Debt Collector
I keep getting calls from this people and I OWE NOTHING!!!! Never bounced a check, I pay my bills on time, but we have the misfortune to be related to someone who has not been financially responsible. Despite the fact that he lives in another stater, never lived with us, never had our number, we do have the same last name. I have no idea how they got our number, but the the advise of "send a letter asking for calls to stop," did it...didn't work..."we are just doing our job, don't be mad at us," tried to have a civil conversation with the man that keeps calling, until he threaten legal action since we know the debtor, tried explaining that we don't know where he is and or how to contact him...was accused of lying. Finally, he tried telling me the debtor used us as a reference and there fore we might me liable for some of the debt....we check our credit reports every month, still in the 800s, no new debt...nothing.

Every time they call they try a new tactic....see why you do appear to be scumbags? We OWE NOTHING?   But have the pleasure of listening to the same idiot threaten our relative through our answering machine at least a couple of times per month....for the last year.

Yes, we would love to know where the debtor relative is, but we don't, have tried and will be dammed before we start giving out the rest of the family's phone numbers as suggested by this company.

We are not all free loaders calling to whine about skipping out of debt, yet we are treated as if we are.

Wrong. 1000 per action not per violation if you can prove a violation of the act. If bills were paid in the first place there would be no need for collection calls. Debtors who use credit to purchase things they cannot afford are fond of going on the offensive against creditors who are entitled to recover the debt. Debtors should stop focusing on how to profit from their inability or refusal to pay debts that they owe by searching for technical violations of the fdcpa. Of course there will be instances when an agency attempts collection from the wrong person. Once that issue is reported the agency should cease communication. Hard to understand how one is a scumbag who tries to collect a debt that is owed. There are likewise defense attorneys and creditors willing to defend frivolous fdcpa suits brought by lawyers trying to make a quick buck while hiding under the veil of consumer advocacy. Rest assured the vast majority of these lawyers are not concerned about consumer advocacy, but about how much they can extort from a creditor for some alleged technical violation of the act. What is saddest of all is that manynof these attorneys keep a large portion of the statutory damages which are capped at 1000 per action and earn attorneys fees in the range of 2000 to 5000 for each case. Who is really profiting from the alleged bad actsnof these purported scumbags?  Exactly, the lawyers pursuing these cases.

You have to understand that debt collectors are people too. At least they are working. Why sabotage someone else because you are not responsible enough to pay your bills?

The bottom line is, if you owe a debt, you are liable for it. Bad things happen to good people, but you can't fault the people whose job is to collect the money that YOU agreed to pay in the first place. No one should have to call you and ask you to pay your bills. No one MADE you get a credit card. Communication is all it takes. People do not understand that a debt collection agency is not a group of people looking through a phone book calling random people.. (who even uses a phone book anymore?) There are 10's of 1000's of accounts in a debt collector's office. Be careful trying to get a quick buck on FDCPA violations because the agency WILL counter-sue you, and if you are falsely filing a claim, YOU will be out more money and trouble than it would have taken to just pay your damn bill. These "debtors unite" blogs are so annoying because all you have to do is call and speak with someone or even send an email to the company. Leaving a voicemail afterhours where you do not give your name or the number they are calling, will not give you any results so don't expect any. If you can't pay all of your bills at once, at least let the debt collectors know the situation and try to pay SOMETHING! IF you don't want to be contacted, send a cease communications LETTER, and you will not be contacted anymore. However, sending a cease communications puts you at risk to be sued if you are in a sueable state. Most of you probably don't even know if you are though... you just want to get online and cry about people doing their jobs trying to get YOU to comply with your obligations. Stop stealing from credit card companies, get a job, or file bankruptcy.

Read the FDCPA "Fair Debt Collection Practices Act".

This will tell you what these bottom feeders can and cannot do. It will also tell you how to stop their calls, and what you can do when they violate this statute.

You are entitled to $1,000 from these scumbags for each violation of the above act you document. There are plenty of attorneys who will take the cases for the easy fees.

Read, an look around. There is nothing these scumbags fear more than an educated consumer. Since they are a 3rd party collector, stopping their calls is as simple as sending a letter telling them to stop calling you.

