ummmm yea they called me on my CELL phone...didn't give me time to answer, it rang once, and they hung up... I have no clue who they are, I don't have an account with them,or anyone else thats in collections, AND not in collections with someone else..

Listen whocares  Don't ever assume anything.  No one at my number owes anything to first equity or knew who first equity was till we googled number.  And we don't know the person they were looking for and have told them but they continue to call anyway.  We have already reported this company to the FTC and State Attorney's office, and we are on the do not call list.  Which means if they call again, they (First Equity) or anyone else that keeps calling will have to pay us $500 for every unauthorized call they make.  No one is exempt when they are calling the wrong number.

And its rude to say "PAY YOUR BILL"  you don't know the cirscumstances why the person didn't pay.  Have you heard of unemployment, plenty of jobless these days that don't even have money to buy food.
Agravating them by constantly calling makes the situation worst for them.

A true story:
End of last year a man committed suicide and left a wife and two kids, just because he lost his job and could not pay his bills.  All these scum bag companies kept harrasing them day and night and he couldn't take it anymore.  And he was only using the cards to buy food and pay the utilities.
The outcome, these companies killed this man and left a poor woman with two kids alone.  Also these companies will now never see a dime of his debt.

Like many other people eventually he would have paid all his debt if only they would have left him alone and gave him a forbearance till he was able to get a job.  Besides with the interest rates all these companies are charging he most likely had paid the debt twice and still they were hounding him for more.  Sick, sick, sick.

I have to say I am very popular with these people. I am now trying to explore that to what extent does their terms and conditions hold water legally.
Our relationship really suffered, when they imposed an over the limit fee, which is $39 and change.
With this fee added my total came to $34 over my credit limit. I think anybody not affiliated with First Equity can see the mathematical dilemma here.
So I asked for an explanation. The first two times the explained what an over the limit fee was about, and when I pushed them, to try to apply that to my case they simply closed my account. I guess if I am not an account holder they do not have to answer. So they are calling 4-5 times a day.

That happened to my cousin and I feel responsible because I had a first equity card and it worked for me and my business.  So when she got an invitation on the mail to apply told her to get it.

Well everything was fine till one day for no reason they raised her interest rate so she had like a month or two to decide if she closed the account or not.  She immediately wrote them a letter and also called them to close the account she did not accept the interest hike.  Ok she kept paying the balance on it on time every month.  

One day she arrives at her buiness and finds the place had been broken into.  Her files with all business card information and cards had been stolen.  She immediately reported to the police the break in but police asked her "Are you ok, anybody injured?"  She said yes and no one else here and I found place trashed.
Then police replied, just report the loss to your credit card company nothing else I can do here.

But since the three cards stolen were presumably closed accounts she did not do anything.  Advanta had stopped doing business, citi was confirmed closed and she had been confirmed by the person on the phone that the First Equity account was closed two months prior.  Well then the next months bill came and she sees an atm debit for $400 and calls them immediately and explains problem.  At first they credited the charge then few months later they put it back with explanation she needed to give them more information and a police report.  Several explanations later to multiple fraud depts. and still the charge is there.

IT WAS FIRST EQUITY'S FAULT, THEY DID NOT CLOSE THE ACCOUNT AND TOLD MY COUSIN THEY HAD.

Now she lost her business and both of her jobs and the stress has landed her in the hospital like so many others I see in these posts. They kept calling her day and night. Now her phone has also been disconnected so for a while she can take a little rest from these scums till she gets a job and pays them off.  Minus the $400 of course.

At first they were calling starting from 7:30 am to around 10:30 pm, and I was too weak to answer. It was really annoying.  All the stress from losing my business and my job took a serious tool on my health.  Then I went into the hospital and since I was not able to pay anything not even my phone it got disconnected.  Now I'm home in bed still recouperating and slowly trying to find a job.  But still no phone and that is good no aggravation from those crooks.

I know some day I will be able to pay them all back but not at 34% interest.

I keep getting the same results. They are looking for a Brenda who must have used my phone number.  I have explained countless times I am not the person. They are polite. Sometimes they say they will stop. They haven't so I filed complaint today with FTC. BTW, today they asked how long I've had this phone number. LOL. I've had it for over 5 years!

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

Just opened new business Sept 1, started recieving calls immediately from this number looking for a Norman?. Told over 20 times no one here by that name, called 2-3 times a day anyway. Finallt contacted the Attorney Generals office, they have had many complaints against First Equity. However, after reporting them, amazing, the calls have stopped.

First Party Agencies like First Equity, NCO, etc.. are in fact bound to the FDCPA depending on the methods used to collect on an account. If credit lender makes collection attempts using a name other than thier true business name then they do fall under FDCPA jurisdiction. So if First Equity agents called your home with a caller id of "Rays Pizza" and attempted to collect on that account as if they worked for Rays Pizza then they are bound to the FDCPA. But from what I'm reading they calling using thier legitamate business name so therefore the FDCPA doesn't apply. But there are other laws for credit lenders, check with the FTC.

That's all nice and good except when you're calling a number where whoever you are trying to reach ISN'T THERE ANYMORE.  My cell phone number gets calls for the guy who had it before me ALL the time and they WILL NOT take my number off their lists.  I have told them over and over he is not here nor do I know who he is.  I've told them if they call me again, I will be filing a complaint and pursuing legal action because it is NOT me and there's no reason for them to be calling me!

have a card with these fools. had a charge that was not mine when i lost my card. they called me and needed a police report on file. the officer said unless you lost the card in our county or city we can't file one. i told the credit card company this and they said if they have none they have to keep the charge on the bill. after there short investigation the charge stayed and i continued to pay my monthly payments. a month later they shut the card down with no notice, no call,and no reason. i called to ask why and they said because we wanted to. was never late till this month. when i call there they won't give there names,badge numbers,or put a supervisor on the phone. i am now late this month because i threw my card out. i get automated calls to call them. when i call i have to punch in card# but i don't have it. if you don't have the number you can't get through. so now i get 2 calls a day and have no way of reaching anyone unless a real person calls me. so why would a company that wants money not put a real person on the call. i went through this problem before with citibank. so for everyone that is late on card bills this is what i went through. you get a letter from the local court house that is delivered by the sheriff. accept it,read it and respond to it. file it with the local court house. i had a lawyer write the letter. cost me $500.
when they mail the letter to the court house and the company it shows you responded. shows you have a lawyer which they don't want to see. after 15 months no more letters or calls. if it goes to court in pa they can't garnish wages in pa. they can go after assets only if your not married. if your married they can't go after anything because what's yours is also your spouses. they can't take what's his or hers if they don't owe anything. the only person they can go after is the person that signed for the credit card. credit card money is money that is unsecured money. fight it and everything stops. i owed citi bank $45,000.00 it stopped after 7 years it's gone and you don't have to file bankruptcy.
