RESOLVED: Contact BBB if being harrased by this company.

I received calls from these clowns for a period of 2-3 months.  They were looking for someone with the same name as me but wouldn't beleive that I had no business with company they were trying to collect for.  They wanted date of birth, last 4 of SSN, first/middle/last name, etc... too much info to give over the phone, and were calling me at work.  My state's ATTN Gen's office wouldn't do anything (Connecticut) since collection agencies are regulated by the department of banking (EVEN THOUGH IT WAS THE WRONG PERSON).  DOB was willing to assist after I provided a plethera of evidence they were harrasing me at home and work.  But it turns out the quickest way to stop the calls is to open a case with BBB, turn around was about a week to receive a reponse from the company stating they will block your number from outgoing calls.

Left a threatening message stating if I didn't call them by end of business day, I will be served with court papers! WTF!!!!!I have asked for back up to the claim of owing debit and have yet to get anything. Also, my caller ID does not match the number he left to call him back at. Caller ID had 800.693.3455 (creditor interchange) and the number he left was 866.816.2979 ext 3167.

According to the fair debt collectors act it's illegal for them to threaten legal action ect.

If they call ask that you record the conversation and if they threaten then present that recording to your states attourney generals office.

Got a call from a Phil Lopez who claimed to represent Citibank. Asked if I had legal council and if so, he wanted their name, address and phone number or to have them call him back at 866-816-2979.

Why should I have legal counsel when I have NO relation with Citibank? Not sure what kind of a scam they're running but beware of clever tactics to try to get you to call them back and separate you from your money!

I had these people harassing me at work.  I explained that I had multiple surgeries for Stage IV Cancer and was unable to work normal hours.  They called me a "lazy slob who doesn't pay her bills" and threatened to take me to court.  They also said that cancer is a personal problem and this is just business.  They are still calling.  Losers.

I received a call from the Scion (pronounced "sea-on")Legal department this morning about an incident that happened on 1-3-01.  He also said that his client would see my silence as refusal to cooprate and that papers would be sent to my home and "place of business."  However, he paused for about 5 seconds when he told me what county the papers would be filed under.  That didn't sound right.  Also, he used my married name.  I wasn't married until 3 years after the "incident" he was calling about.  It doesn't sound legal to me.

This number keeps calling me at work...threatening all kinds of actions.  I am not sure if I should take it serious or not.  I am unsure what it is regarding or if it is for real.

Based on these updates, I tend to not want to call him back.  Its concerning how aggressive they are.

CI contacted us today by letter stating I owed $5435.87 for a credit card I never had called "Heritage Bank One."
Heritage Bank is on the FDIC failed banking list, closed 4/24/2009
See FDIC:http://www.fdic.gov/bank/individual/failed/michiganheritage.html
"On Friday, April 24, 2009, Michigan Heritage Bank, Farmington Hills, MI was closed by the State of Michigan?s Office of Financial and Insurance Regulation and the Federal Deposit Insurance Corporation (FDIC) was named Receiver."

It is my belief this is fraud, a scam like most scams requires you to do something such as provide electronic banking, credit card information.

Investigate any claims you owe the debt before remitting funds or payment method/wire transfer. If you do a wire transfer, set up a seperate account to hand funds transfers, never give out your personal account to anyone.

?Rubber Duck? Reports:

In a fairly recent 2008 memorandum decision in the Supreme Court of New York State, the modus operandi, and therefore inherent personification of the entity, ?Creditor Interchange?, its ownership, management and counselor?s is made public for all to see.

Although the defendant was ultimately awarded dismissal, the plaintiff?s reference to the use of misleading oral promises, as well of employing ?dark legal practice? in the phrasing of written contracts by Creditor Interchange is eloquently described within the context of the decision, and could be construed as a warning to others deliberating on whether to enter into any business agreements with the parent company, Credint Holdings, LLC, Creditor Interchange, LLC, its ownership, management, counselor?s and others, directly or indirectly involved with its affiliated businesses and/or ad hoc associations.

The text of the above referenced proceeding is posted on the internet at: http://www.nycourts.gov/courts/comdiv/PDFs/8th%20JD%20DOIs/Gouchie%20MD.pdf

The plaintiff in the proceeding, Mr. Kenneth Gouchie, may or may not be petitioned for advice regarding Creditor Interchange and his original complaint. It?s possible that he may be contacted at:
Kenneth P. Gouchie
1800 Highland Ave
Fall River, MA 02720
(508) 567-3395

It is of additional interest that the planned acquisition of Creditor Interchange by Debt Resolve, Inc. (AMEX: DRV), terminated by the buyer, was due to Creditors Interchange?s breach of its representations and warranties under the purchase agreement related to its financial condition as well as the existence of a material adverse change in the financial condition of Creditors Interchange.

Debt Resolve Co-Chairman and CEO, James D. Burchetta said: "We are extremely disappointed we had to terminate our efforts to acquire Creditors Interchange. Unfortunately, the deterioration of the financial condition of Creditors Interchange left us no choice.?

Bud Says...

These dirt bags have a history of not being able to control their collectors. Below is the results of an action taken against them last year in Minnesota;

CREDITORS INTERCHANGE INC Lic# CA20157551
Against: Collection Agency
Action: Cease & Desist/Consent
Signed: 2/2/2004 $10000 Fine
File # CA 2303834 KRJ
Allegation:
Respondent allowed collectors to threaten actions they had no intention of taking and allowed unlicensed collectors to contact MN residents.

We have just recently received another interesting piece of information about Creditors Interchange. The State of New York is fed up with the unlawful practices of these knuckle-heads. Because of complaints from consumers about Creditors Interchange they were forced to sign a Assurance of Discontinuance to the New York AG. In other words; "We promise not to break the law again". I have attached a copy of the court document in .pdf format. If anyone has problems with this guys please send a letter to the New York AG office, I'm sure they can make sure you are heard.

New York Assurance of Discontinuance against Creditors Interchange.pdf

August 1, 2003 ? BUFFALO, NY - Creditors Interchange, Inc. has announced the acquisition of its business operations by two Chicago, Illinois-based private equity firms; Prairie Capital, LP and Caffery Capital Partners, LLC.

Creditor's Interchange is located in (where else) Buffalo, NY, however they have a large collection operation across the river in Canada (ayhh!) where the wages and worker benefits are even smaller. CEO David Young must have gotten one hell of a bonus for pulling this off.

VERY aggressive debt collectors who will lie, threaten and do any illegal act imaginable, just to separate you from your money. These are nasty, desperate conmen, and con-women that should NEVER be trusted. They have posed as bankers, lawyers and other professionals to scare consumers into believing something bad would happen, if monies were not immediately forthcoming.

In reality, these low-life's of the collection industry are nothing but a fraud! Any debt collector from Buffalo, New York is desperate, however Creditors Interchange apparently is hiring the WORST of the WORST! Stay far away from this ship-wreck of out of control rats, they are desperate and dangerous.
