ps these are the only exceptions to being in the settlement -

Yes. The following are not included in the settlement: Fifth Third and its officers and directors; the Court presiding over
any motion to approve this settlement; and anyone who timely submits a valid request to be excluded from the
Settlement Class (see ?Excluding Yourself from the Settlement,? below).

Nothing about having a balance.........

Customer Care Management - isn't even a company!!  You cannot find anything on them on the web or yellow pages.  Again - proving they are frauds.  I do not know how they got my information, but I am not happy.  When he calls back I am going to ask him his name, the company's name and the physical address he is calling from.  And then tell him to take a hike and remove me from their list.

These people are FRAUDS!!  I am part of the class action suit as well. They called me this morning for the first time and then called me at my work!!  (I had already searched the number and found this site)  I told them that I was part of the lawsuit and they told me that it was already settled.  I went to the website for the lawsuit - https://www.overdraftsettlement.com// - which states people will be paid with in 90 days of settlement which means 9/29/11.  I said that to the person at this company and he said no, no, no it's done, it's over with, blah blah blah (lie, lie, lie).  I was getting a bit loud and irate with him telling him to go to the website and see for himself and then he said that his managers were IMing him with settlement offers (they were listening in) - oh, we'll give you 50% off if you pay today, or by the end of the month (in 5 days), etc etc.  each offer better than the next, just trying to get some money out of me.

I told them first, I do not owe you any money.  Second, if I did how come this is the first I heard in 3 years?  He was stumbling over his words, making me more offers etc.  Saying that the bogus balance was accumulating 6% interest a day.... He kept trying to get me to promise that I would pay this or that.  He also said that the lawsuit doesn't apply to people with a balance (hellooo I told him I didn't have one) and all these other LIES.  I kept telling him I cannot promise anything without researching this first.  I finally got him to shut up (mind you this phone call took place at work) by saying send me something in writing.  He said he could send it to me via email, so I gave him my generic email addy to email me.  He then "assured" me they were not frauds after saying that the email wouldn't provide specifics...  RIGHT, I wasn't born yesterday.  He then said he'd call me back (tried to get me to say that I'd be ready to settle with him tomorrow).

After I hung up with him I called the lawyers on the website - Ben Barnow, Barnow and Associates, P.C., of Chicago, Illinois, (312) 621-2000 and the woman who answered the phone said the lawsuit was NOT settled, NO ONE HAS BEEN PAID YET because their were appeals that were filed.

DO NOT GIVE THESE PEOPLE ANY MONEY.  This guy was so pushy, I knew it had to be a scam.  Wait till the lawsuit is settled and people are paid.  This "collection" company should be reported to the BBB.

Again, the website is https://www.overdraftsettlement.com//

Check it out for yourself.

I first got a call from them saying I needed to call them asap, concerning an emergency. When I asked who was calling they hung up on me, then when I called again they got really defensive when I said I was going to call the police on them, telling me I was stupid and that the police dont really do anything, and they laughed and hung up again.

Got a phone call from them looking for my brother about a 'claim' they want to review with him before it's signed off on.  Whatever the heck thats supposed to mean.  The only thing is... my brother has been in prison for almost 2 years and the phone number they (the a holes) called, I haven't had for more than 6 months.  I know for a fact he hasn't had any loans, ever.  Nor has he ever had a bank account.  The a holes weren't very forthcoming about why they called either.

Would happen to know the name of the collection agency by any chance? Did they clarify the name of their company?

when my husband asked the guy what the call was about, he said "do you answer a question with a question?"  my husband then rattled off a few expletives and hung up.

Event Reminder
I have just had a phone call from them.  I had an account with them that went negative by .32 and they did not notify me.  I don't even know how it went negative.  They charged me $7 a day for almost a month.  They at no time texted, called or emailed me to inform me that my account was negative. I was enrolled in a protection plan that was supposed to inform me.   When I finally checked my balance, my account was $357 in the negative.  I tried to argue about them not informing me and finally wanted to close my account.  They informed me that they would not close my account until at least another 2-3 weeks.  My closing balance was over $700. They are a rip off

I've had this cell phone for 2 years - which I have explained on numerous occasions. I do not know who they want - apparently not even in this town. I'm just about up to lawsuit point.

Thanks everyone, I also called back to inform them that I was part of the class action lawsuit and me paying them wasn't an option nor was it suggested.  Tthe lady I spoke with stated that the lawsuit is only available for those who pay the balance of the written off account.  To which I told her there was never anything that stipulated that in the lawsuit and that wasn't something I would be doing.  Also the lawsuit only being available to those who pay off the account makes no sense, the account was written off because we weren't going to pay the fees that were accrued, which are the same fees that are the basis for the class action lawsuit.....so tired of them

Just called one of my company cell phones... explained to them that it's a company phone and this person does not own it nor do I know them, and to take me off list. They (she) tells me, "Not what I asked you. I asked you do you know her..." I say, "I already told you no" and started to explain again... she hung up.

Those a***oles need a good a** kicking and I wish they were in my face talking like that... little do they know I'm ghetto and they'll get their a** effed up talking that b***s*** to me. But I won't ever run into any of them, so whatever. I'll be civilized, and sue their a***s next time!