I am constantly harrased by this Collectyion agency saying there are a law firm.  They call all day and hours. I have actually called back the telephone number they give 1-877-238-2868.  I have never been connected to an attorney or even a real person.  Usually after waiting on the line for a long time 5 min. or so I hang up.  They again call me back within the hour.

How can I stop these guys?  Yhey are just another debt collector posing as attorneys.

Is that legal.  I do have outstanding credit card bills and medical bills.  I have had 2 transplant surgery's and have had long stays in the hospital.  Any suggestions if I coulod afford to pay these long overdue debts I would but I have had so much interest and debt added on there is no way I can pay it off.  If I could afford to file bankruptcy I would.

SETTLEMENT AGREEMENT

WHEREAS, the Banking Commissioner (“Commissioner”) is charged with the administration of Part XII of Chapter 669, Sections 36a-800 to 36a-810, inclusive, of the Connecticut General Statutes, “Consumer Collection Agencies”, and the regulations promulgated thereunder (Sections 36a-809-6 to 36a-809-17, inclusive, of the Regulations of Connecticut State Agencies);

WHEREAS, Jacob Collection Group is a Mississippi limited liability company that was licensed as a consumer collection agency in Connecticut under Part XII of Chapter 669, Sections 36a-800 et seq., of the Connecticut General Statutes.  Such license expired on October 1, 2009;

WHEREAS, the Commissioner, through the Consumer Credit Division of the Department of Banking, conducted an investigation of the activities of Jacob Collection Group, pursuant to the authority granted by Section 36a-17 of the Connecticut General Statutes, to determine if Jacob Collection Group had violated, was violating or was about to violate the provisions of the Connecticut General Statutes and regulations within the jurisdiction of the Commissioner;

WHEREAS, as a result of such investigation, the Commissioner alleges that Jacob Collection Group, during the period of January 29 through April 21, 2010, acted within this state as a consumer collection agency without a consumer collection agency license, in violation of Section 36a-801 of the 2010 Supplement to the General Statutes;

WHEREAS, the Commissioner believes that such allegation would support initiation of enforcement proceedings against Jacob Collection Group, including proceedings to issue a cease and desist order against Jacob Collection Group pursuant to Sections 36a-804(b) and 36a-52(a) of the Connecticut General Statutes, and impose a civil penalty of up to one hundred thousand dollars ($100,000) per violation against Jacob Collection Group pursuant to Sections 36a-804(b) and 36a-50(a) of the Connecticut General Statutes;

WHEREAS, Section 4-177(c) of the Connecticut General Statutes and Section 36a-1-55(a) of the Regulations of Connecticut State Agencies provide that a contested case may be resolved by agreed settlement, unless precluded by law;

WHEREAS, both the Commissioner and Jacob Collection Group acknowledge the possible consequences of formal administrative proceedings;

WHEREAS, Jacob Collection Group voluntarily agrees to enter into this Settlement Agreement without admitting or denying the allegation set forth herein, and solely for the purpose of obviating the need for formal administrative proceedings concerning the allegation described above;

WHEREAS, Jacob Collection Group herein represents to the Commissioner that in June 2010, a filter was put into place so that all debtors with an address in the State of Connecticut would be rejected when placed by Jacob Collection Group’s debt buyer client.  Also, all debtors with Connecticut addresses were closed in Jacob Collection Group’s system and returned to its client.  However, Jacob Collection Group outsourced its letters to debtors and found that some account addresses were being changed by the vendor when the vendor performed a “USPS scrub” and, in return, some letters were being sent to Connecticut residents;

WHEREAS, on June 18, 2010, Jacob Collection Group filed an Application for Consumer Collection Agency License with the Commissioner, which application is currently pending;

WHEREAS, Jacob Collection Group herein represents that it has not acted within this state as a consumer collection agency since December 31, 2010;

AND WHEREAS, Jacob Collection Group, through its execution of this Settlement Agreement, voluntarily agrees to waive any rights to a hearing upon the allegation contained in this Settlement Agreement, and waives the right to seek judicial review or otherwise challenge or contest the validity of this Settlement Agreement.

