Thanks and I DID NOT and WILL NOT give them any info until I recieve a letter of verification stating that this is legit.....I cant believe that this kinda of company would even try this to get you to pay......as far as I am concerned they can find me and take me to court I dont care anymore!!!

Hello its me again Tami.... I recieved yet another call from these people today this time from the so called Process Server/PI Jenna Green so she says.....She stated that she needed me to call TRADEMARK where the debt is being handled to "release" the paperwork so that she can get these court documents to me......This is unreal ...these people sure do have unusual tatics and trying to play hardball.....anyone hear from these people????

the sleazy company does not make any sense at all the part where you wrote that its a courtesy call that again is a scare tactic there hoping that you give them your banking info  verbally or with a check now remember if you do send them a check your name your banks name and account and routing number is on it and thats all they need to debit your bank account and they will also take all your future deposits..they dont care if your living in the streets or your kids are hungry..

On the off chance that you're actually capable of understanding the truth of the situation, let's try it one more time.

Process servers do not call in advance. Process servers do not call in advance.

When you get a call like this, it is from a criminal organization who is trying to extort money from you by threatening court action and a fake process server is part of the ruse. Ignore it. Don't answer their calls, or if you do, just hang up. They'll eventually move on.

Hi honeslty I am more worried about the process server who called my phone and left me a message that she wanted to meet me and give me court documents...do process servers call you to set up a time to meet somewhere and nothing is on the court page showing up that I have a judgement pending.....when I asked the collection agency about the process server she says "its a courtesy call'....does this make sense???????

ask the debt collection company are they license to collect money in your state and the law says they have to give you the license number,then check it out because low life collection companies lie all the time i know there not license in new york..also there is 12 states where the PDL is illegal,so that means that in the illegal states i doubt it very much that they will take you to court because they WILL BE FINED FOR LOANING YOU MONEY AND THEY DONT HAVE A LICENSE TO LOAN YOU MONEY..the judge will probably order you to pay the pay day store not the collection company the money  you borrowed ex..you borrowed 500.00 you pay back the 500.00 you do not pay any interest or processing fees and you subtract any payments you already made,and you pay what you can afford,not what they tell you to pay..FAMILY FIRST,DEBT COLLECTORS LAST....
check the SOL.. if the SOL has passed you dont have to pay them a dime and they cant sue you.

If they refuse to validate the debt, they get nothing. Read this post written by an attorney in another post:

"IF they do not provide you with the verification of the debt, the debt is invalid and not subject to collection.  PAY NOTHING TO ANYBODY UNLESS THEY PROVIDE YOU WITH WRITTEN VERIFICATION OF THE DEBT, AND ONLY THEN IF YOU FEEL THE DEBT IS VALID - otherwise, let them sue you for the debt, as a real law firm will only bring a legal action on a truly valid debt".

Well, it's UP TO 25%. This takes place in civil court, not criminal court, and debtors can plead hardship. If 25% is too much, you tell the judge and show the judge why it's too much by writing up a budget ($500 for rent, $300 for food, etc.) to show how much money you have left after the essentials. Judges will not destroy debtors' finances because they want debtors to remain stable in their homes and continue to work to pay off the debt.

Aaaargh!!!  You're driving me crazy!!!  The way the law is written, in order to get validation of the debt (to prove these scammers do own the debt), Your *HAVE* to "dispute" the debt even though you want to pay it !!! I know this sounds stupid but that's how the law is written. Go look at my long post above at #4 that states:
"4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,"
This is how it goes:
(a).  You have to get an address from them. If you don't an address, it's likely a scammer so break off negotiations and sit tight.
(b).  You write them and say you dispute the debt (even though you do not dispute you owe the debt) and ask for written validation.
(c).  Collector mails you written verification of the debt. This might be a copy of the bill of sale or a credit card charge slip or a payday loan statement. It will show the merchant name, the amount, the date, etc. A scammer will *NOT* be able to lay their hands on these sorts of documents. A legit collector will have them.
(d).  After you get written verification (sale docs) in hand, you look them over and decide if they're legit. If they are, pay the man! If you don't get sale docs or fake sale docs, then you know for sure you're dealing with a criminal.

You can also eliminate all this grief by contacting the original creditor and simply *ASK* them what happened to your debt. Why don't you?

Thanks for your advice...my guess is that they are just trying to be forceful and collect payment but again I know I will not dispute the amount cause I do owe it but really go this far????  I have not and will NOT give them any info......as for the court documents my guess is that is not going to happen either......and if it does I will go to court and take things from there....they are telling me that I have like 4 charges against me....

Get a voice recorder and record the call. Announce at the start of the call that you are recording the call. Tell them you intend to dispute the debt and can't do anything until you get the 5 items spelled out in section 809 of the FDCPA and an address to write to to dispute the debt. Tell them if you don't get the info, you will break off contact. Then HANG UP. Every time they call up, you just tell them the same thing. Get the address, the address is VITAL, the law says you have to ask them in writing to dispute the debt so get an address. If they keep making excuses, they're scammers and you can safely ignore their threats of court. And if even if you did get sued someday by the real owner of your debt, would that be so bad since you admit to the debt anyway? Worst that can happen is wage garnishment of up to 25% of your paychecks.

They keep contacting me and when I asked them for a copy sent to me via email the gal I spoke with stated she wwould forward the info to the payment department and I have yet to hear from them and the gal tells me that the call about the process server setting up a time to meet she said that was a courtesy call.....I do know that I owe this but is this how to collect the debt and will I actually be served with this court papers which by the way do not show up on our public court access page.
