I'm so happy for you Stephanie!  If you've  admitted that it is your debt,  and they were able to get by with validating the debt by simply explaining it to your satisfaction over the phone,  and then set you up with payments,  then Kudos for you!   However,  others  who claim that they do not owe the debt,  or just plain choose to play by the rules of the FDCPA for their own protection,  might want to choose another course of action.  That action has been clearly outlined by   "Lone Stranger to Tonia".  I see nothing wrong with anyone who refuses to pay a stranger anything until they have first validated it in writing via usps,  and demand that the stranger validate their right to claim and collect the alleged debt in their state.  Do you?

The party I spoke with on the lthis number Valerie was very polite and helpful she explained in detail my debt and how I could make payments since I couldn't pay the balance in full. This company will work with you if you want to take care of your debt.

At this point it doesn't matter if they are legit, your response is the same.

First some ground rules.  

When they call again:

Do not let them intimidate you.

Threats of any sort are illegal under the FDCPA, and also tend to simply be meaningless bully tactics.

Do not acknowledge the debt.

Do not suggest that you will make payments.

Tell them that you expect them to send validation as required by the FDCPA.

Advise them that you will not conduct business over the telephone, and this is their notice that they are only permitted to communicate with you by U.S. Mail.

If they fail to validate the debt, then they forfeit the right to collect it.  Failure to validate is also a good sign that they are not a legitimate collection agency, or that the debt is uncollectible "junk paper".  

If they validate the debt, and it is valid, under no circumstances should you make any payments by any of the following means:

Check by Phone
Debit Card
Credit Card
Personal Check
Any other method which involves access to any of your financial accounts.

Payments (if any) should be made by way of a United States Postal Service money order, sent by certified mail, return receipt requested.

Payment arrangements, if any, must be in writing, and in your possession before any payments are made.

If they have agreed to settle for less than the full amount, the written agreement must state that this will settle the debt in full, and without recourse.

Even if this caller is a fraud, the things you learn will help you.

Remember - you are in charge, not the people calling you.  Never give in to bullies.

In today's world there is a good chance that these are not legitimate operators.  If you follow the law, you will be fine.  Just don't ignore things which are in writing.  

Once you have demanded validation and told them to communicate only in writing, you can pretty much ignore the phone calls, although I would keep a record of them.

Most of all, do not rely on what we tell you, READ THE FTC WEB SITE instead.

I to received a call from Southland aquisitions. From 877 299-8129 and cannot find them listed anywhere on the internet to contact them. Does anyone know if are ligit?
