Debt Collector
I received a voicemail message from Agent Harpor telling me that I'm defrauding my financial institution and about a legal matter. That they are not able to contact me so they're going to file agains me on court. I'm very scare the police is going to come to my house or place of employment. I work for a Financial Institution and something like this can make me unemployed in a minute. I do have a pay day loan, I have to close that account because I got my purse stolen. I call them to pay by money orders and they told me no that they need my new bank account information and because I refuse to do it the lady hang up the phone. I'm very scare and don't know what to do.

Hi Rosie,

I am a little concern myself. I KNOW I have loans that is being taking care of, but for someone to threatened me? I don't think so. So did you actually call them back on the following (Monday) day? I am going to wait until the end of the day, I don't want to go off on them while I'm at work.

And if I don't return her call TODAY she will be sending my paperwork to court and I might be served at hom or work???

Suggestions??

These idiots called my step-daughter and said if she did not tell them how to reach her father that they would have her put in jail.  I called and they blew me off, obviously not threatened.  I plan to give their # to our State Attorney General's office.  He can at least call or shut their # down.  I deal with medical collections all the time.  We require they give their company names and provide any files that are requested. Paying over time is much better than no payment.  Court isn't much use unless the person works at a job you can send to collection or to get a judgement.

Yeah, I was initially really scared b/c I know I have defaulted on these loans, and want to correct this. I am a hard worker, my husband and I just hit some serious financial difficulty. I am going to wait until Monday (tomorrow) and request something be sent in writing. Has anyone else received the same message or been in the same situation? I know I sound crazy but I am almost a little scared the cops are going to come get me at work lol. I would be mortified, I'm a nurse and work in a busy hospital!

"lawsuit ... in the form of a pre litigation complaint" sounds like gibberish to me; a lawsuit can't be "pre-litigation" because it *is* litigation! I'm not a lawyer but that does sound like something dreamed up to frighten people. Here's what you can be pretty sure of:

? Threatening legal action like this is illegal
? The story about being unable to reach you "at all addresses" is ludicrous ? they have your phone number, why not your address? Did they state what addresses they tried to reach you at?
? Just because you owe someone money doesn't mean you owe it to THEM! They have to prove you owe the money *and* that they're the ones you owe it to. And they have to provide the proof in writing, not by phone or email.

You should contact the police and report these people immediately.

I just got a call from a Ms Adams private locator on a Friday about a " lawsuit being filed against me in the form of a pre litigation complaint. She states that she has tried to reach me at all addresses she has listed on file and because this is a failure to locate she will be sending it to the court system and the authorities will find me for a failure to locate after I have been found guilty"...I'm not even aware of who this is, or what it is in regards to. I called back yesterday, but no answer, it sounds like a debt collection agency NCS. I have defaulted on 2 pay day loans after we came into financial hardship, and I want to settle them. She sounds pretty legit, but from what I read on these boards, these calls are just a scare tactic. What did they say to you?
