Report them! File for Bankruptcy! Answer the Summons! Do what you have to do, but do not pay them once cent! They are only looking to make a profit! They do not want to work out a fair payment plan and your original creditor will not benefit from it. If they sue and your debt is older then 4 years, reply in your answer that the statutue of limitations has passed in your affirmative defense! Get a lawyer and sue them! See how they like it! They will not send validation,  they claim that they sent you notices already. Do not bother doing their hardship application, its a trap to see what they can take and they will not do anything less then 200 a month!

Do not answer the phone and Do not bother asking for validation. Do not bother trying to work out an easy payment plan.
They are only interested in collecting a debt in full plus any interest. If you can not pay, they will sue in hopes they will win a default judgement if you do not answer the summons. They are very pushy and if you make a complaint to the BBB, they never apologize. They basically try to make you feel like scum. They do not represent the original creditor. They bought the debt for pennies on the dollar and are looking to make a profit. Your original creditor won't see any of this money.

A few facts:
They will sue if you call attention to yourself. Just by simply answering the phone or sending a letter.
The SOL in california is 4 years. They will still sue or try to collect on the debt though. It is up to you to respond to the summons and list the SOL as an affirmative defense.
Paying on an old debt, even a small amount...starts the SOL over again.
A debt is reported to your credit report for 7 years.
If Persolve llc gets a default judgement against you, the judgement is good for 10 years and can be renewed. They can garnish your wages or put a levy on your bank account.
In California, if the contract from the original creditor is silent (meaning it does not state if a third party can collect interest) the third party can legally only collect 10% per annum.
If you answer the summons, denying the debt, the amount or Persolve's ownership of the account. You will win 99% of the time.


They will try to get you on debts that are past the SOL or for more then what you really owe. Trust me. Avoid them at all costs. They are not your friends.....
Report them to the BBB, FTC and state attorney general.

THese people have called me too. The are very rude, do not want to provide me with debt validation and threaten to sue me, and garnish wages. Refuse to take less than 200 a month payment. They also refused to give me their address. There is definitely something very wrong with this companies practices and ethics and they need to be stopped.

I've received several callse from this number.  The voicemail they leave is hold music, then eventually it says they'll call back at a later time.

This number 866-438-1269, belongs to Persolv, LCC -- it's a debt collection agency.  I've been working with them for quite some time now after they bought my debt to Orchard Band... [[[from which I NEVER had a card, NEVER used a card, NEVER bought a single thing - but since I started making payments (obviously thinking this was someone I *did* owe) - even after I realized this was NOT my bill and I had purchased NOTHING - I still have to pay it. Even after filing TWO fraud reports w/ my local PD and faxing them the info - there is no way out. Legally - I HAVE to pay... this has been going on for 5 yrs now]]]

Thou it's been sort of a rocky road being shifted from one person to another to another to another (5x now) w/ Persolv, I have finally landed w/ a guy who is working with me to get this account gone once and for all. Out of the 5 people I've dealt with from Persolv, all but ONE really rude b*tch have been cordial and helpful.  Try to call them yourself and see if you can find one of these people.

I have there number on my call block and it still comes thru with one ring.  They have called every 10 minutes for 6 times so far.  This is annoying.  I have told them to send me all info, that I do NOT do business by phone.
