It's one thing to not pay your bills, it's another to be harrassed repeatedly because a bill is a couple of days late...you must be one of the moronic bill collector's that calls, harrasses people day by day making empty threats ...you prob do this job bc you have no one else to speak to and this is the most interaction you will ever get.  I can't imagine anyone who does this for a living actually knows people who like them.  ;-)

I actually was calling to settle an old debt for my wife. The original debt was 1258.00. CRA tells me that it has gone up to 2331.00. So I asked why and they said because of interest and fees. I then asked what state governs them and the lady, Michelle Silva got upset asking if I wanted to pay or not. I advised her that I think they are adding interest unlawfully and I needed to check first. Because unless it is stated in the original contract that the collector can add interest or unless state law says they can they are doing it illegally. So Michelle just got more upset and more upset because I knew the law. So she then tried to threaten me by saying they can legally come after the 2331.00 but are choosing to come after the 1258.00 only which just put her in more hot water because under the FDCPA section 807 she cannot threaten anything they have no intent of pursuing. When I brought this up she said she could no longer speak to me because I was 'impossible'. Now I never raised my voice, cussed, or even was remotely rude. Learn the laws people they are here for us.

CHECKED MESSAGE: CALL FROM MS THOMPSON CR ASSOCIATES FOR MY SON (I HAVE NOT HEARD FROM HIM IN YEARS) I DO NOT KNOW WHERE HE IS. THIS IS A VERY PERSONAL PAINFUL SITUATION FOR ME. MS THOMPSON SAID HE OR HIS LEGAL AGENT NEEDS TO CALL 877-236-3519 TODAY AND GAVE A CASE NUMBER. SAID IT WAS A VERY SERIOUS MATTER. THESE TYPES OF CALLS ARE CRUEL. We have been receiving numerous calls from this number on my 15 year old daughter's phone, home phone, my ex-husbands cell phone and my boyfriends ex-girlfiend.  They will not provide any information but state that it is an urgent issue and they are trying to reach my boyfriend or his attorney.  They have called repeatedly for weeks.  They will not identify themselves and try and get information from me which of course I will not provide.  I advised them to remove our numbers from their records and told them to leave us alone and I did not disclose that I knew my boyfriend.  What is scary is how they have located all of the different phone numbers especially my exhusband and daughters number.

THEY HAVE NO BUSINESS CALLING MY PHONE WITH THESE HARRASSING VOICE MAILS A LITTLE AFTER 8 IN THE MORNING, ESPECIALLY SINCE I AM ON THE DO NOT CALL LIST AND AM ILL AND MUST REST IN THE MORNINGS.

A woman named Ms. McCoy called my home and left a message for an extended family member we don't speak to. She was harsh and demanding. She insisted that it was urgent. She wanted a representitive to phone with a file number. When I phoned to tell them that no one lives here by that name, a man insisted that I tell him if I knew this person, and I insisted he tell me who CRA was. He refused to tell me, and he asked me again. I told him I would call the Better Business Bureau.

My daughter called to tell me my ex-sister in law has been getting calls from a company stating I had monies coming from a claim from years ago. I knew I had no monies owed to me due to the fact I have never filed a claim. I contacted the company. They told me I owed a bill. I stated the bill which was in question was listed on court documentst that my ex husband was suppose to pay. I offered to fax such documents proving I was no longer responsible for the bill. I was then screamed at, cussed at and verbally threatened. I asked the representative for their name, they refused. When I asked for the supervisior, they hung up.
The irony of the situation they initailly were contacting my ex husband who in turn  gave them his sister's number. The reason he told them, his step-daughter stills talks to his niece, so somehow they will get in touch with me, yet he is the one that needs t pay the bill.
I cannot believe these people are allowed to take false information, lie, and harras people. This kind of scare tactics should not be allowed.

I received a call at 8:30am from a woman named Lindsey.  She was very rude and short.  I didn't answer the call because I didn't recognize the ghost number they used.  (310) 855-3351.  Her message informed me that I was not aware of the seriousness of her call and she's been desperately trying to get in touch with me.  She even knew the county in which I live.  However, I tried to return the call and got a message saying my call cannot be completed.

Someone called my father and left a message for me by my current and maiden name.  They gave a reference number and told me to call them urgently or to have my attorney call.  When I tried to call the number to figure out what it was in regards to, they would not tell me who the company was or what it was in regards to. I would not give them the reference number and one lady rudly yelled at me until I hung up and the next lady hung up on me.

CRA called several times wanting to talk to a  Stephenia Shepard.  I told them that this was my cell phone and stephenia Shepard didnt have anything to do with it.  They then asked if I knew a Stephenia Shepard and I told them that I didnt.  I asked them to take my number off of their call list.  They said that they would.  They didnt take me off.  They called on night  at 8:15 pm and another time at 11:12 pm.

A Ms. Garner left a voice message for my husband.  So I thought I would call to follow up for him.  BIG MISTAKE!  I never have spoken to several individuals that were so rude in my life.  They not only told me that they could not legally speak to me about this matter but I was hung up on 5 times.  They wouldn't even tell me what CRA was or why they were trying to contact my husband.  THEY EVEN BLOCKED MY HOME PHONE # SO I COULDN'T CALL THEM BACK!  Now it's my understanding that such agencies may speak to the individual the spouse or an attorney, so why they were so rude with a simple question of "What is this in regard to?" is beyond me.  I think people like that should be imprisoned for harrassment!!

1-866-857-3916 is one of those irritating numbers that show up on your caller ID that can never seem to be identified.   When you return the call, you get the ominous "Can I help you?" or "Case number please."  They refuse to identify who they are when questioned, will not state they are debt collectors, and by tone imply you have committed some illegal act and are in great trouble or they would not have called you.  It is a violation of FDCPA.  It took quite a bit of research and cunning to discover whom the voices were behind the lawbreaking 866 number were...but it's coming together now and they are without excuse.

Give us your stories on CRA and let's put together some useful information to bring these folks down.  Record their calls where legal and save the tapes for future use.  We'll post 'em here if you have something of interest.

In the meantime, hold them to the law; make them put everything in writing, validate the debt.  Use the cease-communication letter.  Violations of the law should be pointed out to the Virginia Attorney General.

CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.

The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.

Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.

Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.


How can I stop a debt collector from contacting me?

If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.


What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.
Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.
Debt collectors may not:

give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.
Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:

Veterans? Benefits
Civil Service and Federal Retirement and Disability Benefits
Service Members? Pay
Military Annuities and Survivors? Benefits
Student Assistance

But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.
