as we all know the debt collector by law must fully identify himself,what i would do is keep on interrupting him until he fully id himself,, ex..what is the name of your business..he doesn't say but keeps on talking about a debt then i just keep on saying what is the name of your company and i would do this until he tells me,another way to break there chops is when they tell you that there recording the conversation,,then you say oh i'm sorry i don't like talking into recorders and have somebody listening into our conversation please call me from a line that is not be recorded or listening to our conversation then you say thank you and hang up.
very important dear you have to request validation.. what they have to send you in the mail is verification,,the debt collection company name..amount of money and then the original creditor
now what you do is by law send them a certified letter requesting full validation per FDCPA ACT.1692g.SEC.809(b) and then explain to them what you want
1..when you opened and closed the account
2..all charges and payments you made..you have the right to make sure all your payments were credited
3..how the interest was accrued because we all know when these IDIOTS do the math they always make a mistake in there favor
4..you want to see the contract with your signature on it..
and in most cases these low life's cannot provide your info,,so the law is...IF YOU CANNOT VALIDATE THE DEBT THEN THE DEBT IS INVALID AND THE LAW IS ON MY SIDE 100%
that's how you screw a debt collector legally

Okay, so, I called up this place and spoke with a man named "Jonathon Brady" who claims he is from a legal processing firm called American.  I asked him where they were located & he refused to tell me. I asked him to send a letter validating the debt and he refused to do so.  I then asked him what attorney he was working for & he told me none.  I asked him if he was familiar with the fair debt collection policy & he had the nerve to tell me there was no such thing. haha.  I know just from small amounts of research that anyone trying to collect a debt has to send out a letter validating the debt.  I also know that we have a legal right to send a letter to the agency to ask that they stop calling my husbands work.  This guy is a total tool and a fraud.  Obviously since he or someone else is coming to my husbands work they have to be from the metro-detroit area.. or maybe they are everywhere.. who knows.
We have filed a police report in the city my husband works and in the city we live in.  Our next step is to wait to see if someone shows up at his work again.. if so my husband is going to snap a picture of the man & take down the make/model & plate number of his car while a co-worker calls the police.
These kind of people make me sick.  Everyone has debt these days, but most of ours is hospital debt.  My only thought is that these people somehow got our information when we were trying to finance a house.  Moral of the story is, keep your personal info under lock & key.  If we can get at the person coming to his work we are going to hire an attorney and sue the crap out of these people.

Just a little update since my last post.  There has been a man coming to my husbands work telling him he is going to serve him unless he pay him money.  My husband told him the other day to serve or he was going to call the police.. the man left.  Today he calls me to tell me that they called him at his work and told him he was going to go to jail and that they were going to ruin his job.  We are going to file a police report today and I suggest that anyone else who lives int he Metro Detroit area that has to deal with these people do the same.  Eventually they will come to your home or work and harass you.

First of all, I am a female.. secondly i am not working for whatever company it is.  My husband called me that day from work and told me that a man in a suit was there to serve him, but told him that if he gave a $50 payment then they wouldn't serve him.  I told him it sounded strange and came on here to look up some info.  I cancelled our debit card so that they couldn't take the payment & guess what! He just called me and told me they are at his work agaiN!! I told him to tell them to serve him with legal papers OR that he was going to call the police.

My in-law got a call today from these people, told him that if my husband didn't call by 4pm they would go to his work to serve him papers.  At 12:30 someone dressed in a suit showed up at his work and served him, then told him to call and make a payment of $50 with a debit card to avoid being charged $3500 in court.

Lynne: You are not the only one who has given information. More than a few people have actually paid these people hundreds of dollars before they found out it was a scam. Because they have so much info already, it's easy to see why people believe it. If you have given them any information at all (SSN, DOB, drivers license, address, etc.) do the following:

*Put a fraud alert on your account with all three credit bureaus.
*If you gave them any banking info, debit card or credit card numbers, cancel them immediately and tell your bank about what happened.
* File a complaint with the Federal Trade Commision at https://www.ftccomplaintassistant.gov/
* File a complain with the Attorney General for the state you live in.

Telephone Collection Scam Related to Delinquent Payday Loans

12/01/2010?The IC3 receives a high volume of complaints from victims of payday loan telephone collection scams. In these scams, a caller claims that the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check cashing services.

One of the most insidious aspects of this scam is that the callers have accurate information about the victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and names and telephone numbers of relatives and friends. The method by which the fraudsters obtained the personal information is unclear, but victims often relay that they had completed online applications for other loans or credit cards before the calls began.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide to the victims any details of the alleged payday loans and become abusive when questioned. So I should have done some research before calling this company back. I admit it sounded a little shady but they had so much info that I believed it to be real! This is the same scam as many other people have reported from a fake company called "ACS". They may give different company names and call from hundreds of different phone numbers. After researching it looks like they are using prepaid phones or possible magic jack or something similar to make these calls. They have fraudulently obtained old debt information and/or pay day loan information for several people. Whether or not you paid your debt (if it's valid) they are still calling. They have been doing this since 2008 but have really ramped up their efforts in December 2011 as I see an influx of complaints about these scum on various websites over the past few weeks. They will tell you that you will receive a summons, have failed to appear or that they are going to come and arrest you at your home or work (in my situation they said they would be at my house in 2 hours with the police). They try to tell you that you have defrauded a financial institution or something similar. They will ask you for your SSN and personal information. DON'T GIVE IT TO THEM! Don't verify any information for them. Unfortunately, they probably already have much of your information such as you DOB, SSN, drivers license, address, relatives names/phone numbers, etc. When they call, question them about their location, web address, name, boss's name, etc. Chances are they won't give it to you. I was told that their web address is private information. Then I was told they don't have one. These people tend to use common names such as Smith, Taylor, Cooper, Anderson, etc. If you don't want to waste your time when they call, tell them they are a scam and are being investigated. File a complaint with the FTC (Federal Trade Commission), the Attorney General, etc. Some people have filed police reports for harassment, that is how bad it is. I even saw a post on a site where these people threatened to come and to their house to hurt them if they didn't pay. This is so shameful, these people should be locked up. I hope that if everyone who gets these calls reports these people, they will eventually catch them and prosecute these scumbags. One more thing, they may give you a company name, most commonly "ACS" but they also use other company names as a cover.

I got a call from a Steven something saying he was from the Processing Summons Division Claiming that they are trying to serve me with papers over a investigation that has come across his desk.  He tells me that since he can't get a hold of me over the phone to please call him and give him a time and place where we can meet and serve me the papers because I have to appear in his office for a hearing.  First this man is not a Judge so why would he hold the case in his office.  Second he calls from a restricted number and gives no number to call him back instead he says I can contact the plaintiff directly at the 1877-373-0478 and give them the reference number so I can pay them directly why would you give me their number when supposedly they are paying him to handle the case?  Please please do your research when dealing with these people.  The get loud and angry just to scare you and pretend to be Tough Be strong and if you do talk to them DO NOT DIVULGE ANY INFORMATION OR CONFIRM ANYTHING THEY ARE TRYING TO TRAP YOU.