NOW THEREFORE, the Commissioner and Jacob Collection Group enter into this Settlement Agreement as follows:

1. No later than the date this Settlement Agreement is executed by Jacob Collection Group, Jacob Collection Group shall remit to the Department of Banking, by cashier’s check, certified check or money order made payable to “Treasurer, State of Connecticut”, the sum of Three Thousand Dollars ($3,000) as a civil penalty;
2. Nothing in the entry of this Settlement Agreement shall adversely affect the ability of Jacob Collection Group to apply for or obtain renewal licenses under Part XII of Chapter 669, Sections 36a-800 et seq., of the Connecticut General Statutes;
3. Upon entry of this Settlement Agreement, this matter will be resolved and the Commissioner will not take any future enforcement action against Jacob Collection Group based upon the allegation contained herein; provided that entry of this Settlement Agreement is without prejudice to the right of the Commissioner to take enforcement action against Jacob Collection Group based on the allegation contained herein if any representation made by Jacob Collection Group in this Settlement Agreement is subsequently discovered to be untrue or if Jacob Collection Group is not fully complying with any term or condition stated herein;
4. Notwithstanding paragraph 3 herein, execution of this Settlement Agreement is without prejudice to the right of the Commissioner to take enforcement action against Jacob Collection Group to enforce this Settlement Agreement if the Commissioner determines that Jacob Collection Group is not fully complying with any term or condition stated herein.  For purposes of this paragraph, a violation of this Settlement Agreement shall be deemed to be a violation of an order of the Commissioner.
IN WITNESS WHEREOF, the parties hereto have caused this Settlement Agreement to be executed by each of them or their duly authorized representatives on the dates hereinafter subscribed.

Dated at Hartford, Connecticut

Got a call from Jacob Collection Agency. The caller ID was from 877-620-3818 but the message was to call 877-238-2868.  We have no debt, so they are reaching at straws trying to connect someone with a similiar name to someone they are trying to reach.  Pressing 1, as instructed to talk to an account representative, did nothing.

As a Credit and Collections professional for over 25 years and currently the president of a company that provides third party credit negotiations for business-to-business clients, I've seen my share of this type of company, the Jacob Law Group.  Check them out on Google Maps - they don't even have a legitmate address!  They give the entire industry a bad name!  I have an attorney working on this now.  I admit, I owe a debt and was trying to make payment arrangments when everything went haywire.  I recently got a new job and intended to make things right, but now I want this company punished for what it is doing.  Can we say class-action lawsuit?  Let's all file complaints with the Better Business Bureau in Oxford, MS as well as with the Attorney General in MS...I want these predators stopped!  Unethical, immoral and illegal!!!!!!

I started receiving these calls as well.  I haven't tried to call them back yet, but I have no debt other than student loans through the federal government.  I am actually looking forward to talking to these scam artists.  My (unlicensed) advice would be to block the number if you can, or just ignore it.  Sure, it is scary at first to hear a debt collecter since most people have debt.  But it credit card companies dont sell their debt generally (because how would they make money that way).  And as I said, they have no business contacting me at all, since I have absolutely no debt other than student loans.

My husband received a message from this number two weeks ago. A man named "Marcus Thompson" left the message, but did not identify his company. He said he was from "the law group." He must have forgotten the company name!

Last Friday my husband received a message from a different number. A woman with a British accent named "Angela Tucker" said she was from the"The Attorney's Office of the Jacob Collection Group."

My husband has a common name, so we assume they are fishing around calling all the people with his name in the phone book.

I have read the stories from people who were called by these numbers. In no case did anyone report receive mail from this collection agency, which is strange in the extreme. Collection agencies send letters first, asking the consumer to pay or call.

Got the number from verizon store when I purchased this plan.  That day I started getting phone calls from 877-238-2826.  The calls were for a man named EDWARD (can't remember last name.)  I have asked and asked for them to stop calling and to even call the Verizon store to confirm that Ed did not have this number.  Whenever I tell the caller that it is not his number and start to ask them not to call anymore they hang up.  Why should I have to change my number.  This has been going on since last april. Nine months of this.  At one point I had at least 20 calls in one month! What can be done?
