Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."
****************************************
A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I received the same call as everyone above, stating there were fraudulent charges under my social security number and would be served at work or home because of the summons. The caller ID was unknown the message was left by Harmony Spring but the return number she left was 866-459-6467. No one answered when I returned the call multiple times. Voice message went to Tiffany Brown with ACS Offices.

It's really unfortunate that people can be so grimy.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I just got the same voicemail from a "process server" named Layla Jackson and when I called back they answered ACS Services so I turned on the recorder on my phone and googled them immediately to find all of these entries about them. I explained to them that I had received a threatening phone call and threats of incarceration for failure to appear. I demanded that if they were going to threaten that they better damn well have a court date and location for me to appear, but of course they put me on hold several times and finally someone new picked up the phone and they had no information to provide regarding any court dates. i then explained that beacuse of that voicemail stating that, their tactics were now illegal and false. I also advised them that I was recording the entire phone call and she got furious and started getting obscenely rude so I hung up but not before letting her know that I too would be contacting my local authorities with this recording and voicemail. She then ignorantly called back and left another threatening voicemail. The phone number they were using was 855-823-1669 with case#.....

Scumbag collectors who are in complete and total violation of the FDCPA.  They misrepresent themselves as a law office and claim to have or will be serving you with a summons to appear in court for failure to repay a debt and attempt to defraud a financial institution.

Bull.

To the idiots working the phones for "ACS" - get a real job.  Oh wait, you failed to get your GED and McDonald's laid you off because you kept dropping the uncooked fries on the floor.

got a call from a Emily Jennings or Jenkins claiming to be a process at the final stage.  If a payment is not set up now for the full amount a state processor will come out to my job or home for my arrest.  also very rude when I asked where she was, she said New York.  I am in Florida.  this needs to stop especially calling someone work place and leaving these types of messages on companies work phone.
I then told her then take me to court and I will let the judge no what I can pay.  she told me I cannot tell a judge what to pay he can order the full amount.  I advised I know my rights I use to work at a jail.

I got a similar message, from Monica Evans, only she left a message on my mother-in-laws answering machine, they left the message under my father in laws name, who passed away 12 years ago, I am just guessing they looked in the phone book for the town I live in, and since the number is still under his name, and that was the only listing with the same last name as mine, they probably assumed that I was related to him, and leaving personal information on a voice mail is against the law, a processer will know this, right. and with all the supposed information for and alleged fraudulant check, saying that if I didn't call back in 2 hours they are going to have a summons served to my work or home,but the number left was 877-806-5357, I guess they got found out and changed their 800 number.  They also called my father, who happens to be a retired police officer, who lives on the west coast, and I live in the south.  Needless to say I recorded the message left to my cell phone and forwarded it to my lawyer.

Call was on my wifes Cell Phone voice message as a result of house phone being forwarded.
My son called back and they were looking for someone with the same last name but not part of our houshold.  I called back subsequently and asked for Address of company so that I could send a certified complaint, and they would not give an address or other information.  All they wanted was for me to repeat the case number.....I did not and certainly I was not going to give any personal details.

Almost the exact same scenario as Kelly - Voice mail form someone with southern accent.
Said he was a Process Server for State of Texas and had a "court docket number" he wanted to serve , and had tried several times to reach my son. Siad it was pertinent to ????(count not understand him ).Then said he WILL do it at work and residence, and at the end said "You have been advised " .  During his spill he also said it could be "taken care of" outside of the court but it was necessary to call 877 251 4288  IMMEDIATLY.... "  CAlled the number back - got recording say "thanks for calling ACS, enter y9our partys extension ( which was given on first call )   no answer

Scammers season now has begun early.....

I would think the state would just issue the warrant and then go get you (via sheriff or marshall officer) if you had not complied with previous instructions,,,   I dont think they would call and warn you first if you had a warrant out on you , and then offer to settle it outside the court.

Received a VM from a Tanya White claiming that she was a State Processor and that she needed to serve me with a court summons.  She also contacted my cousin, in another state, leaving the same information, but adding that it was a bad check claim.  Concerned about what this was about, I called the number I was given, whcih turns out to be ACS and that the person that left the message was merely a process server (probably hired by ACS).  I indicated that the debt was not mine, and, when I could actually get a word in, told them to take me to court.  I was transferred to a manager, which was as bad as the person that answered the person in the first place.  I called back, to get an address so that I could send a letter stating I wanted validation of the debt and that request they not contact me any longer.  I was told that they could not give me their address, and was hung up on twice.  On the final call, they transferred me back to the "manager", who said that technically they hadn't contacted me, the Process Server had.  WOW!

Still wouldn't give me address information, and was told to never call their offices again, and if I did they would file a "reverse harrassment suit" against me..

It was ACS company, most likely a debt collector but they should not be able to lie.

Of course Christopher Sanchez also stated that if my son wanted to settle out of court, that would be much easier.  He also wished my son "Good" Luck.

I received a call as well from this number stating that I owed 2 payday loans taken out on the same day.  I spoke to Stephanie Rivers, she was actually very kind..... weird...... but told me the company was after me for the money and we would be served papers within 24 hours.  I did not take out any loans nor had anything deposited in my account.  It was from nearly 3 years ago.  They had all of our private information.  They left a message and I called back the automated service said it was ACS Offices.  When I spoke to Stephanie she gave me the name of the company that was supposedly going to send us to court, again she was very polite and answered all my questions.  I told her we did not owe any money and she said well if it goes to court the worst that would happen is we owe them the money due?????  I will play the waiting game at this point I am sure she will call back.  I called my bank and they have no record of any deposits or checks cashed around that time.  I even contacted the company and they did not have any record of me taking any loans out.
