in 2010  card services sent me a letter stating they will settle they account for 36 months for $ 83.00 . for 36 months . After 36 months I thought I was done. 6 months later I received a letter from CARSON SMITHFIELD  debt collector saying I owed them $800.00. I sent them the paper that I signed from Cardwork Services and told them I am not paying them a dime but still they keep calling. They can call all they want.

The good thing about Carson Smithfield is they just make phone calls and barely send a piece of mail once in awhile. When the seven years is up the Advanta (or Merrick) or what-have-you tradeline is off your credit reports and dead, done and gone. Meanwhile "no" and "I don't share that information" are the only two things that need be said to their collectors. And at least these are Americans ... lots of other places outsource to India or Costa Rica or the Philippines for their phone calls. At least you can say that for Berman, he hires Americans.

These people call many times a day, and never leave a message!!!!...It is my cell phone, so will try to block them...One time I DID answer and the line went dead, so thinking maybe they have an auto-dialer, like when I worked for GE Capital?

It's Carson Smithfield, LLC, which is related to Cardworks, and which collects on Advanta Bank card debt but also on one or more others (Merrick Bank, if I recall correctly).

Buffalo-area bottom feeding collection agency headed up by a principal named Berman who has been previously targeted by the Office of Thrift Supervision for some sort of shenanigans.

Wow! This is a new one to me. A kid (maybe 16 or so) comes to my door to tell me that I will win $1000 worth of gas or groceries and that they have a daily drawing for other things like carpet, furniture & matress cleaning as well if I just answer the phone when this number calls.  He already had my phone number (I have a listed number, easy to find) so I just verified that he had the right number.  Since that day, I've received numerous calls from odd numbers, but none of which were from the number he told me to answer.  I called this number to tell them to remove me from whatever list they put me on, and a collection agency answers.  Unbelievable the levels some companies will go for an old trash debt that's over 8 years old and uncollectable.  Trying to use these tactics to collect a mere $15-20 that it's worth now.  It's not even on my credit report anymore so . . . . Good Luck Carson Smithfield. I feel bad for the kid that thinks he's selling carpet cleaning.

I have been receiving upwards of six calls per day.. no one ever on the other end. i finally called back and talked to a man who was looking for the previous owner of my house! I told him that we've owned the house for 3 years and our phone number has been ours for over ten years.. he stated that they google addresses and call whatever number pops up. good to know... supposedly he's removing my number from their system... we'll see

If it's a wrong number, then you work that through with them so they stop calling.

If you're the right person to call, telling them "no" will probably get them down to calling no more than once a week. You could also write them a cease and desist letter.

Write them a letter requesting proof of claim. If the original debtor wrote the item off, the collection agency purchased a bad debt and is attempting to strong arm you into paying. No activity on an unsecured account meaning no charges or payments by debtor, and no attempt to petition the court for judgment against the debtor within the 36 month time allows the debt to prescribed.  In the letter advise the collection agency to stop all communications. Begin tracking the continued contact by the parties and you may counter sue the collection agency for harassment which you can be awarded up to three times the amount of debt claimed by the creditor.  As for reporting to the National Credit Reporting Agencies, most true negative activity can be reported for a maximum of seven years unless it is related to bankruptcy, then it is reportable for up to ten years.  All of this information is obtainable through research.  You are also entitled to one free report from each National Credit Reporting Agency each year.  If any creditor lists you, or changes the information filed, then you are entitled to another free report for review.

An attorney advised me that any unsecured debt that has no activity for 36 months is prescribed and CANNOT  be collected.  If the debtor files bankruptcy a proof of claim is required by the creditor and if the debt has prescribed the Bankruptcy Court denies the claim and disallows the listing of the creditor in the bankruptcy  Activity is either a payment or charge by the debtor, or the creditor files petition to obtain a judgment in a court of jurisdiction for the debt. The is necessary for the debtor to be served notice of court hearing and documents filed against them by the creditor.  Any negative accounts can be reported to the National Credit Reporting Agencies for a maximum of seven years from the date the account was either first reported delinquent, or the date of the last activity. Many unsecured creditors write off the debts, then third party agencies buy these debts in an effort to "strong arm" collections The Federal Government has a commission in place that establishes Fair Debt Collections. A letter to the third party agency advising them to cease and desist communications is required, and if attempts to contact the debtor continues harassment can be filed and the debtor can receive up to three times the amount claimed as owned by creditor for the harassment.

Debts do not become null and void unless you file for bankruptcy and then in essence they are.  Statute of limitations, however, on ability to collect a debt is not enforceable after 7 to 10 years depending on your state's laws.  Some are even 5 years.  The obligation to pay is still there but they can't do anything about it legally and attempts to collect on a debt are illegal if they are past those time frames.  You can win against them in a court of law if you pursue going after them for making any such attempt.  The reward is not very much and not worth the hassle.

yeah. back in 2008 ALL of my business cc's went from 0-6% to 32-34% OVERNIGHT. Impeccable payment history. They told me that they jacked my rates because my business (construction) was now "high risk". So they all made it impossible to even pay down. I let it all go. They can kiss my wide one, as far as I am concerned.  They can get the statute of limitations as far as I am concerned. I lost a few years of my life being that stressed out to the maximum. The phone calls ALONE were enough to drive someone over the edge.
