In order to file a complaint with the FCC or in state court you will need proof of the calls. What I do is take a photo of my phone by placing it on the black surface of my stove with the fan light on overhead. The flash from my camera captures the date, time, and phone number of the telemarketer call. I can then transfer the photos to CD as evidence of the calls. Here are the instructions for complaining to the FCC:
How to Complain to the FCC (Federal Communications Commission)
Filing a Do-Not-Call Complaint
In addition to complaints alleging violations of the national do-not-call list, you may also file a complaint against a telemarketer who is calling for a commercial purpose (e.g., not charitable organizations) IF:
The telemarketer calls before 8 AM or after 9 PM; OR
The telemarketer leaves a message, but fails to leave a phone number that you can call to sign up for their company specific do-not-call list; OR
You receive a telemarketing call from a company that you have previously requested not call you; OR
The telemarketing firm fails to identify itself; OR
You receive a pre-recorded commercial message from someone with whom you do not have an established business relationship and to whom you have not given permission to call you.
Send it to:
Federal Communications Commission
Consumer and Governmental Affairs Bureau
Consumer Inquiries and Complaints Division

Consumer Private Right of Action
In addition to filing a complaint with the FCC, consumers may consider filing a legal complaint in a state court.

Calls repeatedly all times of the day or night

I choose not to answer the phone when I see this number. They continue to call regularly anyway. Maybe I should answer the phone with one loud whistle in my mouth.

These people are calling several times every night and refuse to leave a message. I do not answer and wish they would just go away and stop annoying people. I am tired of having my nights interrupted by these idiots.

Dear 1-877-213-6163 ..
800notes is not affiliated with your callers, we are not calling you either. 800notes is a forum for reporting who calls you and any information you may have about the call to share with other forum users. It is highly doubtful that your callers are reading here also.
Do consider maybe getting a call blocking device or phone.. You can google them and many are around $60.00 or so.
Report your callers here:

We've been getting these calls too. Here are some rules on what can and can't be done:
"Charities" are allowed to cold-call you. They are not telemarketers, and they are exempt from the DNC list. Bogus charities also fall under this umbrella, unfortunately. Check out the links geezerly1 posted above to see if something is legit.
All unsolicited calls -- charities, telemarketers, debt collectors, what have you -- are only allowed to leave one message for you a day if you don't answer. Any more is legally considered harassment. Most callers will try to get around this by hanging up when voice mail picks up so they can call you over and over again in a given day until someone picks up. As long as it's during business hours, it's unfortunately allowable. Not answering the phone could work. Callers, charities especially, will eventually see this as an non-viable number and stop calling. Or they'll start calling with a different number after a length of time. But it's a solution akin to pulling a weed when the real answer is to dig it out by the root.
If this is a legit charity (it may or may not be -- most people who get the calls on this thread seem to have donated in the past, but the callers seem very shifty when asked specifics about their *charity*), ask to be removed from their list. They MUST comply, whether they're a charity or someone you've done business with in the past or not. The rules vary, but the benchmark is usually a two-week grace period before they update their lists and the calls have to stop. They are also NOT allowed to argue with you, use abusive language or request any personal info before they'll agree to remove you.
If it's a bogus charity, asking to be removed from their call list won't do squat. Either way, if the calls continue two weeks later, here's what to do:
File a complaint with the FCC
http://www.fcc.gov/complaints
For bogus charities, report them to your state's Attorney General and here
http://www.stopfraud.gov/report.html
Try to get as many specifics as possible -- when they called, their name, their company, their phone number and address, what they said, if they were harassing, etc. The more complaints the government gets, the faster they'll investigate into the problem.
Kat 2014-05-03 13:19:55 Unknown
Ugh ... a call came in at 9 a.m. on a Saturday morning. Does anybody know if *charities* are restricted to Monday through Friday or if they can call during business hours on weekends too? I'd love to file a report if they broke the rules.

My mother donated to a breast cancer charity a couple years ago. She started getting multiple calls from a number I reverse-looked up to see was a (not necessarily the same) breast cancer charity. They'd call multiple times a day and hang up when the answering machine inevitably picked up (just for those who aren't privy to all the twisty rules of the DNC, by law a caller can only leave one message a day during business hours; this is why so many legit and illegitimate callers hang up when voicemail picks up -- that way they can call over and over again each day). Anyway, I told her to answer the next call and ask to be removed from their list. By law they're obligated to comply. She did, and the calls stopped for several months to my knowledge. Now they've started again with this new (to her) number. Same charity? Not sure. Possible coincidence these are separate charities, probably not.
For the people unilaterally calling this a scam charity, do we have any concrete facts on that? Do we know exactly which company this is; has anyone done any research on it? Dirty tricks for sure, but they might be legit. They might not. Regardless, I'll tell my mother to answer and ask to be removed from this number as well. Until the next number change and it starts all over again. Sigh.

