our lawsuit, if I dismiss our Cross/Counter Claim for Fair Debt Collector Practices Act violations.  Oh, I forgot to mention, we do not have an Attorney representing us; and I have not had any legal experience, in the past whatsoever.

I have read / printed & bound, my State's Rules of Civil Procedure and Rules of Civil Procedure - Evidence.  I catch Attorneys on violations of State Rules of Civil Procedure all the time.  And our Judge's let them get away with it.

And for those of you who say pay up and quit being a deadbeat; it appears that you have never had your life turned upside down, because a good job, not high paying by any means, but a supposed secure job, got your hours cut by 3/4.  

And then a couple years later, as you are just recovering, you lose that job.  And when you are in your 50's, a new job is not so easy to come by.  And when that happens, then what?  

Or what about a major illness, guess you've never had that either - too bad.  Maybe if you did, you'd understand why and how people end up getting in financial straights. Not because they chose to, or decided they were going to find loopholes to get out of paying obligations etc.

What if the money isn't there to pay these debts to begin with?  We've been barely able to pay a mortgage, let alone credit cards etc. It's easy to tell someone else what to do.  I hope someday, something throws your secure little world off its axis, and you find yourself in the very situation as some of us here. Maybe then you'd learn it isn't such a cut/dry situation.

Oh, we've struggled.  And the job last hasn't exactly been replaced.  We're still behind in our Mortgage and trying to catch up, as with our other legal obligations.  I can't work because of various health conditions, or I would, including a part time job at least.  My husband started his own company with the tools of the trade, and now contracts for copier, computer, IT technical jobs as he has a computer science degree, and has years of experience in the others, especially the wide format copier / printers / computers.

People, please read the Fair Debt Collector Practices Act; if a Debt Collector violates any one harrassment or other law in there; Federal Laws says you can sue them for $1,000.00 per violation.  Do it, and then THEY can pay off YOUR obligations!!!  

Again I am not an Attorney - but have learned these by my own experiences.  There are Attorneys you could talk to, and I would, if any violations of the laws have occured in your circumstances.  I am posting this strictly to help others maybe have a piece of mind, if they are up all night worrying about financial problems, and sick to their stomach in worry as I have been, and still are in some ways. I am again just a well informed, knowledgable consumer, who has spent hours studying the laws, because I had no where else to turn for help.  If anything I have written, causes you questions, please seek the advice of an Attorney.

Certain situations such as Mortgages and Car Payment loans usually do not apply here; so you may need to seek the advice of a Lawyer for your individual situation.

Get off your high horse. Credit collections agencies go on fishing expeditions all the time (I used to work for one). Someone may owe a debt and they get a list of everyone by that name and then just start calling. My name is common (both first and last) and you would not believe the amount of calls I get. I don't owe anyone. When I say so, they get nasty and agressive, just like this guy above.

John from your company called me on June 26, 2010 called me and gave me some guy's name and reference number on my machine! A. there is no guy in my home. B. So your company is giving out OTHER people's names and reference numbers re their bad credit? Last I checked it was not legal to give out information unless you verified that you actually have the right person on the phone... or are leaving a message on the right phone. Where is your company's RESPONSIBILITY to prevent identity theft and maintain privacy???

Real creditors verify who they are talking to they don't just leave someone's information on an unknown number and answering machine..... Smells like a scam to me....

Oh and for the rest of you you can make arrangements with your original creditors to avoid scumbag agencies like this who do not abide the laws that real credit collection agencies are bound to in Canada.  Most creditors are really willing to work it out with you and hate to send stuff to collections because they get less then half of what is owed in most cases and the scumbag "credit collectors" get the money they get out of you. So deal with your Banks, credit card companies etc. directly.

A good friend of mine worked in collections and said most of these companies do not abide the laws so just deal with the businesses you owe money to directly and put these "credit collectors" out of business.

This number keeps calling me to collect a debt over 10yrs old, that has been charged off by the
credit card company.

They want $2,900.00 for a credit card that had a $200.00 limit !!!

Then they say they are the collection agency for capital one.

They will not settle for any resonable amount. They are very rude which just makes me
become a nasty "b" right back to them. Who would want to pay someone that is mean to
you ?

And every person that calls sounds like a wanna be gangster.
No, you can't AX me anything !!  Learn English people.

Other than that, yeah I owe something to someone.. but not $2,700 over what the limit was.

They called for my husband and the message said that they had a great offer for him!! when I called back requesting to know the nature of their call I was told it was none of my business. I asked them to not call back and was told/Yelled at they'd continue to call until my "dead beat husband returned their call I asked to speak to a supervisor and was told No repeatedly and continued to be yelled at. Finally a supervisor by the Name of Dave Cochrane came on the phone and immediately yelled at me for wasting their time. I contacted The canadian government about this company @ 1- 800-889-9768 andwas given the OPerator/managers contactnumber 1-519-432-0075 ext 2625 Her name is Suzanne LeRoache. SHe was not available when I called a few minutes ago but I will call again. The government said to contact her and if still not able to resolve issue I can file a report with the Government. This is an extremely rude bunch of individuals. Their Proper leagal name is Active Capital Contingency Inc. They also go by Active Capital aquisitions canada Inc. and Active Capital Caoital Canada, They Have an address in London Ontari 1001-130 Dufferin Avenue East London Ontario N6A 5R2  This address was given by Manager Dave Cochrane. been getting these calls every day- 5 or 6 times in an hour and I have a pay as you go c phone.  I will not pick it up because it cost  money and the only one that knows of my c phone is my IMMEDIATE family.  

I do not owe ANYONE any money,  IT IS A SCAM!!!

Just want to add that it is ILLEGAL for them to call you on a cell phone in Ontario, as it costs you money. It is a little known law that is about to get a big boost in enforcement. Just tell them that you are logging their number to your CELL PHONE and they will stop calling.

I kept getting calls from this number everday 1-866-226-8881.  Same woman leaving the messages and she would try to change her voice and say her name was something else.  One day I picked it up I played along she tried to conivince that they bought my account from another company which was a total lie because how can you bought my account from the company I been paying to for the last 6 years.  The woman got all quiet and hung up the phone and never called me back.
I then called my company and told them taht this woman and this number said the bought my account and how this woman was trying to get money out of me.  The company said they would contact the RCMP and their going to file a fraud report against this company.

I recieved several calls from this company as well. They are a collection Agency trying to collect debts from about 8 years ago. After explaining to the obviously untrained employee that there is a statue of limitations of 6 years less a day. They became very rude and defensive. Yes they are still allowed to call regarding the debt but as they know there is really nothing they can do regarding it! They can no longer report this to your credit bureau to mess up your credit and they can't legally take you to court! All they can do is call and harass you into trying to give them money!!! An absolute waste of their time and effort!!!!!!!!!!!!!