Since my daughter had breast cancer 20 years ago I not only donated to the society I also worked on the walks. But since they have made so much money through the years and are no closer to a cure that wasn't used 20 years ago I QUIT donating. Told the telemarketer that and they still keep calling so I just don't answer but that doesn't stop them from calling.
Bill 2014-04-26 19:37:19 Telemarketer
If they continue to harass you for a donation, give them a phony credit card number. NEVER USE A DEBIT CARD!
Never give your Social Security number unless you initiated the call, and then, only the last 4 numbers. Do NOT ever give a bank routing number and/or account number over the phone. Do not give donations to charities or political groups over the phone. You do not know who you are talking to.
Joe 2014-04-18 20:12:36 Unknown
Multiple calls each day. I never have spoken to them as they never leave a message on the answering machine..therefore I probably do not wish to talk to them. So now when they call I pick up the phone and just let it sit there until they come on line and eventually hang up..Maybe I am wasting some of THEIR time. Have received at least 20 calls.

It's been years already that I receive this call. They have deteriorated to rude, annoying and unprofessional!
They leave your number on the list on purpose. They already know that you don't want them calling so the minute you answer they hang up. I did some telemarketing for a company I worked for and the computer keeps track of the results of the call if the telemarketer is genuine and caring and enters the request! Whoever is doing the service for the breast cancer is horrendous and they should not be hired by charities to collect. They are doing a disservice. How can you ask for a donation with a bad attitude. They do it as if a person is obligated to donate. Almost like a debt collector!

This is the Breast Cancer Society (not Association). They call relentlessly. Today I received an 8:30am call, a second several hours after that. When the third call came I decided to answer to ask them not to call again. The woman who called became indignant with me when I said it was the 3rd call I've received today. Then she started laughing. And this organization wants me to give them money? I am sympathetic to their cause - I lost my Mother and Grandmother to breast cancer - but their methods are harassing and making people not want to give. Something needs to be done about them.

superannoyed 2014-03-15 16:11:49 Unknown
I get these calls everyday of the week at all hours of the day and night. I don't answer but I want to answer and yell at them to stop calling. Give up already. I have read the posts and now think back on a call I answered from someone soliciting donations for breast cancer and remember that the caller was rude and just would not take no for an answer. So this could be the same caller. I don't plenty to cancer research, etc. to my local charities. I don't know where this caller's donation is going and she asks for your credit card number. Just want these calls to stop.

(similar to call center setting) for about a minute.

Got a call from these people about Brest Cancer. They told me they were sending an envelope for me to mail a donation. She already knew my name and address. What an evasion of privacy. I wish they would stop these organizations, they are as bad as thieves. Some of us people don't have the monies we need ourselves.

If I answer the phone without caller ID, they sound like some friend, calling me by my first name (which I hate, if someone doesn't know me and are trying to sell me a "bill of goods). This number says they are with the American Cancer Society or Association, and thanks me for "all the good I have done in the past, and how much the ladies have appreciated it." They call all the time. I used to be sympathetic, but no longer. I tell them not to call back, however it does no good. Last time they called, yesterday, I just said, "that's nice." and hung up. I, too, cannot get rid of them. I made the mistake of contributing $20 a few years ago, before being warned about solicitors over the phone. I usually don't let them go on that long, and just hang up. When I go to the phone that has caller ID, I can see the number and not answer.

These people have been calling me several times a day for about a year. I have told them not to call any more and they call more often. Now I let the phone ring, and they still call four or five times a day, seven days a week. Can someone please do something about these people, I am tired of being harassed by them!
Leigha 2014-03-06 01:35:24 Unknown
This number has called 5 times in the last 2 hours. This has to stop! How can I block this caller?
Don't Answer Toll Free Calls 2014-03-04 22:08:56 Unknown
I made the awful mistake of donating $10 to them once because I thought they were affiliated with American Cancer Society. Do not answer the calls, do not bargain or plead with them. I have caller ID and no longer answer 800, 877 or 866 calls. With our phone system, the caller's name - or lack thereof - is announced when I receive calls. These callers are just such a sad lot and not worth much of anything.

I got 17 calls from this number in 4 days and so far today, 4 calls. Last night I went online to the Attorney Generals office and reported the calls. We'll see if this does any good. The number says Breast Cancer Asso but I'm wondering if it really is.
